Is it legal to create marketing materials to beef up your resume? Lets say it was posters and videos; would I get in trouble for using copyrighted items such as logos and trademarks to create something an advertising agency might create? I have some background in web design and filming and editing videos and would like to know if the below scenarios are viable. Example: Diet Pepsi. I like drinking Diet Pepsi and would create a 30 second "TV commercial" that I think a typical advertising agency would produce (although on a much lower budget and scale) Example 2: Video games. Lets say a new highly anticipated video game will be coming out and I then go and create a typical 1 page magazine advertisement for it. Question 1: Is it okay for me to do both? FCC Votes to Begin Crafting `Net Neutrality' Rules Oct 22 12:42 PM US/Eastern By JOELLE TESSLER AP Technology Writer WASHINGTON (AP) - Federal regulators took an important step Thursday toward prohibiting broadband providers from favoring or discriminating against certain kinds of Internet traffic. Despite the concerns of telecommunications companies and the agency's two Republicans, the Federal Communications Commission voted to begin writing so-called "network neutrality" regulations. Proponents say the rules would prevent phone and cable companies from abusing their control over the market for broadband access. FCC Chairman Julius Genachowski said regulations are needed to ensure that broadband subscribers can access all legal Web sites and services, including Internet calling applications and video sites that compete with the broadband companies' core businesses. "Internet users should always have the final say about their online service, whether it's the software, applications or services they choose, or the networks and hardware they use to the connect to the Internet," Genachowski said. The FCC's two other Democrats voted to support his plan. The agency's two Republican commissioners voted merely to start the formal rule-making process, but said they are opposed to the substance of Genachowski's proposal. Republican Commissioner Robert McDowell said he remains unconvinced that broadband providers are engaging in widespread anticompetitive behavior that requires government intervention. "I do not share the majority's view that the Internet is showing breaks and cracks, nor do I believe that the government is the best tool to fix it," he said. Next up for the FCC is to actually craft the rules, with a vote on whether to adopt them expected to come by next summer. That would culminate a five-year debate in Washington that has pitted Internet companies such as Google Inc. against some of the biggest phone and cable companies—including AT&T Inc., Verizon Communications Inc. and Comcast Corp. The broadband providers insist they need flexibility, free from government intervention, to keep their networks running smoothly. "We continue to hope that any rules adopted by the commission will not harm the investment and innovation that has made the Internet what it is today and that will make it even greater tomorrow," Comcast Executive Vice President David L. But companies such as Google, Amazon.com Inc., eBay Inc.'s Skype and Facebook Inc. argue that without such rules, the broadband companies will become online gatekeepers that can prioritize their own online services or those of their business partners—and potentially put others at a disadvantage. Markham Erickson, executive director of the Open Internet Coalition, called Thursday's vote "the first step toward ... creating a framework that promotes innovation and consumer choice on the Internet." The Open Internet Coalition represents public interest groups and big Internet companies, including Google, Amazon and eBay. Genachowski's plan calls for the agency to formally adopt four broadband principles that have guided the FCC's enforcement of communications laws on a case-by-case basis. Those principles state that network operators must allow subscribers to access all online content, applications, services and devices as long as they are legal. The FCC relied on those guidelines last year when it ordered Comcast to stop blocking subscribers from using an online file-sharing service called BitTorrent, which is used to transfer big files such as online video. August 26, 2009 8:26 PM Declan McCullagh - Democratic Health Care Bill Divulges IRS Tax Data Posted by Declan McCullagh (AP) One of the problems with any proposed law that's over 1,000 pages long and constantly changing is that much deviltry can lie in the details. Take the Democrats' proposal to rewrite health care policy, better known as H.R. 3200 or by opponents as "Obamacare." Section 431(a) of the bill says that the IRS must divulge taxpayer identity information, including the filing status, the modified adjusted gross income, the number of dependents, and "other information as is prescribed by" regulation. That information will be provided to the new Health Choices Commissioner and state health programs and used to determine who qualifies for "affordability credits." Section 245(b)(2)(A) says the IRS must divulge tax return details -- there's no specified limit on what's available or unavailable -- to the Health Choices Commissioner. The purpose, again, is to verify "affordability credits." Section 1801(a) says that the Social Security Administration can obtain tax return data on anyone who may be eligible for a "low-income prescription drug subsidy" but has not applied for it. Over at the Institute for Policy Innovation (a free-market think tank and presumably no fan of Obamacare), Tom Giovanetti argues that: "How many thousands of federal employees will have access to your records? The privacy of your health records will be only as good as the most nosy, most dishonest and most malcontented federal employee.... So say good-bye to privacy from the federal government. It was fun while it lasted for 233 years." I'm not as certain as Giovanetti that this represents privacy's Armageddon. (Though I do wonder where the usual suspects like the Electronic Privacy Information Center are. Presumably inserting limits on information that can be disclosed -- and adding strict penalties on misuse of the information kept on file about hundreds of millions of Americans -- is at least as important as fretting about Facebook's privacy policy in Canada.) A better candidate for a future privacy crisis is the so-called stimulus bill enacted with limited debate early this year. It mandated the "utilization of an electronic health record for each person in the United States by 2014," but included only limited privacy protections. It's true that if the legislative branch chooses to create "affordability credits," it probably makes sense to ensure they're not abused. The goal of curbing fraud runs up against the goal of preserving individual privacy. If we're going to have such significant additional government intrusion into our health care system, we will have to draw the privacy line somewhere. Maybe the House Democrats' current bill gets it right. Maybe it doesn't. But this vignette should be reason to be skeptical of claims that a massive and complex bill must be enacted as rapidly as its backers would have you believe. Update August 27 11 a.m: Marc Rotenberg of the Electronic Privacy Information Center says in e-mail: "We would oppose section 431(a) of the bill because it violates the intent of the Privacy Act which generally requires agencies to obtain information directly from individuals and not from other agencies." We are practically broke as a country and printing money and getting in more debt to China or whoever else is not a responsible action. It takes billions to implement and the free market must be allowed to give consumers options they want not mandated insurance. The federal government has a track record of not being efficient and losing money just look at social security then the Post Office and other agencies losing money. We need to start paying as we go and reverse the deficit or else America will be crippled significantly and in jeopardy of being worse off than the recession we are experiencing. Common sense says that when you are in great debt you do not incur more of it but seek to pay off that debt with more income. We should aggressively allow oil drilling and refining and get the tax revenue from that to increase federal revenue. We need to use our own oil and the gas combustion engine is not going away any time soon despite the newer technology around. Selling that oil to other countries will also bring more revenue. Most cars on the road are older and most people cannot afford hybrid cars so face reality please. Other concerns: the border fence was approved but it is not being built: we need to stop the incursion of illegals that drain our state and federal financial resources and fill 30% of our prisons. NO to Sonja Mayor as a Supreme Court judge; she was a member of an all woman's group which is not appropriate for a judge and she thinks in racial terms as when saying a Latina is better than a white man and she was reversed by the Supreme court when she decided it was OK to discriminate against white and Latino fire fighters who scored better than black fire fighters. You are on the wrong side of history if you continue to ignore fact that Congress has not qualified President Obama as a natural born citizen. Several days ago I saw a house for sale that looked like one I would be interested in purchasing. I went to the agency's web site that had the listing and got the MLS#. I sent an email to that agency but did not receive a reply, so I contacted a real estate agent with whom I had spoken with several months ago when I was considering selling my current home. Instead of getting me the information I requested, she said she couldn't do anything for me unless I signed a Buyer/Broker Agreement and also implied that unless I was ready to place my current home on the market, there was little else she could do for me. I've been smoking 30 years. I live in Arizona where we just started getting Fire Safety Cigarettes. For three weeks I was constantly getting ill, and having never heard of fire safe cigs, had no idea why. I immediately noticed my cigs (Marlboro reds) kept going out, not in a few minutes, more like every 30 seconds, Very annoying. My dad a 50 year smoker called me one day to say his cigarettes, (Marlboro Light 100's), kept going out, and tasted awful. So I e-mailed Phillip Morris asking "What's going on"?. I googled, 'Marlboros keep burning themselves out'. I was appalled at what I saw. Web sites, blogs, and forums abounded with smokers complaining about getting sick from smoking these FSC cigarettes. I couldn't believe our government would force a product on its citizens that were making smokers across the country sick. Didn't anyone bother too do some research on the health impact of these new 'safer' (not) cigarettes? I immediately went to my vendor, and after searching there inventory found and bought five cartons of regular not FSC cigarettes, (labeled above the bar code). Within two days of smoking regular Marlboro's my illnesses subsided, and after a week I felt like my old self again. Now I will have to start buying them online from companies in North Carolina, a state that still offers regular cigarettes that don't make me sick. After that I will buy them from Russia if I have too, or search out a black market, as I'm sure they will be popping up real soon. Fire prevention agencies claim it will save 700 to 1,000 lives per year. New York Department of State did a study in New York State, a state which has mandated FSC for four years now, and found that deaths did drop from 31 deaths to 22 deaths in 2004. Harvard School of medicine said that five compounds in the FSC cigarettes had increased in toxicity, but there was no evidence that these increases affect the already toxic nature of cigarette smoke. OH REALLY, then why am I finding smokers all over the internet complaining they're getting sick? , I know they made me sick. Those entities that are pushing this garbage on us didn't even have the courtesy to tell us smokers what they were doing. These 'speed bump rings' that are incorporated into the paper, has increased amounts of a glue produced by DuPont used to adhere carpet, and is very toxic, (Adhesive ethylene vinyl acetate). First our government unjustly targets smokers with a huge tax burden of 500% the past ten to fifteen years, now there going to poison us. Did I mention the taste? These RSC taste terrible, another factor I’m reading from smokers across the country online. The amber or (cherry) at the end of the cigarette doesn't burn the same and allows too much air to mix with the smoke, and you can't get enough taste. So you end up drawing on them repeatedly trying to get a good full drag. You end up with uneven burning and ambers falling all over the place. Seems to me this is going to cause 'More Fire Hazard'. Also the constant relighting causes the paper to ignite into a real flame, and has even blown up in my face, and I only smoked a few packs of them. New York States 2004 study claims nine lives were saved. Nation wide that would be 450 lives per year, less than the number of people a 'month' who die from tripping and falling down. But it's okay to make thousands of smokers’ nationwide sick. How many smokers a year will die now from the higher toxicity in the paper, only time will tell… If we allow these non smoking advocates to 'dictate' what we consume, were will it end? There's still as many non smokers dying each year of lung cancer and heart disease as smokers, considering the high levels of pollution in our cities nationwide. Fast forward to June 08, they repost my position again, so now the first position, god knows what happen to it. So I apply to the repost and now they're telling me that my paper work is stuck at OMB again for whatever reason, hiring freeze. I'm like how come my paperwork always get stuck at that particular time. Anyway, I've been on a few interviews since last year but nothing never became of it, either because I wasn't really intrigued about the position or maybe it was that most of my applications were sent because of frustration and I just didn't know if I was going or coming in this place. Alright, so its now February 09, in a few months I'll be hear 2 years. Now the lady that was here for 20+ years left this bureau and went to another agency because she just about had it with these people. From the scandals in management to the lunatics that we have to work with in other bureaus, this is just a nut house. This nut house however, has made me into a serial entrepreneur, and has allowed me to channel my frustration to create websites and I now have my my own internet marketing and web design company. I alreaedy have my comp registered but its under my mom's name. But I have the site up and I'm ready to heavy marketing. So here I am in the present and just about ready to get out of here so I can focus my energy on my business, my 2 girls and increase my skills for my entrepreneurial dreams by going back to school and taking some business courses. I would really like to just leave this place and get unemployment benefits becaues I know they will keep stringing me along and using the hiring freeze as an excuse. I have no health benefits, no nothing. I had to skip 1 week for the last month just to get my 1 year old daughter medicaid. If i dont come in or my kids get sick I dont get paid. Its ridiculous, I could do so much with my sites and my new business ideas. I have my bf that's working and soon we'll be getting a good refund that should help sustain. When I'm here its all chaos and frustration seeing management get over with their affairs and scandals. I've had it. I need some way to get out with a good cause for unemployment. They already know that I'm frustrated but they think because of the economy I have no where to go. They don't know about my business that I have and the web design skills that I've been advancing. They think I'm just a simple young procurement agent who has (2) girls and needs to hold on to this because I need them more than they need more. Even so, that's the least I'm thinking, I would just like to go and start working on myself, my future and making sure I'm there for my girls and not have to scramble with them everyday to come to a place that is only frustrating me and stressing me out. Does anyone know how to go about getting a job in web development or web design...even programming. My partner graduated 3yrs ago with Msc in IT web development and just can't seem to find a job in his field. He applies online and has registered with loads of agencies. But nothing. Is the market really dry? Are there just no IT jobs out there? Can anyone enlighten me? Any advice would be appreciated. more
