Resolved Question: Using a company logo on an advertising poster?

Keeping it as vague as possible, I've just taken over as the promotions manager for a nightclub and I was wondering if any legal eagles could give me any advice. The club I promote for has been featured multiple times in a few hugely popular national publications/media forms and I was wondering if there would/could be any potential problems stemming from using their logos on posters in a 'As Seen In/On _______' (publication name there) kind of way. The posters won't be going anywhere other than locally (ie fast food places, university, dorms, shops aimed at our punters etc) I'm asking this here because it's 10.43pm and I'm currently knocking the posters together and I'm not going to get an answer from any of the publications in the near future (i.e 12/24 hours) and wouldn't mind some opinions/facts beforehand :) more

Open Question: How do I know when we should get licensed for a lawn care business?

I wanted to start a lawn care service with my brother. Our ages are 16, and 23. I wanted to find out more about the legal part of starting a service. Is it okay to just go out and advertise for a service like this? Or is there a certain amount of money you can make without being licensed. Open Question: How much difference does the brand or type of golf ball really make?

Me and my friend Dave have just begun playing golf this summer. I believe there is little difference between LEGAL (according to what is legal by USGA guidelines) golf balls. I think when they start advertising balls that correct slice or increase distance, the correction is minimal and greatly exaggerated to make more sales. If there was an substantial difference such balls would be made illegal. However Dave believes they make a big difference. He has a really bad slicing problem and believes getting one of those "anti-slice" balls they sell at like Wal Mart will eliminate that slice. I say he's dreaming and should start learning how to hit the ball correctly. Who's right ? more

I want to start my own country. I will have to buy land from a country that is poor, so I can afford it, but it has good resources, so my country can be rich. Here's how my government would be; You apply to move to my country If you decide not to work, we will send you to an island with resources where you can survive on your own, but you can't return. You start school at 5, and finish at 20, which will be the legal age. Drugs that are psychoactive are illegal. Weapons are banned from people who aren't police, or in the military. We have a powerful military, so war can be avoided at all costs. People can drive cars at 20. People can marry whoever they want, and can marry as many people as they want (any dislike of polygamy is cultural, but since this is a new country, it can have a new culture.) Minimum wage will be 1/5th of maximum wage. People can eat anything that is edible except other people (any dislike of the consumption of things like horses, dogs, cats is only cultural.) Animals must be killed humanely. This includes a bullet to the head, or a quick decapitation. Knives and CO2 will not be used. Government isn't done the same way. There will be people who study the economy under one branch, there will be people who make ethical decisions, and there will be people who will make decisions regarding foreign relations on the last. Each branch will have 100 (congresspeople) to run it. People can say what they want if it isn't threatening, hateful, or discriminatory. People are allowed to criticize the government. Voting Question: I have been a temporary worker for 3 years in the same job. What are my rights if any?

Due to the economic climate there has been a 'recruitment freeze' during the duration of my assignment here. I have a 100% attendance record and exceed all targets placed in front of me with a 0% error rate. I am paid 40% less than my colleagues who are doing the exactly the same job, albeit worse in my opinion as I am clearing up after them generally, with no entitlement to holiday pay and/or bonus. Surely this cannot be legal after this amont of time?? Now I know that new legislation has to come in to effect by October 2011 (Agency Workers Directive) in that legally you have to be paid the same as a permenant member of staff for doing the same job after 12 weeks of the assignment, but does this mean that companies will just get rid of you before this takes effect?? I have made my boss aware of my feeling of complete lack of appreciation/motivation in my current plight (I.e Not have a permenant job and/or being paid the same) but they just state oh our hands are tied and you cannot get a job because of the recruitment freeze. To top this whenever a position is advertised in my department we get somone from elsewhere in the company who I have to train and mentor. Any constructive thoughts would be much appreciated.... Ok, I live in a 1bd apt, which values at 800/mo but I have a partial employment contract with the owners to help out around the place so I get 200 taken off. A larger apartment has opened up, which they publicly advertise as 1000/mo. So I've asked to transfer to the new apt, which with my discount would make 800. However the manager has said if I want the unit I need to pay him 1050 base price So as it stands, if they rent to someone else, the combined income from our 2 units is 600 and 1000, totaling 1600. And if they rented the new apt to me at 800 and re-rented my old unit at 800 they would get the same 1600. The 1050 he is asking means that he would be making an extra $50 from me on top of the amount he would make from any other tenant. Would this be considered any kind of housing discrimination or otherwise violate any California law? I mean he is singling me out specifically to pay a higher price. And it kind of feels like extortion to say that if I really want the unit that bad I need to pay him an extra $50 a month NOT to rent it to someone else.... If I have legal grounds to fight this, please help! My parents recently handed in their notice to vacate the apartment they are in and have paid the last months rent. the place is a mess at the moment and my mother has told the real estate that on this date they can have as many inspections as they like (the date is 2 weeks prior to their Expiry date to vacate and they are month to month) The realesate agreed to this but obviously wasn't communicated to another agent who put an inspection for that weekend, 4 days before the date my mother said they could do an inspection, and the lady was extremely rude, saying it is their procedures basicallt trying to intimidate my mother as she screwed up by advertising the inspection. Resolved Question: Allergic Reaction to Chain I bought (Legal Advice)?

I recently bought a chain from the mall at a little stand that sells tons of jewelry. I purchased what I thought was a silver chain and upon purchasing before I even bought it I made sure to ask if the chain contained and nickel in it since I am highly allergic to it. The clerk said no and insisted on pointing on the chain to something that says "14KB" which only means its made in mexico and is cheap fake silver but that is besides the point. Now after a week I have broken out throughout my body with lots of rashes, itchiness, and continue to get more rashes now even though I have taken the chain off and began treating myself. I'm not too concerned from a medical standpoint but have considered going to the hospital to make sure I treat everything right. My biggest concern is the fact I was sold falsely advertised product that the merchant denied nickel was in even though I told him I'm allergic and had my girlfriend there as witness. My first attempt is going to be to make a return, but their stand sign says "No refunds" and exchange within 7days. I'm curious from a legal point of view what can be done if anything? Keeping in mind if I were to go to the hospital for treatment and return to the merchant to have him reconfirm he sold me a "nickel-less" chain what could be done? Please let me know. I need to find the small debt receipt I was given, but my bank statement has the information of the purchase and date so I'm not too concerned. more

A friend and I are trying to think of a name for an odd job/ moving service we'd like to get started at school. It's basically a glorified lawn mowing gig. Resolved Question: Can I take a Craigslist poster to Small Claims Court?

I saw what I thought was a good deal on Craigslist. A lot of items typically resold on ebay for $500. This type of lot is not uncommon on Craigslist. As an experienced ebay seller, I could have made about $1500 on this lot. I got ahold of the Craigslist poster, and he promised the lot to me for $500. I told him I could come over immediately, and he said that he was unavailable, but that he could meet 5 days later. I was in a situation where that day/time did not work out for me, but I changed my schedule so that I could drive the one hour trip to meet him. We conversed several times over the next 5 days, verifying that he was going to meet me and sell me the lot. When the day came, literally as I was in the car leaving to get to him, he called and told me the price has changed to $1250 and if I wanted the advertised and agreed to lot for $500 lot, I'd have to pony up double the money. Is this legal? We had a verbal contract. Can I sue him for bait and switch? It costs $31 to bring him to small claims court. What he did is unethical, and even if I don't win, I think it would be worth the hassle to make this guy realize that what he did is wrong. If I do take him to court, what do I ask for? (Again, I'm not thinking I would actually win, but think he needs to be scared straight in his dealings.) And which county would I take him to court in; mine or his? I'm assuming his.We absolutely had a contract - a verbal contract made after replying to an advertised price.I have a copy of his ad and his email correspondence with me. He has since changed his Craigslist ad, but I have a copy of the original.Again, I'm seriously not looking to win this one. Just looking to take legal action that will have him rethink his actions. I am not .. computer savvy.. only my home PC. I have attended a computer class that was like latin to me. Its not my nitch. But.. goes with the job. The instructor said she has more jobs/connections then students to fill them. But..there is no computer classes in this program that will take me a year to complete then I would have to take additional non credit computer classes.. and I have to pay for my books. This will all take me about 1.5 to complete. She got me with.. the fact she pretty much guaranteed me a job. There is also an internship. She said I would get only salary . She is the instructor and an Attorney. She would know. She said I would start out at 30 a year.. which has been my goal that I have never yet reached and to me that is a reasonable goal. The problem is.. although I am self supporting.. I am caring for my mom whom has cancer. I am more concerned with finding work right now. I am juggling a lot alone. I am not sure.. if this is the right path for me to be honest.. I know they are paying... and she guaranteed me work. I will also be able to sit for my Real Estate and Broker License. I am not sure if I am being intimidated by all my fears.. Or.. if they are very real.. and it will hit me like a ton of bricks crashing on me. Especially the computer learning for the job. I understand I can be a broker from home.. I am to be honest more interested in traveling to sell vacation rentals.. but.. that can also get old fast and be hectic. I am a home body. So.. I thought of two alternatives..Or back up choices.. Paralegal.. which law is to me interesting especially environmental.. Patent and Immigration Law. I could also be a Real Estate Paralegal. Attorney's I do know Pay you a lot and it is also Salary. I know a legal secretary making well over 60 a year. But Attorneys aren't cheap but can be jerks I hear to work with. I would I am sure.. learn computers and West Law in that program.. but I would have to go to Globe or one of those real expensive schools .. Or. to the County College for an associate.. but that would take me 2-4 years longer.. So.. you pay double or triple for a faster program to get out and working. I think they call it legal assistant. Or... the other choice which was my first one.. originally was to get my cosmetology license. I can go at night.. and get some kind of part time job days.. whilst taking my mother for her treatments. Days would require full days and I have to be available for my mother. The Property Management Program was two nights a week .. then when they are done .. its two days.. a week.. and one on line.. Then back to two night .. two classes only at a time. But.. its doable around my schedule for my mother.. BUT .. just because I was approved and they are paying .. I don't want to have to feel I should or am meant to do this. I am not sure if I can go get a brokers license here separate somewhere else or not. I just wanted to achieve a salary of 30 or so a year. But the Cosmetology unless I go at night does not seem that doable days. But I can go at night if I had to. It may take over a year to complete. Its more creative. They probably make 30 a year with tips.. and I seen many jobs advertised including where I live.. and manager jobs for salons and spas and you can do nails etc. There are many avenues that can bring in money. I like moving around .. more then sitting all day. I am just afraid to mess someones hair up lol.. But.. I suppose that is what they teach you. It seems like the most fun job out of them all. I am creative and artistic.. love make up.. but my age is a factor for employment .. although I must be well preserved because this young girl told me to go for it.. and convinced me to do that originally.. before everyone told me I can't count on commission and tips. There's a local Italian deli that also makes pizza. They have lunch and dinner delivery hours and are open Tuesday through Sunday. The delivery hours for lunch are from 12:00 PM to 2:00 PM. I have tried ordering from them at around 1:45ish a few times in the past, but they would never take my order because it was too close to 2:00. Is that false advertising? Should they say "Our delivery hours are from 12:00 PM to whenever we can't make and deliver a pizza before 2:00 PM"? I really love the place, mind you, and there is no way in hell I'd ever take legal action, it's just sort of an annoying thing about them. Also, I am not a very assertive person. How could I possibly convince them to deliver for me at 1:45 without sounding like a jerk? Every time they say "No, we usually stop around this time" I just say "Oh OK, thanks," and then hang up. Their email response which came a long time after I lodged a formal complaint, was a casual one-liner 'if you do not like it, send it back'- without a hint of an apology. Its really not a matter of 'not liking it' but of misrepresentation of facts and cheating. Hi, I would like to set up my own business, and don't have enough money to register a trademark (as that is like £200 per trademark). I also want to run my business as a sole trader, not as a limited company. In the mean time, can someone else register my advertised business name as a limited company, and therefore stop me from trading using that name? If that is the case, should I register the name as a limited company and just leave it dormant? As companies house only allow one instance of each business name to be created, so that would surely add some level of protection until I can afford to create a legal trademark for my corporation? I'm 25, will be finishing my bachelor and master combo in Indonesia in 2 years time. Dating a 28-year-old lawyer and are about to get engaged when I finish my current studies. We've been together for a year, been good friends for 7 years, and are set to marry each other. I'm currently unemployed, haven't really "started my career". Unfortunately the midtwenties is considered rather late to start in Jakarta. In the past I've worked as a translator, radio talk show host, multilevel marketer, and even tried starting my own business. Before this, I studied advertising and philosophy in Europe (didn't finish). In the future I'm considering to work either in advertising or journalism. I've been trying to get a job in Jakarta for 3 years now and it hasn't been working out; the opportunities I find are either corrupt, require connections, are very low paying, or could not satisfy my appetite for intellectual challenge. A fresh graduate here is paid about $200 USD a month, and although a postgraduate can earn up to about $1000 USD a month, it is very difficult to get those jobs if you have little work experience (which is how most of my prospective employers have viewed me). And yet one of my and my fiancé's most urgent needs before getting married is to buy an apartment or house to live in. The pay here is so bad, many people are forced to live with their in-laws well into their thirties or even for life, but that's not an option for us. That's why I'm considering going to Israel to take my second masters' program while working either on campus as a research assistant, or off campus as a journalist. (My dad supported our family by assisting his professor when he studied his doctorate in the US.) I visited the campus already and am in correspondence with them. There it is normal to be just starting one's career in the late twenties, intellectual capabilities are more appreciated, the pace of life is more sane, and the pay is much better. It may also help me gain access to better job opportunities and salaries when I come back to Indonesia. Although my fiance is a globetrotter and open to moving abroad again sometime, he is currently focusing on his legal career in Indonesia, so I may not be able to take him with me. This may mean postponing our wedding by another 2 years. We'd then marry in 2014 at ages 29 and 32. He once told me that he's open if I want to study abroad again, and would look forward to spend his holidays with me while I'm away. But when I asked him today, "When I finish my current studies, can I go take my master's in Israel?" he seemed a little shocked. How will studying abroad affect our relationship? Will it help or hurt? I'm thinking it's an investment: it's my last chance of embarking on a study that's actually satisfying, and to achieve a lot of things that will be good for my future family. I'd become more mature, win more respect from others, and hopefully use the things I learn to make good things happen in my country. My fiance would have more time to save up to buy us a decent home, and I'd be able to contribute because I'd be earning more. Moreover, the life skills I learn while I'm away will make me a better wife for him, and help me to appreciate him even more than I do now. On the other hand I'm also wondering if this might create a rift between us. After a long distance period, you don't expect to go "back to normal" because it forever changes the shape of the relationship. My fiance is really the only person who values me not for what I achieve but for who I am, and still cherishes me although he knows my failures very well. Despite his busy career, he's also surprisingly the only person who shows me that it's OK to slow down, smell the roses, and enjoy the moment without worrying at all about the future. He's not half as ambitious as I am, but he's achieved a lot more than I have, and I've learnt that I can be a lot happier when I'm less ambitious. Finally, my priority is to first set an excellent foundation to share the rest of my life with him; then second to start a fulfilling career which provides personal growth, satisfaction, and a good income; then thirdly to travel the world and learn both life lessons as well as academic ones... but ultimately it must only enrich my future marriage, and the communities I become a part of throughout life. Otherwise, I'd be more than willing to give up this plan and move on to other opportunities. So help me out here. Yay or nay? Mention some pros, cons, possible consequences, and what my fiance and I can do about it. Helpful advice and consideration would be greatly appreciated. more
