Open Question: traffic question (stop sign voilation)?

I was stopped for florida statute 316.123 (2) (a) this morning. However I was stopped at the stop sign and my tires were behind the white line for over 30 seconds. There was a motorcycle in front of me that was 5-6 feet in front of the stop sign. He pulled out across 2 lanes, into the median, then followed into the median. We both pulled out and a police car came up fast and pulled me over. I saw him when I was sitting at the stop sign. So I had no idea why I was being pulled over. He said I failed to obey the stop sign. I find that untrue, since I sat at it for over 30 seconds.... Anyone have any idea what I did wrong? Also this should easily be dismissed in court, as the violation says failed to obey stop sign. If i didn't follow the law, id pay my ticket right away, but this is ridiculous. more

Voting Question: PA Landlord thinks we owe more than security deposit but is outside statute of limitations?

My husband and I were living in PA and our original lease ended August 31. We moved out August 21, and had our landlord sign a letter stating that we were released from our lease obligations effective the 21st (though we paid the whole month), since she wanted to have people come in and do work and we didn't want to be held responsible if anything happened. Our landlord told us before we moved out that we owed her a lot of money for damages (mostly a burn on her laminate counter top). We asked her several times before we moved for a copy of the work order so we could see that this was actually the cost, and she never showed us any paperwork. We figured it was for her to show us, so we didn't worry. Well, we moved out and never heard from her. We are aware that she has 30 days from THE DAY WE MOVE OUT (which effectively terminated the lease) to send us a letter explaining why we are not getting our security deposit back, and detailing any damages and money we may owe her. We never received such letter. We did not give her the address we currently live at, since we did not close on our home until a few days after we moved, but we did give her my in laws address which is where we were staying until we moved. She did some deceitful things, like calling our moving company and the HR department of my husband's old company to try to get our new address, since she didn't believe us! We did give her a legitimate address, just didn't want to give her the new address in case something happened with closing. My in laws still live there, and she could have reached us there all along (it is only 15 minutes away), and she did not have to go above our heads to try to find our address. Anyway, today (33 days after) I received a certified letter from the district court in PA suing us. I refused service since I know she did not follow protocol and is past the 30 days. My husband called the post office and wants to accept service, which is fine I don't care. My understanding is that after 30 days, she waives her rights to try to collect more than the security deposit. Also, from what I understand is we can sue her for the security deposit. If there were no additional damages, we could sue her for double the security deposit, but then she could counter sue us. Can we really sue her now, and not risk her counter suing, if we just sue for the security deposit? So what are my rights at this point? What are her rights? Can we sue her for our security deposit and not be counter sued? By waiting more than 30 days, did she waive her right to sue us? By not sending us a letter first, and going directly to court, is she in the wrong? Thank you so much in advance for ANY help!I meant July, not August for when we moved out! more

Bush and his appointees for criminal violations of the Civil Rights Act of 1964 and the Voting Rights Act of 1965 via the corruption of his DOJ in the period 2001-2008. There can be no impeachment proceedings against G.W. Bush, because he no longer holds elective office. However, the statute of limitations on crimes committed by G.W. Bush and his appointees during his presidency is not up. By the Right’s new standard of civil and voter rights justice for Obama’s DOJ, the Right should be outraged by Obama’s hypocrisy if his DOJ does not pursue this case against the former President because of its political consequences. Resolved Question: Can my landlord require my roommate to sign the lease? (MI)?

My roommate and I have lived together for several years. She has always been listed as an occupant on the lease, not a resident. Now that I am renewing my lease they are saying she has to sign the lease as a resident and pay a $100.00 application fee. I have lived in this complex 10 years, she has lived with me for two and this has never been an issue. Resolved Question: Does the Civil Rights Act of 1866 protect constitutional rights?

I've been following the eccentric Tennessee politician, Basil Marceaux, for a while, and he keeps claiming that the Civil Rights Act of 1866 makes it a misdemeanor to imprison or fine someone in a way that violates the person's constitutional rights. I'm trying to figure out if this interpretation is accurate. In order to determine this, I have to determine whether or not the language of the Civil Rights Act of 1866 specifically protects a peoples' protection under the constitution. It does clearly make state that it is a misdemeanor if the imprisonment/fine something that the act specifically protects. Section 2, of the Act includes, "...any person who, under color of any law, statute, ordinance, regulation, or custom, shall subject, or cause to be subjected, any inhabitant of any State or Territory to the deprivation of any right secured or protected by this act... shall be deemed guilty of a misdemeanor, and, on conviction, shall be punished by fine not exceeding one thousand dollars, or imprisonment not exceeding one year, or both, in the discretion of the court.” But the language about the constitution is less clear to me, so I was wondering if you could have someone let me know: Does the Civil Rights Act of 1866 protect the rights guaranteed by the constitution? more

My husband was involved in an incident in April involving another man. We were in the same circle as this other man, so we both knew him equally well. This other man had posted a comment on my(the wife) facebook page of a sexual nature which was naturally offensive to my husband. I completely cut myself off from said individual, deleted him from my friends list, blocked him from my facebook, avoided him altogether. That is when he started texting my phone repeatedly. He wanted to know why I deleted him, called me every name you could think of, none of which I responded to. So my husband decided to confront the man, told him he didn't appreciate the comments or the constant texting, blah, blah, then the guy laughs in my husband's face when my husband told him to never talk to me again. At that point my husband snapped, he grabbed him, pushed him on the wall and told him how serious he was. He didn't hit the guy, but he did touch him so the guy filed a complaint against him and he is now charged with second degree assault which is a class b misdemeanor in our state. He has NEVER been in trouble before other than a couple of minor traffic violations. We are wondering at this point, given a clean criminal record, and having never been in trouble with the law before otherwise, what are the chances of him getting sentenced to more jail time? He was stopped for a burned out tail light and was arrested Thursday evening, he was in jail for 6 1/2 hours and released on a OR. At this point we are just holding our breath, praying that he is not sentenced to more jail time. Hoping someone on here has experience with criminal law and may be familiar with the statutes on Assault 2 in the state of Arkansas. Thanks so much for your help. Any information is appreciated. Resolved Question: Automatic Renewal of Lease for Year in Pennsylvania?

I got an internship in a town outside of Philadelphia for this current summer. When I went through the process to get my apartment I told every complex I talked to that I would only be renting for the three summer months. On July 31 I went to give notice to the complex I ended up renting with that I would indeed be moving out at the end of August like I originally said. The people began to talk in circles and basically landed at the fact that I needed to give 60 days notice. Because I did not give 60 days my lease automatically renewed for a year. I looked at my lease and after reading it, I suppose it does say it (the wording is very ambiguous, and there seems to be a statement or two that I take as a contradiction) but what I am wondering is if it is possible to automatically "renew" a lease for a year when my original lease was only 3 months. To me, "renew" implies a lease of the same terms. Again this is in Pennsylvania, and I have not been able to find any good documentation of laws or statutes. more

There can be no law preventing such customization, especially in CA, which is famous for its customization. If you want the specific statutes, then ask at any shop that does customization. They will have had lots of experience over this. The testers simply do not know the law, and you have to come there prepared, and ready to demand to see the supervisor. Demand the specific CA statutes. If they can not provide it, they must give you a pass. I parked outside a freinds house yesterday in a white parking box. there is a sign that says free parkin except on matchdays (it was not a match day) the box in which I was parked blocked a set of gates, the gates had no sign requesting no parking and the kurb in front of the gates was raised and not dropped indicated use of gates by a motor vehicle. My car was towed. Is this illegal seen as I was pakrked in a box set out by the council, a sign saying i can park in the box was present and there was no 'no parking' signs on the gate? According to Deuteronomy 11:1 we should keep God's charge, statutes, judgments, and commandments forever. So should we keep the law till heaven and earth pass, or not keep the law? Whosoever therefore shall break one of these least commandments, and shall teach men so, he shall be called the least in the kingdom of heaven." - Matthew 5:18:19 According to the old testament law in Leviticus 20, incest is wrong and is punishable by death, bestiality is wrong and is punishable by death, homosexuality is wrong and is punishable by death, etc. In Leviticus 11:7-11 it is also wrong to eat pork or shellfish, which is an abomination. If the law is abolished somehow, why is it now OK to eat pork or shellfish, but wrong to engage in incest, homosexuality, bestiality, etc? Why do Christians keep some old testament laws and do away with others? I mean it seems contradictory and hypercritical. Just to give some context, it took place a long time ago, and it was an older woman that he knew (not a stranger.) He doesn't want to report it. He's worried that he would be blamed for it, since he was 13 at the time. That's old enough to know what's going on to some extent, but I would still call it sexual abuse, because at that age you can be easily manipulated. That age is just too young to really be able to stop something, so the victim shouldn't be blamed. I know that it's common for both men and women to have feelings of guilt in these matters. I think he's also worried about what people will think, especially his father. I don't think his father would be sympathetic towards him at all on this. Am I right that is completely not his fault? What does the law say on this, and what is the statute of limitations on reporting it? Would reporting it help him get closure on it, or would it just end up making him feel worse? I'm actually a little worried that a counselor will blame him in some way, and that might just make it worse. I don't know that much about how these things work, with getting counseling.
