I was wondering if it is possible for me to be at a party of someone who is 1 year shy of the legal age drinking with people who are of age as well as underage. Open Question: Is this legal for a doctor to do?

Had a on the job injury. Was being treated with injections to the shoulder. Had a few PT sessions. Doctor ordered an EMG. First on came back okay. While at the Workers comp doctors office, pain in limited ROM. Never had syncope in my life. Passed out and fell on my injured arm and hit my head. Was none responsive and they called for ambulance. Neurologist in report stated that my neck was stiff and had muscle spasms to the left side. Painful pectoral at touch. No fractures, to head or brain abnormalities. Thank God. Had another EMG done by request of the W/C surgeon and it came back that there was impingement to elbow and wrist. W/C PCP said NO to treating it. Said he was sending me back with maximum medical improvement. I told him that the ER doctor is requesting MRI for Cervical Radiculopathy. That also I suspect a tear to my shoulder or bicep. He still refuse to treat. I will be talking to my attorney about this. I asked him, "If you are refusing to treat than why okay the pain W/C doctor to do an EMG (which was negative, and okay me for PT? He said I don't know. I further asked now that the second EMG came back something impingement you are still refusing to treat. He said yes! I had a nurse case manager present when he examine me. She was shocked and said she was going to talk to my attorney. That I need to ask the surgeon if the impingement could cause the Carpal tunnel and the Cubital syndrome in my elbow? By the way this is the first the that doctor EVER laid a hand on me. Every visit I've had with him this W/C doctor goes off of the reports of the other treating physicians, and that's it. Even when I would tell him about my injury before the accident in the office. The original injury was from crushing my hand in a door and being jerked backwards with my arm extended and hearing something pop. The surgeon said that my x-ray looked like a hairline fracture to bottom of my thumb, as well as dislocation of the IP joint. Said that I had epicondlyitis in my elbow, and that I have Carpal tunnel. But today the W/C doctor said they were not going to treat the impingement or elbow problems. That I already had surgeon for my thumb and wrist. Is this legal for him to do after putting me through all that pain of the EMG, and therapy? Is he trying to duck a law suit? Please Help!!!! more

Open Question: why does it semm only bad people have what it takes to fight, use self defense, and resort to violence?

I've been thinking why does it seem good people seem to hesitate when it comes to self defense. But if a bad person is being attacked he won't even think twice about fighting back The reason I came to this conclusion is because of: Arizona immigration law and how nice countries treats people from other countries who don't care about the process of becoming a legal citizen. But in other not so nice countries like China Russia Iran Iraq etc. they'll most definitely will make sure that their laws are obeyed. Another example: Why do good citizens let criminals break into their house while occupied. Why cant they fight back. What is it about being a decent citizen that makes most of law abiders "softer" than a criminal? But it seems if you driving in a city like Los Angeles and you happen to make the wrong turn into the wrong neighborhood you might just get shot. Because the gang members feel you're in "their territory." Anyway why does it seem bad people have more, nerve more audacity to defend themselves and whats theirs,and good people just act passive most of the time. And is it ever going to change? more

Open Question: What can I do about this "surprise" garnishment of wages in Arizona?

I recently lived in a rathole apartment and moved out to someplace marginally cheaper because (surprise) I couldn't afford the rent. They tacked the eviction notice papers on my door, which said I had to appear in court. I assumed that summons was for the eviction and just making the claim that I owe them money because of my broken lease (more or less a statement of, "This is the value of your lease"). I know nothing about laws. I am literally just some 22-year-old kid with no savings, no liquidatable assets (outside of a car that's a month overdue on a note worth 4 times its resell value), more bare living cost bills than I can afford, and no family or knowledgeable access to help and I am not even a native to Arizona so I have no idea how stuff works here. ANYWAY. That was approximately 2-3 months ago, during the middle of March. I got a call today from some firm or company (they weren't a law office, likely a collection agency of some sort) saying that the old apartments -had- received a legal judgment against me and the court was now reviewing my seize-able assets and preparing to garnish 25% of my wages. They would not accept an alternate agreement except a 400+ dollar down payment, which obviously isn't going to happen because if it could, I would have already given them their money and gone happily on my way. ((The judgment was for about 4600-5000 dollars, roundabouts.)) Outside of the eviction notice, I have never even been served or contacted what-so-ever. I expected them to eventually approach me for debt collection, but I haven't heard ANYTHING. No mail, no phone calls, no visits from severs or nicely dressed policemen. I was under the impression that they needed to serve me court papers before they could sue for wage garnishment (and like I said, they hadn't even contacted me for payment prior). Is this true? Can they just up and take my wages without even sending me a notice? more

Open Question: How long can a manufacturer hold a deposit?

I am in California state as a buyer for a local garden/home decor store. I contracted an artisan/designer also in California to make something for my business. They took a deposit of 5% of the quoted price of the 'job'. They sent an invoice showing the paid deposit and the price of the job. However, four months later, they informed me that the job was going to be more money than they quoted and invoiced me for. Needless to say, I decided to move out of the agreement I had with the designer. However, after multiple attempts to get my deposit back the designer now refuses to even speak with me. Is there a legal way to get my money back? A law or something? I'm trying to stay away from small claims court. There was no signed contract by me. The only piece of paper stating the deposit received and the original price for the job is the invoice they sent me. Please help! more

I mean, like Good Friday, you don't eat meat. It started out because the fishermen wanted a day where people would only buy fish, so they asked the pope to tell people to not eat meat on friday. Now it's this religious thing. And during the Crusades, the pope declared it illegal to kill Christians but legal to kill Muslims. Not that that law is still around. Nor was it a moral law. Also during the Crusades, it was told that if you were a soldier in the war, you automatically had a spot in heaven. Open Question: how long does a confidentiality agreement last in CA?

I signed one in 2005. It stated that "at no time during or after" my employment would I ever give out our "secrets" or any names of suppliers ect. I left the place within a year. Fast forward to now. I have come back in as a "contract employee". The new owner, who is really the same old owner but who is hiding by placing the company in the name of his nephew and having changed the company name as well as other cute little tricks got wind that I was thinking of jumping ship and opening my own place just like his. He grandly whips out this 5 year old piece of paper I didn't remember signing and tells me that I am in danger of going to court with him. I pointed out that A) I was a W2 employee when I signed that B) the company name on it is no more in the legal sense C) He is no longer the true owner D) it did not state for how long after my leaving the thing was in effect. He informed me that it is binding for my lifetime in the state of CA and that he would be happy to prove this to me in a court of law. Ok, can some legal eagle please explain this to me? Open Question: Im kinda lost now...?

When I was younger I plain and simply wanted to be a lawyer. I was one of those kids in school who never studied either and passed with good grades till I got to my highers and I messed around ALOT and skipped school alot too. I still passed all my highers but I obviously didn't study and barely showed up so I ended up with a bunch of C's when really I could have gotten A's. I ended up going to college anyway and doing an HND in Legal Services which I thought was ok I suppose but then went on to university to do Law and Management (got straight into 3rd year bcoz of the HND). I quickly realised it's not for me, I hated everything about it, I hated doing the coursework, I skipped class there too, I fell asleep at the back of lecture halls so I ended up dropping out, arguing with my parents BIG TIME about it and got thrown out my house because clearly I am not what my mother wants me to be (personality wise and career wise). Problem is I dont fully know what I want to do. Im sick of school now and have been applying for lots of jobs in different offices and they all tell me I have no experience and bla bla bla, so I realise maybe I do need a degree to get anywhere and I just dropped out of one. And alot of my friends have just graduated and some will graduate next year and they all seem to be going somewhere and doing something and Im standing still. When I see all these people with their degrees now it makes me think I too should have one and I get this strange feeling in my stomach and I get really down about it. But I dont know what Im doing. I want to do something for me and what makes me happy but I think Ive spend so much time doing things to please my mum that I dont truly know what I want. So hearing anyone talk about their accomplishments academically totally frustrates me and makes me soo depressed but at the same time I feel Im through with school because I just dont want to go anymore. Should gun banning be legal for a state or municipality? Protected by the tenth amendment. I mean the constitution does say that the state has the final word about laws, but does that mean a state can bring back slavery? Deny the freedom of speech? Legalize it for Soldiers to quarantine your home? Legalize search and seizure of your property? Take away your right to due process, double jeopardy, self-incrimination? Take away your right for a trial by jury? Make it legal for them to set a more than excessive bail? They have taken away the 2nd amendment in many states and municipalities. more

Open Question: Those against illegal immigration, why don't you answer these hard questions that nobody from the left asks?

It seems that immigration, illegal immigration, and amnesty has literally become a political issue between left wings and right wings supporters. But I say this with full rationality that it seems that at least one side has last every single sense of rationality. I'm not going to discuss the Arizona law because this has nothing to do with my proposition but here are some really difficult questions that conservatives have absolutely no answer to. 1) many legal immigrants have no document because they either neither obtained them or may have lost them and have never ever cared. Many Americans unfortunately don't leave the country and hence don't get a passport. Some don't drive and don't get a drivers license. And some have misplaced perhaps there passport or any other documents and have no want or need to pay money for them when they have no use for it. first question How can you possibly ever identify a legal or illegal immigrant? Now lets stop with the discriminatory nonsense and the Hispanic argument, and actually think how can you? Those who are citizens may have a passport but many don't. So do you expect every single police officer to now start calling immigration on everybody they detain and ask if there a citizen (that is if its in there database). Wow do you know how expensive and long that would take? Question 2: If someone doesn’t have documents how does that prove that there illegal. I thought it was innocent until proven guilty and not the other way around? So you know want to presume everyone is an illegal until proven otherwise? So you want to change the whole justice system for immigration? Question 3: How do you deal with illegals if you somehow determine beyond a reasonable doubt that there illegals (yes that means tax payer funded immigration courts, wow we will need a lot of juries for that)? If you answer A) put them in jail. Then how on earth can you fundamentally rehabilitate the criminal? One of the goals of the justice system is to make the criminal understand there wrong doing, but how do you do that by putting them in jail and feeding them? How do you teach them there acts are wrong, when they can't be rehabilitated. Or do you just torture them and starve them to death. Also why waste so much money on an idiotic jail that does nothing for the well being of society. How does the jail help? If someone escapes from jail do you set up a man hunt for a illegal immigrant escape? Do we show them on America's most wanted? Now if you answered B deport them which seems to be the most common answer. Well problem 1 How the heck do you find out there citizenship? If someone is illegally from Australia how the heck will you ever find that out? You think the immigrant will just tell you this? If there undocumented how can you ever find out where there from? Next if you somehow find out where there from (bloody unlikely) then how are you going to deport them. How many countries exist in this world? How many times will at least one illegal come here from one of these nations? So you want to have tax payer funded deportations for all illegals is that right? How many plane flights will that be and how much will that cost for this never ending cycle. Next Pretend in the imaginary world you somehow do deport them , the immigrant has nothing to do but try again and again do go back to the USA. So how many times can you repeat this cycle. Or do you just jail him for life, with a waste of more American resources for an illegal immigrant? Question 4: Lastly something nobody ever mentions and will never mention what happens if the individual escapes or leaves somehow from a nation that we have no diplomatic relationship with. Lets say north Korea. How the heck would you deport them there? North Korea will never accept them and just allow a plain flight into there land for this BS (remember they don't care about American immigration reform). So what do you do? Arrest them and repeat what’s mentioned above? Drop them in the ocean and not let anybody know? These are issues that will always be brought up. Ill tell you my opinion. Immigration reform has completely become an issue of not law and order but an issue about Mexicans and Hispanics. Nobody talks about illegal immigrants from England, Australia, Canada, or any other European Country. Its always about somebody who they consider wants to just get free welfare benefits. So immigration law is the biggest losing battle ever. You can't win it. Its a lie! Its a way of government to tell you what they can do, and allow the country to be organized in there own way. Question 5: Why do conservatives who hate government bureaucrats, suddenly trust the government to make law that can't not be based on race. How is saying that a certain amount of X individuals can come from that country not be considered racist. Immigration law is the most tyrannical government power that is not FOR THE PEOPits amazing how the first five answers didn't even address the Questions. The second last answer apparently wants to just kill people. That's really going to happen. Whos going to be the executor? You ? You want me to pay you through my tax dollars? I would we rather fund illegals. funkyk, has got the most miss informed information ever. There most certainly are legal individuals who don't speak english, and that's there business. Second everyone does not get issued a SS # you fool. SS is only for paying taxes. It has nothing to do with immigration. Open Question: Why is Fox News "obsessed" with the Joe Sestak matter when nothing illegal happened?

Even conservative legal analysts have already said that no law has been broken here. This is typical Washington politics, even though it comes across as slimy, it is not illegal. The President apppoints various people to his Cabinet and posts in The White House all the time, and he selects certain reasons to do so. The candidates themselves are usually aware why they are being selected anyways. Is it a crime for Obama to pick Kagan to the Supreme Court because she is a good friend of his? I am currently in need of an idea to write on that involves gaming law and tax. I need a topic with some substance, preferably one that involves the tax implications to the Casino/Corporation rather than only to the individual. My prof suggested a topic called "chip float," which can be about the tax implications if a patron takes a gambling chip home and never spends it. Open Question: Pro-choicers, do you think drug use should be legal?

You use the argument that it is her body, her choice. It is also a person's choice to use drugs like cocaine or heroin. Ever since cocaine and marijuana became illegal, people have died because of drug violence. Shouldn't we just allow these people to choose what they do to their bodies, instead of invading their private lives, and feeding the mouths of social deviant criminals who commit murder? Marijuana (when eaten) is definitely the least harmful drug, and such things like cocaine and heroin are ingested individually, thus having no physical effect on anybody else. Laws oppress them when they tell them what they can't do with their own bodies, so shouldn't drugs be legal again? By the way, date rape drugs should stay illegal, because they cause rape, but all the drugs that don't cause crime (outside of drugs being illegal) should be legal, because it is their choice. more
