Open Question: Can a landlord change a lease on you every month?

We live in Wyoming and have been renting at this apartment for three years. We had a lease to start with, but it was a three month and we went month to month from there. Our landlord died and now his daughter makes us sign a new lease every month, and the terms change drastically. Is this legal? Can you point me to case law or statutes, or even what terms to search? So I was arrested on obstruction chargers - susequently plead no contest to a 415 Peace disturbance .. time served and no probation. I was arrested approx. 4 am on a thursday morning I was held thru tuesday afternoon and then only after promting from my legal counsel did the local sheriffs dept. actually get mental health workers there to give me an evaluation. I was found sane and of no threat to myself or others. While in custody i was a model prisoner (i was in solitary confinement). just history no priors in nevada. No felonies, or prior mental health in any other state. Video arraignment friday afternoon from county jail. The judge affirmed the continuation of the mental health hold for the 72 hours and affirmed bail amount and acknowlewged it could be ;posted anytime after the evaluation and mental health release. On tuesday afternoon after the expiration of the 72 hours I was still had not been afforded bail and was forced under physical threat to be evaluated with an understanding that if i failed I would be held consqently for an unknown amount of time. time line thursday 4am(intial booking w/ hold)-friday 4am = 24 hours friday 4 am -12am saturday (end of business week) =20 hours going into weekend =44 hours served Monday 12 am - tueday 12am = 24 hours tuesday 12am - tuesday 2pm = 14 hours = 38 hours Monday thru tuesday 2 Pm (afforded oppurtunity for bail) + = 44 hours thursday thru 12am saturday = 82 hours of weekday business hours held total time in custody including weekend 48 hours = 130 hours So now knowing the time frame I have several questions 1.) Was I to be afforded oppurtunity to bail at 72 hours? 2.) what documents are to be filed by mental health if they choose not to see prisoners on weekend and how often do those documents have to be re-affirmed and re-signed (i have read that documents must be filed by mental health agencies declaring they see or don't see patients on the weekend and if they do then weekend hours are counted in 72 hour hold and these documents must be updated like quarterly or so.. any recolections?????) 3.) can a pschycological exmiation be required by the state after the 72 hour's has passed without a further court order? I know ext. of holds can be granted by the court but none were sought or affirmed by the court 4.) are 72 hour shower mandates affirmed by nevada state dept. of corrections required even for 72 hour hold prisoners. Just wonderin? 5.) on 72 hour hold prisoners what is the length of time local jails can keep you from contacting legal counsel? does the menta status and behavior of the prisoner play a role in this. WHat if the prisoner is model with no signs of aggitation or aggression? What are the rights to counsel since a criminal charge is being charged as well? I am fairly capable with researching law and code and statutes if anyone has an idea where I can find these answers I would be apprecitive. If you have answers and chapters, sections or titles of code or links I would be greatful and happy. I have 4 months left in statute to file the claim with the county for damages so any advise would be helpful. WASHINGTON (AP) Supreme Court justices appeared reluctant Tuesday to allow the family of an illegal immigrant to sue U.S. government doctors personally for claims of shockingly poor medical care. The federal government has admitted negligence in doctors' poor treatment of Francisco Castaneda, 36, a native of El Salvador who died after his untreated penile cancer spread to the rest of his body. But the government's attorneys insist the doctors are immune from personal liability. A U.S. District Court in California and the 9th U.S. Circuit Court of Appeals disagreed. At the high court, however, Conal Doyle, an attorney for Castaneda's survivors, seemed unable to convince the justices that the doctors are not protected from personal damage suits if they violated Castaneda's constitutional rights. Justice Stephen Breyer expressed skepticism about parts of Doyle's arguments. In cases like Castaneda's, Congress decided suing the federal government is the exclusive remedy, he said. "That's the problem for you in this case," Breyer said. Attorneys for the doctors and the federal government said Congress in a 1970 law gave immunity to Public Health Service doctors who treat immigrants in detention. Under that law, Castaneda's survivors can only sue the federal government, under the Federal Tort Claims Act, which bars jury trials and punitive damages and limits economic damages to those allowed under state law. If they sued in California, Castaneda's wife and daughter could be limited to about $250,000 in damages. A lawsuit against the doctors personally would not be so restricted. "This is not a case where there is no other relief," said Justice Samuel Alito. Doyle insisted subsequent laws have curtailed some of the immunity given the government doctors. But Justice Anthony Kennedy said immunity clauses are intended to make employees secure against both foreseen and unforeseen circumstances. im having an issue with my states laws & I know what is going on is contradictory to the federal guidelines concerning child support/birthing costs. I even found a question & answer page on Wisconsins website written by the dept of children & families stating that i'm right. But when I go to court I'll need to cite the actual statute or guideline. So where can I go to look at these? And if you happen to know what sections I should look in in regards to child support, more specifically birthing expenses, & tax intercepts that would be even better. Pregnant women who are illegal immigrants no longer eligible for Medicaid By NANCY HICKS / Lincoln Journal Star Around 1,000 pregnant women who are illegal immigrants will no longer receive prenatal services through the federal-state Medicaid program, beginning in early spring, according to Nebraska Department of Health and Human Services leaders. The prenatal care issue creates a conflict between two state goals: * On the immigration front, senators have wanted to make certain that illegal immigrants do not get any public benefits, passing strong anti-immigration legislation (LB403) last year. * Because of the strong pro-life sentiment, Nebraska also has provided Medicaid coverage for all pregnant women, regardless of their immigration status. The assumption is that the prenatal coverage also is for the benefit of the unborn child, who will be a U.S. citizen once born. However, federal officials have told state leaders that federal law prohibits Medicaid coverage for people who are not documented except for emergency care. That means no prenatal care for pregnant moms. Unlike Nebraska, which provides coverage for the unborn, the federal government has no similar concept. "Unborn child is not an accepted Medicaid eligibility group," said Vivianne Chaumont, director of the Division of Medicaid and Long-Term Care, in a letter to state senators. "The only Medicaid coverage that is available for an undocumented alien pregnant woman is the cost of delivery and the cost of treating complications of pregnancy considered to be emergencies," she wrote. The federal government pays for about 60 percent of the costs of the Medicaid coverage and state taxes pay the rest. If senators want to provide prenatal care for pregnant mothers who are illegal residents, the Legislature will have to create a separate non-Medicaid program in state statute, according to the letter from Chaumont. The state is reviewing the 6,000 pregnant women receiving Medicaid-funded prenatal care, according to Kerry Winterer, CEO of the Nebraska Department of Health and Human Services. All women who are not legally in the country will lose their benefits, likely on March 1, he said. The state estimates that somewhere around 1,000 women now receiving prenatal care are undocumented and will lose Medicaid prenatal coverage. That coverage costs around $850 to $950 per woman, according to Chaumont. Winterer said the letter was intended to bring the issue to the attention of senators, letting them know there must be a legislative solution if they want to continue the program. Several senators said they had only recently received the letter and had not had time to consider a solution. I will condense the points Harold made in several e-mails, as fairly as possible: He arrived 18 years ago with a one-year visa at age 15, liked it here, overstayed his visa and then had "no way" to become legal. (He could have returned home to apply, lawfully, as millions of others do.) He tried to get citizenship through marriage, but the marriage broke up and now he's a single father with a home he owns, a car, a driver's license, insurance and two kids in Catholic school. He sounds like a good American, but is he a good citizen? He sees proposed House Bill 4321 as providing amnesty to "those who follow the law, up to date in taxes (if able to pay) and have been in the country for more than five years. I do not understand the part in capital letters. An excerpt from the Finnish Parliament's official website: "... After the President has signed it, the law is published in the statute book. The President can also refuse to ratify a law. In this case it goes back to Parliament, which can either approve the law without amendments or reject it. If Parliament again approves the law, IT COMES INTO FORCE WITHOUT RATIFICATION. If it is not approved, the matter is regarded as having lapsed. ..." How can a law come into force if it is not approved? To me that sentence contradicts itself. Does anybody understand this extract? more

Home of the free and land of the brave? Really. People are afraid to walk the streets at night and so on. My goodness I was watching TV the other day and they blurred out a baby's face! What the hell? Do people have hits out on babies now? Will some long standing enemy of the baby recognize them then kill them? They were literally born yesterday! Why did they censor the baby's face? Don't all babies look the same anyways? So we are not free, there are so many laws telling us that we can't do anything. And brave, people don't give a crap about one another. What about the pledge of allegiance? The very last words "...and justice for all." What about the unsolved crimes? And people that are denied justice? What about the statute of limitations? The pledge should be changed to "...and justice for a limited time only." Or "...and justice maybe for some, if they they are allowed to have it, for a limited time only." This country seems to only exist on paper. Land of opportunity my @$$. What American dream? More like the American nightmare. The USA supports education, but employers don't look at grades. I could go on with examples but most people often tell me my details are too long so after this are just examples. Read if you wish: There was a case where a woman admitted to killing a guy, getting rid of the body, and so on, in court. In front of attorneys, and so on. No one invistigated this further. No one reported it. It was just written down. Like a decade later a cold case person looked into it, found the confession and finally threw her in jail. The guy described it as "some one dropped the ball." Really not "people acted really evil and crazy"? How do you NOT report that? There was one murder that only got 8 years in jail. I forgot the case but that's crazy. Schools in this country teach students to pass tests, not how to pass life. Schools get more funding if the kids pass the tests. This country apparently supports education. But this is abuse. There are kids that understand how to pass a multiple choice test, but can barely read and write. more

Help! I have to understand the Disability Discrimination Act. I understand the original legislation was the 1995 Act but then we have the updated 2005 Act. Sadly the 2005 Act (found on opsi) seems to only speak about the amendments! Well, amendments were made by 2003 regulations also - where on earth is there the one act condensing all these amendments and the law in one statute? The Race Relations Act has an act, as it is in force today, written with all the amendments etc - does this one just not have one, or can I not find it, and if it doesn't have one, how am I (or how does anybody) make sense of it??? more

I need help on statutory interpretation, so I'll pick a theoretical scenario: In the preamble to the Protection of Sea Life Act 2001, there is an explanation that it was passed to stop over-fishing in UK waters. To live or not to live Although physician assisted suicide is a very controversial topic, it should be allowed because people who are suffering in a terminal situation should not have to suffer. You have been diagnosed with stage 4 cancer this is not in any way a pleasant way to die. You have constant pain all through the night this also leads to no sleep. You can hardly sleep, eat or even think because the pain is so overwhelming that it takes you over. The pain is not just overwhelming it is also constant it seems to never leave your body the doctor prescribes you every pain medication that is physically possible. You have bed sores that are hurting all over your body because you have been too weak to get up or even move. You just wonder if there is anyway out of this anyway to get rid of this over bearing non stop pain. The start of the first legal physician assisted suicide in United States started with Oregon. The first ever bill to legalize voluntary euthanasia in the United States was introduced in Ohio legislature in 1906. It was provided that when a mentally competent adult was terminally ill or hurt his doctor could ask him in the presence of three other witnesses whether he wished to cease to live. If the adult said yes three other physicians had to agree the patient’s condition was hopeless before the adult could be put to death. This bill was eliminated. The bill sounded to be very lawful and just yet it was defeated. Oregon became the first government to legalize physician assisted suicide. Physician assisted suicide is unknowingly not a right protected by our constitution. Physician assisted suicide involves prescribing lethal drugs for a patient with the knowledge that the patients intends to end their life with such medication. Euthanasia the most common way is the lethal injection of the patient by the doctor. The opponents of the assisted suicide are worried about the abuses of assisted if it were to become legalized. The bill that was eventually passed so that Oregon may have assisted suicide was called the right to die bill according to Richard (caring for dying). The patient may receive life ending lethal drugs under a few conditions. 1. Two doctors have to agree that the patient isn’t going to live more then 6 months. 2. The patients asked the doctor three times about for help in ending their life and the third time would be in writing. 3. The patient is offered alternate routes and hospice care instead of ending their lives. This bill was passed in November 1994 with a 51 percent to 49 percent win. Jack Kevorkian took place in many assisted suicides before anyone thought anything about legalizing or is even physician assisted suicide legal. This is why it had such a huge affect because no one new about this physician assisted suicide that came up. Jack Kevorkian publicized his work in helping patients end their lives so he could help more lives. He claimed he helped more then 130 terminally ill or chronically ill patients take their own lives. Kevorkian truly believe it was okay and the right thing to do, to help people stop suffering by helping them take their lives as a physician he even went as far as to going commercial to raise money for his cause. I was abused at a dyslexic school in Suffolk in 1997. A conviction of 6 years was reached for the abuser at the Ipswich Crown court. And was awarded 12,000 pounds for mental anguish, and my mother father were also given 12,000 for lost school fee’s and air fairs, but what they claimed for was 50,000. However I feel that 12,000 pounds is not enough, to make up for my lost childhood. I have been trying to find out if I have recourse for a seconder claim. And have been using a well known law firm ( small but well known ) but have been very unhappy with there service. In 8 months all that has been done is write too the old school and that is it. (I found out >>)The school was sold in 1998. The lawyer told me, it was most likely that there was nothing too be done. However I tracked down the ex-owner myself from Australia as well as the school’s lawyers at time, I also had to hire a PI to help confirm my finding. I don’t feel I should have had to do this, as I am the client. They ignore my questions and instructions regarding my case. And for every 6 emails I send them I get one very short one back. I am doing more running around here in Australia then they are in the UK. Now ....know one knows if a full and final statement was ever sighed. As I was 13 at the time. My lawyer's legal aid said she did not think it would be a problem if it had been sighed as I was under the age of 18. A media exclusion contract was sighed ( it was for 5 years ) but that is all, that my mother and father can remember, witch they felt forced to sigh as it was. We did not have proper legal advise, having been recommended to a firm, but where told they would not take on the case, but would be there in a supportive roll only. Funny they still sent us the bill! We found out some time after that they were not child abuse experts and were more corporate lawyers then anything. According to The New York Times, ruling in authoritarian fashion is normal and acceptable. “Any president has vast authority to influence policy even without legislation, through executive orders, agency rule-making and administrative fiat.” In fact, Obama’s plan to rule by authoritarian decree is unconstitutional. Article I, Section 1 of the Constitution states: "All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives." I watch law and order SVU and it sickens me that there is a 5 year statute of limitations on rape. There is no limitation on murder and although, i don't feel like there should be i feel that rape is just as bad if not worse than murder. Those victims go over what happened to them over and over and who is our government or law enforcement or whoever it is that makes these laws to tell them "oh well you may have been raped over and over but that was 5 years ago. SORRY." I feel that if they must make a limitation why not 25yrs or 50yrs who the heck came up with 5? I just think its Absolutely ridiculous. Do you agree?
