Voting Question: Gianvi Birth Control?

Last night my pharmacist convinced me to switch from Yaz(which I've been on for about 2 years) to a generic version of yaz called, Gianvi, to save money. I decided to look up Gianvi and see if it is the same, and what I found was pretty scary. Apparently Bayer(maker of Yaz) is suing Teva and Barr(makers of Gianvi) for "false advertising and patent infringement in connection with Teva’s generic oral contraceptive Gianvi™ Gianvi™’s label falsely claims that its formula and product, now in the US market, contains the same product stabilizer as YAZ® (drospirenone & ethinyl estradiol) Bayer’s oral contraceptive / Suit filed in the Northern District of Illinois (Chicago)" My pharmacist swears up and down that Yaz and Gianvi are the exact same thing, but I've also found people online saying Gianvi is causing them major stomach pains, mood swings, fatigue, and weight gain. Basically my question is should I be taking Gianvi over Yaz? I'm really worried, but I never know what I can trust online. Sources in answers would be very much appreciated. Sorry for wall of text. more

Resolved Question: Can home owners in Illinois sue me if I refuse to close on the house?

I tried to buy a house in Illinois but had so many problems with the real estate agent and the home owners. I brought home inspection to inspect the house and found several problems. The homeowners said that they would fix everything before closing. Closing came and they didn't fix anything. Later in the month they said they fixed everything now (second closing time). We brought a home inspector again and the home inspector said they didn't fix anything again. So later the owners made a deal with me and they would give money instead of fixing it, so I agreed. Just before closing the owners said they want to take the bar from the house claiming it is movable object. But the bar was listed in the flyer of the house, which is false advertisement. My own stupid lawyer who already took money in advance claims that the owners are right and they can move any object movable. So I got fed up and refused to go along with closing the house. I told my lawyer I don't want to house anymore, because they are playing games. Now they want to sue me for damages? Don't I have the right to sue them for trying to steal the bar (false advertising)? That is also a crime for attempted robbery. I am the one who should sue for damages not them. I lost my 8 thousand dollars from the government because of the owners. I lost lawyer fees, and real estate fees. They have the nerve to sue me?Yes the bar was listed as part of the house plus they have pictures and they even told me it is part of the house at open houseChris, How can they take the bar even if it is movable and it is listed as part of the house? Are you kidding me? So you would enjoy being ripped off?The bar is movable. But so what it was listed as part of the house. Once something is listed as part of the house it is illegal to remove it.I can also press (criminal charges) attempted robbery against the real estate agent, owners and their lawyer for trying to take the bar. This is deceptive practive for their lawyers part. First he said the bar will stay, now he says owners can take it. Sounds like a hippocrite to me.The purchase agreement are extra things that should stay in the house such as refrigerator, washer dryer etc... Not things that are listed in the ad or flyer of the house. That would be very stupid if they can take anything not listed in the purchases agreement. You don't need to list things that are already part of the house as advertised. That would be a misleading. If they have the legal right to take the bar, Why did they even mention it to my lawyer to tell me? That means they know it is illegal. If they have the right to take the bar, then they should of kept quite until closing. more

Resolved Question: How do you feel about "body enhancing apparel" for women?

Do you believe that it should be considered illegal and false advertising? Would you agree that since a company can be sued for false advertising that a woman could be sued for the same? Would you feel betrayed by a woman if she wore these items, and when you were alone you found out you got punked and she didn't look like what you first saw? Should there be a law in legislation passed to prevent companies from making these items, or from a woman wearing them, unless it was her job uniform, and only then and only then would she be allowed to wear them? After her job, should she be required to remove the items and put on "normal" clothing? If you were on a date or asked a woman out, would you leave/dump her if she wore these items? Should she by law have to inform you that she is wearing these items, so not to deceive you? What would you do in this situation? Not just the bras, it's the body sculpting items that make them look slimmer, when a man gets thm home and she takes off her clothes, the flab folds out like a Navy life raft, and the items that make their butts appear full and round, the bras that make them appear bigger or look firm, when they look like two eggs sunny side up, or sag and look like two tube socks with oranges, or flat as two beaver tails, and sagging to their wast. more

Resolved Question: Can you sue for false misleading and deceptive advertisement, and for non disclosure?

Recently, this car company, advertised in this magazine the following statement: 100% Guranteed Approval No matter What. 0% down, and 179.00 dollars per month on there cars. I wwnt to the lot to purchase the car. After I test drove it, I was told that I had to fill out a credit app, to see how much money I would have to put down. Resolved Question: Should I try to come up with the money and pay her back, or take it to court?

Yesterday, I sold my old jeep to a young lady and her father. They had driven the car 3 times before deciding to buy it, and her husband and father inspected the vehicle and said it was good. They checked everything-the tires, motor, transmission, and after driving it, her father said it was a good car. Today, the girl called me, very angry and said that she wanted her money back, because the car wouldn't start, and the windows wouldn't roll up. Now, I was surprised because as I had told her before, the car had worked for me absolutely every time I used it. And the windows were working. She said it was false advertising, and her husband threatened to sue me. Now, from the people I've talked to, I know that once the deal is done, it's over. I signed the title over, they gave me the money, and that was that. The car was working just fine while I had it. So what should I do now? I will be speaking to an attorney tomorrow but I want to have an idea or at least a few opinions on what to do. I don't even have the money anymore, I used it for college. I feel kinda helpless. Any ideas? It's a 1994. What could they possibly sue me for? more

Resolved Question: My peanut butter does not taste like chocolate and I'd like to sue the company! POLL: Any attorneys here?

I bought this peanut butter that says "dark chocolate" flavor but it does not taste like chocolate. It tastes like sugar-coated squirrel vomit. I would like to sue the company for wasting my $5.49 for a small jar. How do I go about this? Look I know I could return it but I'm almost done with it and it's time that peanut butter companies pay for their false advertising. Even if it has chocolate liquor it doesn't taste like it. So why say it's chocolate flavor? Forget the oil spill, it's time we as Americans take a stand for what really matters AND can actually be fixed. Are you with me?All 3 of you: the answers are in my text. So you're the dumbass because IT SAYS "DARK CHOCOLATE" RIGHT ON THE LABEL YOU IDIOT! more

Resolved Question: Can I ask this photographer to take down my photos?

I'm currently in the process of suing my photographer. She took my photos for my engagement announcement, and we were charged for this and a partial deposit for the wedding photography as well. After paying her, we just never received the photos. She kept making excuses and saying they were lost in the mail, but then retracting this and saying they hadn't been mailed yet, etc. Lots of lies. We've tried everything to get our pictures but she's basically just a liar and a fraud. Yes, we had a contract. And we've been waiting for our photos almost a year now. We used a different photographer for our wedding, since she proved to not be dependable at all. But anyway - here's my question. She is using our photos as the central point of her portfolio. I feel like this is almost false advertising to display these pictures when this work was never completed or received. I realize there's the whole pictures are the copyright of the photographer, not the subject, but how can she use these to show her professional stature when she's anything but professional? Could I include this as part of my small claims case? more

Resolved Question: isn't using fake eye lashes in mascara commercials considered false advertising?

i remember in the eighties or, later or something, this shampoo company got busted for using wigs in their commercials. there was a big law suit because that's false advertising, but i literally cannot think of one mascara commercial where the model's eye lashes look even slightly realistic. how come none of these mascara companies are getting sued? that is SUCH false advertising, its the same thing as the shampoo wigs, so why no consequences now? more

Resolved Question: I am being sued for false advertising..help!?

I sold a laptop using ebay that I thought was in very good condition. When it was delivered to the buyer, he claimed that i misrepresented the item. I wrote that it was in mint condition, ran excellent, touchscreen worked great, and that it had no major cosmetic flaws that could be seen. I am not a very tech savvy guy, but obviously the buyer was because he found a million and one problems with it, ranging from a cracked harddrive (that i had no clue about), the operating system was pirated (which I told him that it was not working correctly and that I was going to look at it..he told me not to take it out of the box to look at it because I hadn't sent it yet and so I shipped it off to him ). He paid 850 dollars for the laptop, which is worth thousands (Toughbook CF-74). He is now suing me for false advertising and I am only 16 years old! I do not have the funds/time/energy to carry through with a lawsuit and have no idea what I need to do. I'm not sure if I can even be sued, since I am a minor? Please help, does this guy actually have a good case? more

Resolved Question: Can I sue the tobacco company for false advertising?

So I hate my life okay, and five years ago I was in the shop and there were these little boxes behind the counter that said "SMOKING KILLS", I was intrigued, and I bough a pack, eve though I was a year underage, I looked older, so I bought a pack. Nothing for two years!!, so I upped my daily intake.. So far nothing, the company promised me death, and nothing, just spending money on a scam!!, I'm no more dead, I just smell a bit more, my fingers are orange and smelly, and I have a wheezy cough, no cancer, not heart disease, still alive but just smelly. Can I sue them for false advertising? They promised me death, they advertised death to me, and I'm not dead, I can't go out and hang myself, because last time I tried that **** there was a load of drama with my family, so I figured this would be a more subtle way of doing stuff. I want compensation, its like I got scammed, and scams are illegal, I think.... What legal action can I take..That's the beauty of smoking, I like burning myself too. And the best part is, I can hurt myself and scar myself, and it cortorises its self! Amazing little creations!!Tobacco smoothies. Never thought of that, sounds expensive, but worth it, thanks :) more

Resolved Question: Company advertising for one job and have it be something totally different, is that legal?

An ad in the help wanted section of the newspaper is advertising for customer service representatives. For mainly electronics repair. The offer 2000/month to start and 1st week bonus! However I did some research and they are not even who they say they are on the phone. It ends up being a totally different job than what is advertised. Selling vacuum cleaners door to door and the pay is not even close to what they printed (only if you meet there quotas). I asked directly on the phone if any sales where involved I was flatly told no. So I checked it out and it ends up being nothing they advertise for. me and my father moved to peru indiana september 14th 2009 and we are currently renting. we have been looking at houses since january 23rd because we are tired of renting. we have run into a lot of shady deals. for example we put in an offer on a house that was on the market for 3 days. when we heard back from the real estate company they said that an "offer" was placed a day before we made an offer. turns out it was a back room deal and the real estate company literally threw away our offer to get double commission. Now we have run into this problem. We decided to pay full price for a home that was 31,900. It said on the MLS sheet real big THIS HOME DOES QUALIFY FOR A HOMEPATH MORTGAGE 3% DOWN NO PMI. so we thought great! not so much...they wouldnt give us the loan because the forclosure DOES NOT qualify for a homepath mortgage. you can only pay cash. we are tired of getting screwed around on back room deals and shady advertising. can we sue for false advertising since we put $1,000 earnest money down and are not even sure we can get that back. Resolved Question: Enfamil users -- will you consider switching?

"Mead Johnson, Maker of Enfamil, Loses Multi-Million Dollar False Advertising Case Against Store-Brand Infant Formulas ...The nutritional supplements under examination in the case are two fats, DHA (docosahexaenoic acid) and ARA (arachidonic acid), which Mead Johnson calls “LIPIL®” solely for marketing purposes and touts as promoting infant brain and eye development. PBM’s claim focused on Mead Johnson’s direct mailing to more than 1.6 million parents of an alarming blurry picture of a child’s cartoon duck next to a clear picture of the same image which suggested that anything other than the Enfamil LIPIL® blend of ingredients is inferior and will result in poor eye and brain development. Other parts of the false advertising campaign consist of statements that only Enfamil LIPIL has been proven to confer visual and mental benefits on infants, and store-brand formulas are a “cut-back in nutrition” compared to Enfamil. PBM successfully argued that these advertisements were false and misleading especially since PBM store- brand infant formulas have the same nutrients at the same levels as Enfamil. PBM infant formulas are formulated to contain DHA and ARA, and are sourced from the same supplier in amounts which equal or exceed the DHA and ARA in Mead Johnson’s Enfamil LIPIL®. This decision marks the third time PBM Products has sued Mead Johnson for false advertising claims. On the prior occasions Mead Johnson admitted that it made false claims about PBM’s products..." http://www.pbmproducts.com/press.aspx?ID=310 more
