I moved out of an apartment recently and did a full cleaning with my roommate. Floors were wet and dry mopped. Counters, toilet and bath were scrubbed down. Refrigerator, freezer and stove were cleaned and nothing was left behind for the landlord to throw out. The landlord now wants to deduct a $250 cleaning fee from our security deposit, however it's our understanding that under NJ tenant laws no amount can be deducted from the deposit for cleaning if the apartment is "broom clean." Any perspectives? I've seen a few sources cite that the apartment needs to be as clean as the day the tenant moved in, but the below NJ tenants law doesn't seem to support that (and while our cleaning job wasn't professional it was certainly adequate). http://www.lsnjlaw.org/english/placeilive/irentmyhome/tenantsrights/chapterthree/index.cfm#3back moreOpen Question: can i drive a crf 450X trailbike on the street?

Suicide has several symptoms, but it depends on the person. Mental illnesses, losses, safety, and grief are only on the tip of the ice burg to explain why it happens. A common illness is depression. It makes a person completely incapable of being acumen or making rational decisions. Over lasting effects can cause both mental and physical effects. A common cure involves medication, but that typically escalates the problem. Because suicide has been a controversial issue, in the united states it was strictly illegal in six of the following states: North Dakota, South Dakota, Washington, New Jersey, Nevada, and Oklahoma in 1968. My friend and I were on the beach in New Jersey looking through my purse with a lighter for my cell phone. All of the sudden, cops come up to us and start accusing us of lighting a "marijuana cigarette" as they called it (if i wasn't getting in trouble I would have laughed at how ignorant they were). The problem was my friend is a sucker, and when the cops promised that they would just dumped it out if we gave it up, he admitted we had it, also completely ignorant to the fact that cops lie. When they searched my purse, they found 4 grams in it, but nothing rolled, no bowl, and no paraphanelia, which is the reason they searched us in the first place. Also, after they had arrested us and we were walking out of the police station, I looked in my purse and they had forgotten to confiscate the marijuana, haha it's kinda funny how they cause so much trouble and don't even really care about the actual drugs. I had left it in my purse, yes I know, it was dumb, and the cops called my mom and she snuck in my room in the middle of the night and took it out and gave it to them because she's crazy and doesn't really care about me. Anyways, I'm still a minor and this is my first offense. I was wondering if anybody had any actual expirience with something like this in New Jersey and if the evidence is even legitiment because it was received from somebody not even involved in the situation and the reason they were bothering us wasn't legitiment either. Thanks for your help. moreResolved Question: Will an arrest that was dismissed in New Jersey effect me from getting government aid in Nevada (+ more)?
I was arrested in NJ for simple assault back in 2003. I was fighting with my sister. In an attempt to get away from her I slammed the front door. She went to stop it from slamming and her hand went through the glass. So, under NJ law an officer is required to make an arrest if there is evidence of harm. The charges were dismissed. (i.e. I don't have any convictions). That was the only time I've been in trouble with the law. I now reside in Nevada and I'm looking to open up a business that is centered towards the mental health field. I would very much like to open up a foster care agency, but I know that they issue a background check and I'm worried that I will be denied. I also need to file an application with Medicaid for my business and I'm worried about being denied by them as well. I'm looking into having my arrest record sealed or expunged, but is that really necessary? I'm looking over the application for expungement and I know that I can do it myself. I also know that lawyers will charge an outrageous arm and a leg for their services. I would love to find an attorney who can charge a reasonable price. I wouldn't mind a higher fee if they could guarantee that my case would be expedited. So, to summarize: Could my arrest effect my chances of getting Medicaid for a new business? Will my arrest show up on a background check that was filed by a government agency? Should I have my arrest record sealed or expunged? Is there such thing as a lawyer expediting the filing process, or is that a whole bunch of bull (scam to get more money)? If there is such thing as an attorney who offer an expedited process, can anyone recommend one? If not, then would any of you recommend me filing myself (pro se) verses having an attorney handle it? Evon Rodrigues' identity will be clear at least for the next 2½ to five years - he will be a state prison inmate convicted of sexually assaulting a teenage girl in Shenandoah. Rodrigues, 20, of Shenandoah, must serve 2½ to five years in a state correctional institution, President Judge William E. Baldwin ruled in handing down his sentence, which also requires Rodrigues to pay costs. Also, Baldwin imposed lifetime Megan's Law sanctions on Rodrigues, even though the defendant faces deportation from the United States after he serves his prison sentence. "I know that there is an ICE detainer" on Rodrigues, Baldwin said, referring to the Bureau of Immigration and Customs Enforcement of the U.S. Department of Homeland Security. In a one-day trial over which Baldwin presided, a jury of seven men and five women found Rodrigues guilty June 1 of two counts of indecent assault and one each of statutory sexual assault, aggravated indecent assault, indecent exposure and corruption of minors and not guilty of two counts of involuntary deviate sexual intercourse and one each of rape and aggravated indecent assault. Shenandoah police charged Rodrigues with sexually assaulting the 13-year-old girl Aug. 13, 2009, in his borough apartment. "He pulled me by the hand. I kept saying, 'no'," the girl, now 14, testified at the trial about how Rodrigues got her into the building. "I felt kind of scared." Rodrigues, who speaks no English, was initially arraigned as "John Doe" because his true identity could not be confirmed. Rodrigues is an illegal immigrant, District Attorney James P. Goodman said in June after Rodrigues' trial. The Megan's Law sanctions will require Rodrigues to provide his address, employment and educational statuses and any change in any of them to state police. Megan's Law was enacted in Pennsylvania, numerous other states and at the federal level after the 1994 murder of Megan Nicole Kanka, 7, of Hamilton Township, N.J. This is an insult to all who believe in religious freedom in America. http://creepingsharia.wordpress.com/2010/08/07/new-jersey-judge-rules-islamic-sharia-law-trumps-u-s-law/ New Jersey Judge Rules Islamic Sharia Law Trumps U.S. Law Posted on August 7, 2010 by creeping Fortunately, the ruling was overturned, but it’s obvious sharia is creeping. A New Jersey family court judge’s decision not to grant a restraining order to a woman who was sexually abused by her Moroccan husband and forced repeatedly to have sex with him is sounding the alarm for advocates of laws designed to ban Shariah in America. Judge Joseph Charles, in denying the restraining order to the woman after her divorce, ruled that her ex-husband felt he had behaved according to his Muslim beliefs — and that he did not have “criminal desire to or intent to sexually assault” his wife. According to the court record, the man’s wife — a Moroccan woman who had recently immigrated to the U.S. at the time of the attacks — alleged: “Defendant forced plaintiff to have sex with him while she cried. Plaintiff testified that defendant always told her “this is according to our religion. You are my wife, I c[an] do anything to you. The woman, she should submit and do anything I ask her to do.” In considering the woman’s plea for a restraining order after the couple divorced, Charles ruled in June 2009 that a preponderance of the evidence showed the defendant had harassed and assaulted her, but “The court believes that [defendant] was operating under his belief that it is, as the husband, his desire to have sex when and whether he wanted to, was something that was consistent with his practices and it was something that was not prohibited.” Charles’ ruling was overturned last month by New Jersey’s Appellate Court, which ruled that the husband’s religious beliefs were irrelevant and that the judge, in taking them into consideration, “was mistaken.” This is an insult to all Democrats who believe that a Judges rule is final. So I suggest contacting Congress. What is next the overruling of the Homosexual Law passed by that Judge in California? According to the court record, the man’s wife — a Moroccan woman who had recently immigrated to the U.S. at the time of the attacks — alleged: “Defendant forced plaintiff to have sex with him while she cried. Plaintiff testified that defendant always told her “this is according to our religion. You are my wife, I c[an] do anything to you. The woman, she should submit and do anything I ask her to do.” In considering the woman’s plea for a restraining order after the couple divorced, Charles ruled in June 2009 that a preponderance of the evidence showed the defendant had harassed and assaulted her, but “The court believes that [defendant] was operating under his belief that it is, as the husband, his desire to have sex when and whether he wanted to, was something that was consistent with his practices and it was something that was not prohibited.” Charles’ ruling was overturned last month by New Jersey’s Appellate Court, which ruled that the husband’s religious beliefs were irrelevant and that the judge, in taking them into consideration, “was mistaken.” moreVoting Question: How does the Affordable Care Act affect me (college student)?
"Young adults' ability to attain and secure health insurance coverage for themselves is often difficult. Ordinary transitions in and out of school and jobs throughout their 20s affect their ability to remain on their parent's or guardian's policy or become eligible for employer-sponsored health insurance. Entry level low-paying and temporary jobs typically do not offer health benefits. Purchasing health insurance in the individual market is unaffordable given that 50 percent of uninsured young adults reside in households with incomes below the federal poverty level. To address this problem, State policymakers are proposing and enacting legislation that extends dependent benefits to young adults not enrolled in college full-time. In 1994, Utah become the first state to enact legislation allowing coverage for unmarried dependents to continue up to age 26, regardless of school enrollment status. A 2006 New Jersey law provides coverage for unmarried dependents up to age 31, as long as they do not have any dependents of their own. At least 30 states have now enacted similar legislation to extend dependent coverage regardless of enrollment in school." This is what I've found. However, I still have a few questions: 1. Do I stay on the same health insurance plan as my parents, or is it some separate federal program? 2. Do I have to live at home for this to apply to me? (I currently live in a different state as my parents, but I am still on their health insurance as I am a full-time college student.) 3. Can I just take a break from college without risking the loss of any health insurance coverage? 4. When does this go into effect? (I have heard September 23, 2010 but I'm not sure.) moreResolved Question: WHY WON'T THE MEDIA LET US KNOW ABOUT THIS?
VERY QUIETLY OBAMA'S CITIZENSHIP CASE REACHES THE SUPREME COURT AP - WASHINGTON D.C. - In a move certain to fuel the debate over Obama's qualifications for the presidency, the group "Americans for Freedom of Information" has Released ! copies o f President Obama's college transcripts from Occidental College. Released today, the transcript school indicates that Obama, under the name Barry Soetoro, received financial aid as a foreign student from Indonesia as an undergraduate. The transcript was released by Occidental College in compliance with a court order in a suit brought by the group in the Superior Court of California. The transcript shows that Obama (Soetoro) applied for financial aid and was awarded a fellowship for foreign students from the Fulbright Foundation Scholarship program. To qualify, for the scholarship, a student must claim foreign citizenship. This document would seem to provide the smoking gun that many of Obama's detractors have been seeking. Along with the evidence that he was first born in Kenya and there is no record of him ever applying for US citizenship, this is looking pretty grim. The news has created a firestorm at the White House as the release casts increasing doubt about Obama's legitimacy and qualification to serve as President article titled, "Obama Eligibility Questioned," leading some to speculate that the story may overshadow economic issues on Obama's first official visit to the U.K. In a related matter, under growing pressure from several groups, Justice Antonin Scalia announced that the Supreme Court agreed on Tuesday to hear arguments concerning Obama's legal eligibility to serve as President in a case brought by Leo Donofrio of New Jersey. This lawsuit claims Obama's dual citizenship disqualified him from serving as president. Donofrio's case is just one of 18 suits brought by citizens demanding proof of Obama's citizenship or qualification to serve as president. &! nbsp;&nb sp;Gary Kreep of the United States Justice Foundation has released the results of their investigation of Obama's campaign spending. This study estimates that Obama has spent upwards of $950,000 in campaign funds in the past year with eleven law firms in 12 states for legal resources to block disclosure of any of his personal records. Mr. Kreep indicated that the investigation is still ongoing but that the final report will be provided to the U..S. Attorney general, Eric Holder. Mr. Holder has refused to comment on the matter... Lately, after hearing that new words are being made up by Caribou Barbie and that many conservatives are actually upset that all the justices on the SCOTUS came from an Ivy Law school, I wonder why intelligence is such a bad thing. People are saying that it's good that Sarah Palin is an "average Jane" and not "elitist intellectual scum". Furthermore, many conservatives are complaining about the alma maters of our justices. Just last week a nearby Tea Party rally spent 15 minutes ranting about our "elitist SCOTUS" and this happened all over New Jersey. Isn't it good that our justices are intelligent and know the law well. I certainly would choose the most qualified candidates for SCOTUS, not an average Jane. And wouldn't you want your President to be smarter than you? After all, the smarter they are, the better they'll serve America. Not to say that we should be a meritocracy, but a book smart President like Clinton or Obama certainly couldn't hurt after the Bushes, Reagan and Carter. moreResolved Question: I need information about FETCH Pet Care?
Generally when professionals are engaged in litigation they don't leak information, due to respect for the legal process. Apparently as other posts suggest, corporate has taken that step. In response to queries by other NJ franchises--Yes , 2 franchises, Greater Wayne-East Hanover and Somerset Hills-Long Valley, are joined in a law suit against Fetch and Paul Mann. In addition, at this point, one—Greater Wayne is being audited by the state of NJ. Contrary to buzz, the case has not been moved to California. It is before the Appellate Court of NJ. Paul Mann and Fetch were served with complaints on the following counts: First Count: Breach of Contract Second Count: Breach of Implied Covenant of Good Faith and Fair Dealing Third Count: Fraud and Misrepresentation Fourth Count: Violation of the Franchise Practices Act Fifth Count: Violation of the New Jersey Consumer Fraud Act In order to determine the integrity, stability and future of Fetch, these are just a few of the questions/requests put to Paul Mann and Fetch via attorney: Paul Mann set forth in March, 2010 that the 2009 FDD had been completed, and according to All Business Website, which gave Fetch the "Full Disclosure Award" all financial performance has been disclosed. Please make that available. The FDD received [by Greater Wayne and Somerset Hills] in May of 2009 prior to signing the Franchise Agreement was dated November 2008. Based on FDD guidelines, shouldn't they have received an FDD dated March, 2009? Why is there a major discrepancy in the financial declarations of Fetch, which are represented to be 6.25 million dollars in the media and only 1.3 million dollars with reported losses in legal papers forwarded to Brooks and Hughes? Has Fetch reported this 1.3 million dollars with respect to reported losses to all Fetch franchisees? Has it been disclosed to prospective investors and prospective franchisees and/or the media? Does Paul Mann assert that the Fetch "successful" independent contractor model he represented in May of 2009 is the same model that he is representing today? When was Paul Mann first aware of issues pertaining to the independent contractor model that would affect franchisees? When did Paul Mann start refining the independent contractor model and why? When was the newly refined independent contractor model deemed to be successful, and what benchmarks, proofs, and time periods were used to determine the success and viability of this new model? Paul Mann has himself stated that if the company has to pay 100% of the rescission money it owes, the company would be devastated. Has Paul Mann indicated to franchises to keep current financial and legal issues quiet in order to attract investors? How many active, viable franchises exist at this time? How many franchises have closed their doors in the past 2 years and why? To these inquiries and many others, Paul Mann responded that he is under no obligation to make disclosure. My roomate/ a best friend was parked in a parking spot rite next to my car. As he was leaving the parking spot the next day he cut the coorner to sharp and side wiped my front bumper and fender stripping the paint. He told me after he was back that he would give me his first paycheck (from the job he just started). So I waited for that day and of course it never came. He eventually moved to his fathers house where it would be easier for him to get back and forth to work. I assume you've heard of the Islamic SHARIA LAW. This is the law that governs anyone who professes the religion "of peace", Islam. My question is this: How many of you advocate or promote the idea of Sharia Law in America?? The reason I ask is because so many liberals and left-wingers side with muslims, some because they think that by appeasing them they won't get their neighborhoods blown up or thrown into a riot, and some because they think that whatever the ACLU does surely must be the right thing to do, and social justice has a strangle-hold on America right now, just as political correctness does. Unfortunately, both appeasing radical muslims AND political correctness will end up getting us all killed; but I digress: As gays, bisexuals, transgenders, etc, what do you think the end-result would be if we were to allow sharia law in America. Think its not possible? A judge in New Jersey just heard a case of a vicious rape of a muslim woman by her husband. The Judge decided that because the husband was Islamic and is governed by Sharia Law where he comes from, he has every right to force his wife to have sex with him, quote, "even if its on the hump of a camel". She must sacrifice herself to sexual intercourse and whatever else he desires (sexually) regardless of her state of mind, her physical condition, or any circumstance. In short, she is a total and absolute sexual slave, period. So think again if you believe groups like the ACLU are looking out for any person's best interest in America. Why should YOU care about this? Well, because Sharia Law says much, much more than just to subject women to a life worse than any dog in america: Sharia ALSO HAS SOME NICE PLANS FOR YOU FOLKS, LIKE THESE: Are you a lesbian? You will be stripped, buried to your waist, head covered with a white sheet, and then stoned to death. Your own family MUST participate in the stoning, including any children you might have from age 3 and up. Takes all the fun out of "getting stoned", ya know?? Are you a gay man? Oh goodie: you will be stripped and hanged by the neck until dead, not for stealing or for murder, but only for your sexual preferences. "Hang 'em High" isn't just a movie title anymore. Are you safe because you are bisexual or transgendered? Hardly. Men will still be hung and women will still be stoned, but the only difference is that you will be humiliated by gang-rape before-hand. Think of it as a going-away orgy of sorts. If you ever listened to one piece of common sense in your whole life, PLEASE, TO MY FRIENDS ON THE LEFT, listen to this: We have a huge problem right now in America that extends far beyond the economy or our differences in whats moral: the truth is that we have muslim and other groups in America who hate this Country and want to bring us DOWN. Groups like ISNA, CAIR and others are unindicted co-conspirators in funding of HAMAS AND HEZBOLLAH. These muslim groups are here in America to divide us and turn us into an Islamic Nation. They are working our own laws and freedoms/rights against us ALL. Do not think that they will somehow be on your side because they HATE YOU MOST OF ALL: YOU ARE A DISGRACE TO ALLAH. Do you honestly think that abortion clinics will still be operating? There WON'T BE ANY ABORTIONS, AT ALL....NOT EVEN FOR RAPE OR INCEST. And you feminists out there: Do you honestly think you will be making demand after demand? You'll be lucky if you're allowed to speak AT ALL. You will be treated like a vaginaa because thats all they believe that you are: a walking sexual organ. You whine and complain about being equal with men, but you'll be lucky if you're equal to a dog if not lower. The only reason muslim women in America don't experience these things IS BECAUSE THEY LIVE IN AMERICA., but if America is gone, so are all the rights and freedoms we have. Let a feminist speak and her tongue will be cut out of her mouth. Even with our laws in America we still have over 200 BEHEADINGS OF MUSLIM WOMEN IN THE PAST 22 MONTHS BY MUSLIM HUSBANDS, oh...i correct myself - one was run over by her muslim husband in the car, over and over again until she bled to death on the street. STOP ALLOWING GROUPS LIKE THE ACLU TO CATER TO THESE MUSLIM GROUPS. STOP ALLOWING PEOPLE TO GET VOTED INTO OFFICE WHEN THEY ARE ADVOCATES OF SHARIA LAW!! ELENA KAGAN IS AN ADVOCATE OF IT AND NOW WE HAVE HER ON THE SUPREME COURT FOR GODS SAKE. WAKE UP PEOPLE. So again, my question is this: how many of you promote or advocate muslim groups who follow Sharia Law??? If you do, as an LGBT, WHY do you??EDIT: FIRST, THANKS TO ALL WHO ANSWERED. Second, it may be alot to read, but its important for my gay friends to understand that when you go along with those who advocate and appease and brown-nose, quite frankly - supporters of Islamic Sharia Law (AND YES KAGAN IS AN ADVOCATE OF IT), then you are literally shooting yourselves in the foot and making for dangerous circumstances. DO NOT THINK that because you have a large gay lobby that you would be immune when some of these crazy far-left ideals come to reality. Time to think about it with some common sense, or just pretend life is all rosey and fine......your choice. moreResolved Question: Liberals what happened to separation of church and state?

Do tell. And by the way, it doesn't matter that it was overturned. What matters is that it was initially DENIED by an American judge.@Yellow Alarm Clock: Legally, yes, it matters that it was overturned. The slippery slope the original denial implies is a completely different story. The fact that that could happen at all. I expected better from you. And I also expected you to tell me what the judge's decision was based on, since you so obviously know.As it happens, I KNOW why the judge denied it and it had EVERYTHING to do with the man's religion: "In considering the woman's plea for a restraining order after the couple divorced, Charles ruled in June 2009 that a preponderance of the evidence showed the defendant had harassed and assaulted her, but "The court believes that [defendant] was operating under his belief that it is, as the husband, his desire to have sex when and whether he wanted to, was something that was consistent with his practices and it was something that was not prohibited." " In fact, the appellate court specifically addressed the judge's consideration of the man's religion. No, YOU do not get it. The judge's ruling stated very clearly that the man's religious beliefs were an adequate defense for his feeling he was doing nothing wrong. Point blank, period. The fact that the appellate court overturned it is fabulous and everything but it never should have had to go to the court of appeals. It never should have happened. There is no defense for this type of behavior. The ONLY defense this man had was that his religion says it's OK and BASED ON THAT, the judge gave him a pass. It's pretty cut and dried. Again, the appellate court addressed this SPECIFICALLY, proving that the judge did indeed take this into consideration. He had to have done, because it was the man's only defense and an Imam testified on his behalf.@Otto: "Five sharia courts have been set up in London, Birmingham, Bradford and Manchester and Nuneaton, Warwickshire. Im liberal on some things, and conservative on others. When it comes to gun laws and rights, I believe in the 2nd Amendment that people have the right to possess a firearm. As I approach my 21st birthday, Im filling out the necessary documentation to obtain a firearm. Thing is, here in New Jersey, if you own a gun, you are very much frowned upon. I have people constantly saying to me, "Why do you want a gun?" and always seem to find myself getting into arguments. The reason: it is my constitional right. Thats it, that should settle it, but apparently these people think that if they bombard me with enough questioning, they'll be able to convince me to not follow through with owning a gun. Whats a good response???Katy M, Im going into the Police Academy very soon, so I'll need a gun anyway for employment reasons. But I do also enjoy target practice. And it doesnt hurt to have extra protection. Imagine this scenario: someone breaks into your house with a gun of their own, and you call the police but in the few minutes it might take for them to get there, your life is at risk. And it may be you or the burglar who dies. They have a choice, whereas you dont. Ending #1 to that scenario: I dont have a gun, so I get killed. Ending #2 to that scenario: I have a gun so I commit justifiable homocide and save my own life. Either way, someone is killed...me or them is the question... Does that satisfy your curiousity??? Thing is, I shouldnt have to explain this to someone each and every time Im questioned about it. I just want something quick and easy to tell them to get them off my back....Phil, Drugs are illegal and people still have them. The same thing would happen with guns if they were ever made illegal. moreResolved Question: Will Elena Kagan consult the Babylonian talmud or the Holy Bible when it comes to relgious issues?
Will Elena Kagan consult the Babylonian talmud or the Holy Bible when it comes to cases inolving religion in the Supreme Court? Seems like some states in the US already consult the Babylonian talmud when deciding court cases. "Leading off the discussion was New Jersey Supreme Court Justice Barry T. Albin, who tackled the traditional American concept of civil rights; Rabbi Shlomo Yaffe, dean of the Institute of American and Talmudic Law, gave attendees the Jewish approach to the issue." http://www.vosizneias.com/17376/2008/06/23/morris-township-nj-supreme-court-chief-justice-200-top-attorneys-attend-jewish-symposium-on-talmud-values/ http://www.chabad.org/news/article_cdo/aid/703108/jewish/Civil-Rights-on-the-Docket.htm moreVoting Question: Where can I find contact information for New Jersey's U.S. Administrative Law Judges?
