Open Question: Do "rape shield" laws violate the right to a fair trial?
Obviously, laws that prohibit the media from naming a rape victim or even a woman who makes a false accusation (such as Crystal Gail Mangum from the Duke Lacrosse Case) are a flagrant violation of the 1st Amendment and have been declared unconstitutional by the Supreme Court (Cox Broadcasting Corporation v. Cohn and Florida Star v. B.J.F). However, aren't the similar laws that undermine the ability of the defense attorney to cross-examine an accuser a similar violation of the Constitution, since everybody who is accused of a crime is supposed to receive a fair trial? I understand that radical feminists assert that it is traumatic for women who are accusing a man of rape to have to be cross-examined in a court of law, but isn't that argument beside the point? Afterall, aren't people who are accused of a crime supposed to be considered innocent until they are proven guilty and aren't they supposed to have the right to confront their accuser? If you accuse somebody of a crime, but are unable to handle being cross-examined by a defense attorney, wouldn't it be a better idea to just forget about bringing a criminal case against somebody in the first place rather than trying to deny the person you are accusing his right to a fair trial? If a law was proposed to "shield" a person who accused another person of any crime other than rape (for example, a "theft shield" law), wouldn't everybody see that law as flagrantly unconstitutional? moreOpen Question: switchblade law in florida?

I presently own an unoccupied house in Illinois which I plan to move into in a couple years. However, one of our relatives wants to store some of her furniture, such as a dining table, washer/dryer, and baby grand piano, probably worth almost $20K, in my house after selling her own house in IL but not having bought her own house yet in the place she plans to move to, Florida. So my question is, is this a bad idea, even if it's for a relative? I wonder if Illinois is one of those states where I heard if you have someone's possessions in your own house for a specified period of time, the owner of those possessions may claim himself or herself as a resident of that house, and I would have to go through an eviction process to get rid of them when it's time for me to eventually move into the house myself, if they don't want to remove their property from my house. We both pulled out and a police car came up fast and pulled me over. I saw him when I was sitting at the stop sign. So I had no idea why I was being pulled over. He said I failed to obey the stop sign. I find that untrue, since I sat at it for over 30 seconds.... Anyone have any idea what I did wrong? First let me give you some background: My in-laws THINK they have the right to come to our home whenever they please. I mean showing up at all times of the day or night without calling or notifying us that they are coming. They live in Ohio, and we live in Virginia. My mother in law is medically retired, and she lives with my husband sister. Neither of these ladies are considerate of others space, time or money. They think we should drop everything and be at their beck and call. My mil & sil have come to VA three times this year unannounced! I don't mind them visiting, but insist on showing up when it's highly inconvenient for us. The last time they had showed up, we were on vacation in Florida. They called our cell phones, and chipped their teeth at us because we weren't here to entertain them or let them use our house. I don't let my sil stay alone in our house. She has stolen money & jewelry from us before, and pawned my things. I've forgiven her, but I refuse to let her be alone in my house without someone being home. My mil just ignores her daughters behavior. But my husband has told him mom & sister to stay home in Ohio until they are specifically invited to come to our home. This made them both extremely angry. But he doesn't care about what they want anymore. It's NOT about them, it's about our family, and what is best for our family. Now that you know the history behind the question here is my problem. My mil & sil want to come down for the birth of the twins that I'm carrying. My husband has told them to stay home until we give them the OK to come here and visit. They've told my hubby that they will do what they want when they want, regardless of how he feels. My mama is coming here to VA to be with us for the birth of our twins and for a few weeks afterward. Every woman has the right to have who she wants when she gives birth. I want my mama to be with me. I'm not that close to my in-laws at all. I just want to have a stress free birth, and not have to worry about my in-laws causing chaos. We've chosen to keep the location of where I'm giving birth to ourselves. My in-laws keep asking where I'm giving birth, and I keep telling them that it's none of their business, and to quit asking. But they are still being pushy. I want them to see the twins, but we also need them to understand that my birth is not about them, it's about ME! I don't ask for a lot, but I want a lot of space when I give birth, and when I bring our babies home from the hospital. More then likely I will deliver them early, and they will have to stay in the NICU like my oldest son had to. I don't want my in-laws here until we bring home two healthy babies. But they don't listen, and think that it's all about them. I'm sick of their selfishisness! So my question is: How do I keep my in-laws at home until we give them the OK to visit?Unfair I don't think so. What is unfair is having two nosy women show up anytime they THINK is convenient for them. It's rude, immature, and selfish. My mom and gram are coming from AZ to be with me. My mom & in-laws don't get along, and DO NOT like each other. Of course I would choose my family over my in-laws, especially during this time. Every woman who is pregnant, HAS THE RIGHT to choose who they want. I'm choosing my mom over my in-laws. We have orders back to the west coast, and we are NOT telling my in-laws the new address. My husband is sick of his family barging into our house & lives. He loves his family don't get me wrong, but they lack respect for others. It's OUR house, OUR children, OUR pregnancy, and OUR birth, NOT THEIRS! moreResolved Question: When should my mother in law from florida come to visit baby after i deliver?

What do you think illegals demand end to 287(g) but offer little evidence to back up Racial profiling,Unreported hate crimes, Families separated and parents deported for making “insignificant” mistake ?A group of fewer than 10 immigration activists made a litany of accusations against the Collier County Sheriff’s Office and law enforcement in general on Thursday afternoon during a press conference in front of the Collier County courthouse. They called for comprehensive immigration reform and the end of the Sheriff’s Office’s 3-year-old 287(g) program, which gives trained deputies the federal authority to act as immigration and deportation agents. However, when asked for evidence to back up their accusations against the controversial program, the activists had little to offer. “We’re looking for the data right now,” said Felipe Matos, 24, an undocumented immigrant from Brazil and a national organizer for the Basta (Enough) 287(g) campaign that’s planning similar stops around the country. “Right now we know the community is very scared, and the community is not reporting crimes.” When asked for names of people who he believes the Sheriff’s Office deported without warrant, Matos refused. “I can’t release names because if I was to release names, I would be going against the very will of the people who are scared to come forward right now,” he said. Since the inception of 287(g) in Collier County in 2007, the Sheriff’s Office has placed nearly 2,700 immigration detainers on illegal immigrants for removal from the country, the agency reports. The Sheriff’s Office’s 287(g) program has two sides, a corrections program which checks the immigration status of everyone booked into the jail, as well as an investigative program, which targets and arrests criminal aliens with approval from U.S. Immigration and Customs Enforcement. The Sheriff’s Office reports that criminal aliens detained through the corrections program have an average of five prior misdemeanor arrests and one prior felony arrest, while those detained through the investigative program have and average of 7.5 prior misdemeanor arrests and 3.3 prior felony arrests. “By identifying and removing these individuals from our community we are keeping Collier County citizens and visitors safe,” Sheriff’s Office spokeswoman Michelle Batten said in an e-mail. Rather than keep the community safe, Grey Torrico, 23, of the Florida Immigrant Coalition, said the 287(g) program creates “discomfort” for both legal and illegal immigrants. “Victims of crime are less likely to report, and witnesses are at times too scared to say what they saw,” Torrico said. “Many hardworking families have been torn apart by the deportation of a parent detained for any insignificant mistake. 287(g) is not a solution to the current immigration crisis. “On the contrary, it has created a climate of racial profiling and community insecurity.” When asked if he approves of the deportation of violent criminals, Matos said that he only has a problem when “unjust laws get enforced in an unjust manner.” When asked, hypothetically, if he would support deporting an illegal immigrant guilty of rape, Matos said he was unable to give a “concrete answer.” “I’m not ready to answer that question because I don’t feel comfortable without looking at the whole situation instead of looking at very specific cases like that,” he said. Matos said that because of 287(g), victims of domestic violence are being booked into jail, another charge the Sheriff’s Office denies. “We have always encouraged anyone who has evidence of racial profiling to bring it to our attention,” Batten said in an e-mail. “To date, we have not had a single complaint. Additionally, we are not aware of any studies that conclude immigrants are less likely to call police when there is a 287(g) program in place http://www.naplesnews.com/news/2010/aug/26/small-group-protests-collier-county-sheriffs-illeg/ moreResolved Question: What kind of settlement should I expect?

Okay. Where do I start? Sorry this is kind of long. I am 14. currently live with my father. He abuses alcohol. I have been on my own for making dinner and stuff most of the time because he is drunk and passed out. He threw a dog collar while he was under the influence and it hit me. My father also made me miss a court date when I was 9 that he never told me about. He has also put me in danger while I was riding with him and he was drunk. He has also taken my money and put it into his account that I never saw the money again, my father is also racist. I spent a lot of time with my mom while she was in New York with me but she currently lives in Florida so now I am always stuck home with my father because he wont let me do anything. I'm co-writing a fictional work in which the child's father has opted not to meet his child which the mom only told him about in order to obtain kidney bc the child had kidney failure and was dying. The child is 6 years old, and since being told about her, the father has given her the kidney and not expressed interest in meeting her AT ALL, he shot himself soon after but survived and left town. There is a step-father involved who has been there since birth, and is listed on the birth cert. The mother now has heath issues and 'thinks' she might be dying, so I need to know for her perspective, if the bio father were to try to obtain custody after the mom dies (which she thinks she is going to) which way would the pendulum swing? Would the mother's wishes matter at all, and the fact that the step father is the only dad the kid knows? The biological father has a history of mental illness and was institutionalized at one point a few years ago, and the stepfather is very stable, sane and reliable. Would that make a difference? Or would biology win out? The story is set in the state of Florida, if that makes a difference with laws and whatnot...It isn't ALL depressing. Me and my boyfriend are both 18, my boyfriends sister is 12 and his mom is 42. Whenever he comes home from work, his house is ALWAYS a mess, and I have been in the house before, and its bad. I know the mess in the house is not from him, because he is a clean person, a lot of people think he is metro sexual actually. So the last night, he posted a facebook status saying "I'm glad the house is a mess..again. It's happened all week" and his sister commented on it saying "I'm glad you come home in a bad mood..again. It's happened all week" Well I decided to comment back because his sister realllllly needs a new attitude and she has never heard me actually stand up for him, so I posted "maybe its because the house is a mess? Just my opinion" and I liked it. Well then he came over to my house and we were just about to eat Taco Bell, and his mom called, yelling at him to come home now, and to take his status off because its disrespectful, and this and that, and telling him that he needs to take the Wii away from me because I don't appreciate whats free in life (my boyfriend bought me the Wii) and told him, that he can't come over for a week. Well I posted a status and said "I'm glad I'm being punished, that's cool" and she texted my boyfriend and told him that I wasn't going to see him for a while, because he is getting a ticket to go to Florida, where his dad lives, all because of my status. Well I can't help it, but I cried. The reason why I said, I couldn't help it is because she has done this at least once every 3 months. She has threatened our relationship, mind you we have been best friends for 6 years and have been dating for 1 year and almost 3 months. She has done this constantly, and she is just not a nice lady. She has called my mom a whore, and said I was going to be like her, because I have a father and 2 step fathers. And she wants my boyfriend to take a break from me, and go have sex with other girls and for me to stay single and wait for him to get done to see if i'm still going to be here for him. When his mom yelled at my boyfriend and threatened our relationship I told him that I'm not going to screen my facebook, just for her, I'm 18 years old and I'm my own person and that it was BS. and so i deleted and blocked her and his sister from my facebook and made it private and I also deleted his sister from my myspace, and blocked her. I will marry him though, he is the best thing that his ever happened to me, and I know he feels the same. I'm not some idiot right out of high school claiming to get married right out of high school, I am going to wait til I'm finacially set and make sure every thing is in order before that goes into play. His mom keeps saying she doesn't hate me, but actions speak louder than words. So my questions are Do you think it was the right decision to delete her off facebook? What should I do to make her stop acting the way that she is? moreResolved Question: It happening today we march tomorrow we shall become citizens?
WEST PALM BEACH, Fla. -- A South Florida church and advocates are calling on the government to grant more rights to illegal immigrants and for the state not to enact an Arizona-type immigration law. About 100 people marched through a West Palm Beach street on Saturday. Many said they were concerned Florida lawmakers would pass a proposed law requiring police to check illegal immigrants' status during lawful stops and for immigrants to carry legal paperwork. Others called for immigration reform that would allow illegal immigrants to become more incorporated into mainstream society, pay taxes, buy homes and hold legal jobs. I know I can call them about not being able to show up, but what i was wondering, is will i have any issues here in florida regarding custody or visitation??? The state of ohio has a STRICT rule of parentage...365 days of no contact for absent parent means no more rights to the child. still financially responsible though. I am scared i will now have to fight for custody in FLA, but i am unfamiliar with the law, or if they can grandfather the ohio law in for me since me and my child have always lived in ohio til recently. Ohio recognizes me as the ONLY and SOLE parent, due to the 365 law, no hearing was necessary to get guardianship, as i am the only one who has ever provoded for my kid. I have never received child support and i know that will finally be ordered...but i absolutely dont want him to have any visitation(8 years of none is a long time to not want to see your own kid) but he should be held responsible for her financially. if anyone has any advise or info, please let me know....also, i have no criminal record or any drug issues....the father has a few felonies, drug problem, and mental issues, also into devil worshipping as i am to understand. help if u can and thanks :) moreResolved Question: is it against the law to go in your neighbors yard and check on there dogs if they are away?
i heard the little yorkies a few days ago and i haven't seen my neighbors home all week. it has been 100+ degrees out and the fenced area they keep them has no shade. not sure what to do. one time they went on a vacation we did go check on them but that was when we knew they went to florida. they had someone coming by but they hadn't been by for a couple days so we went and gave them food and water. this is dif. we don't know for sure if they are on vac. and if the little dogs are still back there. but no one has come by. these people don't take there dogs anywhere. they don't even take care of them. what should i do. most will say stay out of it. so those that hate animals don't commenti live in texas and these neighbors pretty much keep to themselves. maybe an occasional hi. so no they are not close with anyone. they live on the corner lot. so i will see if my husband can go peek through the privacy fence. thanks for those that carewell i just went and checked and all i can do is call animal control. so maybe it will take a couple of days. if these people are on vacation they should be home tonight cause school starts tomorrow. they just make me sick. leaving these poor dogs in these living conditions. i looked through the fence and there bowl was empty with weeds all grown around it. the fence is creating a small portion of shade so the 2 yorkies are laying there. i just really hope they are having a worry free vacation. sick people in this world moreVoting Question: What are the gun laws in Florida?
I am thirteen and recently got my first 22. I was wondering what the Florida gun laws were in regards to minors and firearms. I keep a gun lock on it - my parents have the key, although it is in my possession (it's in my closet). It's in a locked case with the ammunition stored in a separate and locked area. Also, are there any other things I need to do? Thanks in advance for your answers.I have done some of my own research of the gun laws prior to this question, but I'm just want to make sure I didn't miss anything. moreResolved Question: How many bedrooms are required for 6 children in Florida?

I will try and give the short version of what has happened to cause this. I live with my husband (who is Irish) in Ireland, about 5 miles from his parents. Every summer I go to visit my parents in Iowa for a few weeks, and for part of this time my husband and his parents will vacation in Florida (where they've gone every year for the past 15 years) for a week or so and then my husband joins me in Iowa. This summer I was supposed to meet them for a week in Florida, but I cancelled the plans to join them when I found out my grandfather was poorly and decided to use that last week to travel to NY to see him, and to spend more time with my family who I only get to see 2-3 times a year. My husband left Florida after a week and came to Iowa the day I was supposed to go Florida so we could go see my grandfather together. Ever since this happened about two months ago, my mother-in-law hasn't contacted my husband or me. He has seen her once, and said she acted cold to him then, and his father has since told him she is furious with me for ruining their vacation and doesn't want to see me. My husband was told by his brother that she said she doesn't think she can ever forgive us, but mostly this means me. Instead of just having it out with me, (or my husband) she is ignoring us while telling other family members how angry she is at me. She is passive-aggressive in general, but we've never had problems before as I've never done anything to upset her. My father-in-law got over the whole thing almost immediately, and is frustrated with her for causing an ongoing and uncomfortable situation (we used to see them at least 3x a month), so I now feel like it's causing problems between lots of people in the family. What should I do about this? I personally don't care if I don't see her or talk to her as I've never been close to her (she's always been hard to talk to and a bit cold) but it's the stress it's putting on my father-in-law (who I adore) and my wonderful husband (who is supporting me 100%) that is so upsetting. Help, please! In response to Kiss4u, we split the cost of the trip evenly; we paid for all our expenses, and while my husband was there on his own with his folks they shared a hotel suite which he paid for 1/3 of, and for 1/3 of the rental car - basically, they weren't out any money by me canceling and they hadn't paid for anything for us. They were there a total of 19 nights, of which I was meant to join them for 5 of. Last year we did the same thing and I joined them in Florida where we rented a house for a week and we split all the rental and food costs evenly, and had a good time, which is why we wanted to do it again. My grandpa is ok, his heart is apparently functioning at 15-30%, and I am very glad I went to see him as he will be 88 in December. I don't regret my decision as I don't know what will happen with his health, but the repercussions have been very upsetting. moreResolved Question: What will happen if I just leave my apartment lease without telling the apartment manager or paying?
First off, yes I know doing this is unfair to the apartment manager and my roommate but you only live once and I'm not going to live like this anymore so try not to judge me when reading this... I live in a 2 bedroom apartment with my boyfriend and a roommate. The roommate verbally abuses me, calls me names and says terrible things about me. The only reason he does this is because he is a 20 year old guy who is in a bad relationship with a 17 year old and he is jealous of my boyfriend and I having a great relationship. It has gotten to the point where I hang out in my bedroom only and I don't leave the room even to eat if my boyfriend isn't home because my boyfriend always sticks up for me. I have no car and no job. Jobs are pretty hard to get where I live so I don't leave very much. My boyfriend used to work for Disney World in the college program and he works for his dad now. We live in Indiana now. He called me from work about a week ago to tell me he got a job offer to come back to Disney and already found us roommates, some of his friends who work at Disney. We have to be in Florida by the first of September and we both feel risking our credit is fine with us because it gets us out of a bad situation and gets him into a job that pays a lot better than his current one. We told the roommate right away we're doing this and he doesn't really care (which surprised me.) Even though he's a really bad person, I feel kind of bad and I want to know what we are leaving him with when we leave. I asked my brother in law (who works for a big collection agency and deals with stuff like this) and he said we can't be summoned to court for an Indiana lease if we're already in Florida and I know it will still effect our credit. The lease says we have to give 60 days notice, pay 2,000 dollars, and all the rest of the rent in the lease if we cancel early which ends up being about $9,500. Will he get charged all of it when the apartment can't contact my boyfriend and I?Yeah I think they had me write my social security number down. Is that their way of finding me if I skip out on the lease? moreResolved Question: does florida law require an 8 year old girl to have her own bed or can she share one with her mother?
The mother decided to move in with grandma and her husband (who has been in jail for drugs). The 3 adults and 8 year old live in a 2 bedroom duplex. Mother and girl must share a bed. Is there a law governing this arrangement? To Pat who answered my question; If calling me a moron is your answer, I think you should take a look in the mirror. This question involves a child who had been placed with guardians because mother abandon her using excuse she could not afford to take care of the child. Mother claimed she was on her feet and was prepared now to support child. Within 24 hours of regaining custody, she had to move to her mothers house because she suddeny realized she could not afford to care for child. Again the child suffers because mother can't afford her own place or child care. Also the grandmother and her husband have a history of domestic violence as well as a criminal record for drugs. Sorry Pat if you don't believe there must be some law overseeing this child's welfare. moreResolved Question: Ramadan:what do you think........?
On 26th July, 2010, a church in Florida, USA, announced September 11th - corresponding 1st Day of Eid Al-Fitr - to be an "International Burn A Quran Day" where every Christian should burn a copy of the Holy Qur'an. The church is also providing T-Shirts saying "Islam is of the Devil" for everybody to wear on that day The church announced -on it’s Facebook pages- all people to burn the Quran. The General Secretary of the Muslim League Dr. Abdullah At Turkey and Sheikh Al Azhar Dr. Ahmad At-Tayyeb warned - in two separate statements- from the danger of such an announcement on human relationships, communication, co-existence and cooperation among peoples. They described the remarks made by the Pastor Terry Johns- that “Islam is of the Devil “ - as hateful, extremist and insolent statements that call for provoking hostility and incite to hatred and resentment, that are things Almighty Allah forbid in all His Messages and are prevented as well by the International Laws issued by the United Nations. The statement expressed strong dissatisfaction of the Muslim world and Islamic centers and institutions from the campaigns waged by this Pastor against Islam and Muslims, that harm to him and to Muslims and provoke their feelings and incite hatred and discrimination against them The Aim of this campaign is to show Islam and the Holy Quran in an offensive way and that they are the source of every evil and terror in this world Now it’s our turn to publish 1 Million copy of the Holy Quran all over the world To make this easy for everybody, we provided different means to deliver the Holy Quran to the greatest possible number of people Join us in our Campaign “The Quran; my Gift to you” http://www.rasoulallah.net/v2/document.aspx?lang=en&doc=11081 moreResolved Question: Are law enforcement agencies in Florida allowed to have arrest quotas?
