Voting Question: False Advertising! Do I have a Lawsuit?

A car company is sending out scratchoffs as a promotion. first prize a new car, second prize an atv, third prize 3 gold coins, fourth prize $1000 cash. When i won, I had to go in and the guy told me i won three gold coins. The guy gave me three 2008 presidential dollar coins that are made out of 0% gold and 88.5% copper. They could have come from the trainstation. Is this false advertising? I argued with the guy, he told me that anyone on the street will say its gold, but i knew it was made of copper. His coworker said it was 100% silver. I continue to argue that i wanted the three gold coins that i won. I asked them to tell me the compositie they wouldn't, they would not tell me the percentage of gold, they wouldn't look it up on the internet, they kept saying that it is gold and other winners were happy with their three gold coins. I made a scene. They asked me to leave when i asked to speak to the guy running the operation. Then the guy told me that he was the manager. I asked if I could see the flyer he said no. I did manage to steal the flyer and the coins as evidence. Do I have a lawsuit? third prize is 3 gold coins( which are actually copper), and They kept saying it was gold when it wasn't and started getting nasty when i asked them to prove it to me. I would be happy with three 1/20 oz gold coins which are under a hundred, its the fact that they are advertising copper as gold that pisses me off. I would also prefer the 4th prize! The fine print in the flyer states gold coins! Not gold colored coins! Which was one of our arguements more

Resolved Question: Do I have grounds for a lawsuit against the Axe company?

Can I sue them for false advertising? Because I spent 3.49 plus tax on their body was (I chose the VICE scent), and then I went to church yesterday, and no hot chicks jumped me! I was devastated! Can I sue? What sort of punitive damages might I win? Thank you for your opinions. -Occulty™ (P.S.--My atheist and irreligious contacts should not be woried that I'm turning religious. Resolved Question: Should Fox News face a Civil Action Lawsuit for FALSE ADVERTISING?

Fox News refuses to report on ANY story that makes the right-wing look bad. Fox News is a JOKE, they spread nothing but lies, hate, and most of all, fear-mongering.. the fact that they call themselves "fair and balanced" is a lie and false advertising. they are a private company, can't they be sued? yes, there is a freedom of speech in the country.. but you can't go around inciting hate. cults are broken up because of this. you can't threaten the President's life, that is against the law.. yet Fox News encourages their followers to hate the President.example: "Bush has hate in his heart" hate = noun. i LOVE when people try to make me look dumb by using misinformation and lies.. it reminds me of Fox News.ND Fan.. hate is also a NOUN. don't attempt to insult my intelligence. my IQ is triple any Conservative's IQ. get real. more

Resolved Question: Seriously...can anyone honestly say that they thought there were real berries in Cap'n Crunch Berries cereal?

Does anyone really think the false advertising lawsuit had merit? http://cbs5.com/local/capn.crunch.lawsuit.2.1037553.htmlDesdamona, it's under "Law & Ethics." It regards a recent decision in a lawsuit, so it is a legal question. Would you like to answer the question now?US Army Veteran, it is actually legal to lie if there is no chance anyone will believe you. The legal term is "puffery." And puffery is used every day in advertising. You remember the M&Ms commercial that said "melts in your mouth, not in your hands"? Well, if you hold them in your hands long enough, they will actually melt. So are they lying? Or is it just a bit of puffery? Either way, should they be sued if some moron holds M&Ms in his hand too long? Or did you really think Juan Valdez picked Columbian coffee beans one by one? more

Resolved Question: Computertraining.com?

I went to computertraining.com jan 07 through july 07. I got a loan for $25,000 to be able to go to this school. When i was finished with the schooling, they had told me that i had a 75% chance of getting a job within 6 months of graduating. I never recieved a degree or actual certificate of any kind. I have been trying and trying to get a job in the IT field now for almost 2 years without any success. And now my student loan is asking for the money that i had borrowed, yet i dont have that kind of money to shell out since i dont have this "$50,000+ a year" job that they asaid i would have no problems getting once i graduated. I guess my question is, is there any kind of Class Act lawsuit going on against computertraining.com for the false advertising and scams they pulled and are still pulling on people? If there is can someone point me in the right direction, so that i may add my bad experiences to the list with the many others. I feel that i had been betrayed and used for someones financial gain, and honestly i would like something to be done about it o that others wont be decieved like i was. Also, is there any way of getting out of this loan? I was told by Sallie Mae that this is one of the worst loans to possibly get as there are no deferrment plans. You can go into forberance, however they say that you must pay 2 full months in advance. Now i dont know about any you, but i cant afford one of these payments let alone 2 full payments. and when i did scrape up 2 full payments and sent it in, they turned around and denied my forberance request anyways. I need someone to please help me in this crisis. Thanks for your answers in advance. P.S. This loan that i was told was a federal loan is in fact not a federal loan, but a loan by a private bank itself.Skeptical, your post is not helping me at all. dont post in here if all you are going to do is tell me what i did wrong. i dont need to here that. i need help and a proper answer for my problem, not some person telling me i didnt do my homework correctly. and yes they still say on the radio and on TV you can make 50K a year at start. more

Resolved Question: Lawsuit for injury due to false advertising?

My husband got a very bad cut from the sharp edge of a can after being opened by the As Seen on TV One Touch Can Opener. The ad clearly states "no sharp edges." The cut was down to the bone and took several hours to stop bleeding. In searching the internet, there are several websites with reviews that show people getting seriously cut from the razor sharp edges this creates on the top of the can. Would this be grounds for a lawsuit? I am not a sue happy person and hate hearing about the frivilous lawsuits out there, but this ad clearly states "no sharp edges." Would appreciate an opinion from an attorney. Thanks! more

Resolved Question: Is it legal to sell or display rigged games?

There is this game called "stacker" i play at the mall that allows you to win major prizes like an xbox 360 or wii. the object of the game is to stack all of the light blox on top of each other in a line while the blocks are moving side to side. however, i heard that the manufacturer set the allowance to win to 1 in 800. Resolved Question: How does apple get away with slandering Vista in their commercials?

I always thought that it was illegal to target another company in ads. Like, you never here pepsi say, "Our product is superior to that of Coke." Rather they say, "Taste experts agree on Pepsi." So my question is, why can apple specifically target MS and Windows and not face slandering or false advertising lawsuits?Untrue.: Microsoft has now sold more than 88 million copies of Windows Vista, according to company officials. Windows Vista: More than 88 million copies soldVista sales were a big part of the reason Microsoft had a more-than-solid first fiscal 2008 quarter, with earnings of $4.29 billion, or 45 cents a share, on revenue of $13.76 billion. New pc users buy vista...old pc users have no need to update their OS yet. Doesnt mean its not selling or bc vista is bad. The new generation of computers handle vista just fine...and it works great. They complain mainly about bloated code and needing 2gigs of memory. Same thing happened with 2000 and xp...everyone was like omg...512mb or ram...UNTHINKABLE! But yet its a great OS. Resolved Question: Do You Know Obama Is Censoring Opposing Political Speech?

Obama Wants NRA Ads Banned Saturday, September 27, 2008 8:10 PM By: Newsmax staff Article Font Size The Obama camp has been threatening television and radio stations to keep them from airing anti-Obama ads. The latest target is the NRA and stations in Pennsylvania. Earlier this week, the National Rifle Association's Political Victory Fund released a series of radio and television spots to educate gun owners and sportsmen about Barack Obama's longstanding anti-gun record. In response to the NRA-PVF ads, a clearly panicked Obama campaign and the Democratic National Committee (DNC) are doing everything they can to hide Obama's real record by mounting a coordinated assault on the First Amendment. They have gone to desperate and outrageous lengths to try to silence your NRA by bullying media outlets with threats of lawsuits if they run NRA-PVF's ads. The Obama camp is particularly angry with an NRA ad entitled "Hunter" which lays out Obama's record on gun control. You can see the "Hunter" ad -- Go Here Now. Other NRA ads include "Way of Life" and another focusing on Joe Biden's record, "Defend Freedom, Defeat Obama." This week, Obama's campaign general counsel Bob Bauer wrote seeking to censor the ads at stations in Pennsylvania. "Unlike federal candidates, independent political organizations do not have a 'right to command the use of broadcast facilities,'" Bauer writes. "Moreover, you have a duty 'to protect the public from false, misleading or deceptive advertising.'" "This advertising is false, misleading, and deceptive," Bauer continued. "We request that you immediately cease airing this advertising." The NRA says Obama's camp are sending out these "intimidating cease and desist letters" to cable operators and television stations, threatening their FCC licenses if they run the ads. The NRA charged that "Obama and the DNC have been using strong-arm tactics reminiscent of Chicago machine politics to try and cover up the truth and silence NRA by forcing the stations to assist them in hiding Obama's radical anti-gun record." And now, Obama and the DNC have opened a new front in their assault on your First Amendment rights by calling on their followers to contact these station managers to demand that the stations not run NRA-PVF's ads. NRA stands behind the accuracy of these ads, and NRA attorneys have responded to the Obama campaign's despicable and abusive attempt to trample on the First Amendment by sending a thorough rebuttal to station managers. This rebuttal clearly and conclusively refutes the Obama campaign's fallacious claims that the ads are inaccurate. The NRA has set up a web site detailing its position on Obama at www.gunbanobama.com.  more

Resolved Question: Can i get a small claims lawsuit against me for a sale of a product online?

I sold a set of wheels on a website forum. this was not an auction or sales site at all. the site is for a subaru fan club. i posted that the wheels were used and in good condition. the guy i sold them to received them in used and good condition. i did not lie to him. he claims that 2 of the rims are bent and he wanted his money back. i refused so he said he called a lawyer and is filing a false advertising lawsuit against me. can he do that or do you think he is trying to scare me? more

Resolved Question: Strange Lawsuits?

We all read about weird lawsuits online, but what's the strangest one you've experienced? My strangest one by far has to do with false advertising. We've heard of people suing businesses because a 'reasonable' person would have assumed a business promoted "x" but instead did "y". I once had a friend get sued by a man she turned down and tried to get a protection order against. He sued her for 'false advertising', but it had a different name (I wish I could think of what it was!). His lawyer managed to convince the judge that a reasonable person would think she was interested in him because of her actions, and that her words (which he described as 'inconsistant') could have been interpreted by a 'reasonable' person as the go-ahead. Before she got the protection order through (he was not violent toward her, I think that was the problem), she ended LOSING and was stuck with a protection order against HIM. more

Resolved Question: You've seen it on TV, but who has actually had "crowds" of sexy women dogpile them because of wearing Axe?

I'm thinking about pursuing the filing of a lawsuit against Axe for false advertising. My grounds would be that I have used their product, but unlike their testimonials and television spots suggest, I've only ever had 2-3 women jump on me at one time before because of it...one of those women was 94 years old, and the other one (I'm pretty sure) was transgendered. Resolved Question: Can she win this lawsuit?

I am a childcare provider and have been caring for children in my home for a little over a month. I will no longer be able to do this for personal reasons. I gave each of the parents of the children I care for my two-week notice. All have been understanding except one mother. She has been difficult to deal with the entire time I have had her son in my care. She demanded her deposite back (the sum of two weeks of care). In my contract I state that there must be a two week written notice in order for her to get her deposite back and the deposite is given back in the form of her last two weeks of care. When I refused, she said she would see me in court and hung up. The next day she called and left me a message on which she threatened to sue me for "child endangerment" because I "got her son sick" by letting another child who was sick be in my care. And "false advertising" because she says I told her that I would have a substitute for any time I was absent. She can not prove either ofthese things because they are not true. She said she would not sue me if I give her her deposite back. I feel if she really felt that her son was so threatened, she would have sued anyway. Also, she stated that she was unhappy with my services, well, if that were true, she could have told me this BEFORE I gave notice. Can she win?Infinity, I still don't believe I should give her deposite back. I gave her two weeks notice... the deposite would have covered those last two weeks. But, as stated in my contract, I do not give back a deposite in the form of cash/check/etc. Except during the trial period (two weeks which have well passed). more

Once I called her because her son had a fever of 103 and could not get hold of her so I called his father. The father told me it was my responsibility to get hold of the mother. When the mother finally came to get her son, she chewed me out for calling the father. She even turned red, she was mad. I almost ended the contract right there but I thought a lot about it and assumed she was going through a lot. Her husband probably yelled at her which would frusturate me as well. She was just transferring her emotions to me. Well, things like this happened regularly and frankly, she is part of the REASON I will no longer be having a daycare. Resolved Question: False advertising by large coporation--jewerlery?

I bought a ring from a large coporate website (won't mention the name here as a lawsuit may soon be pending) sold me a ring for a premium price. It was claimed to be 10kt white gold. Resolved Question: How is this not false advertising?

My local Subway resturant has displays of their sandwiches and they are full of meat and cheese and are at least twice the size of the actual sandwich they actually make. How can food companies like them, and also the other fast food places that have pictures or commercials showing these large burgers or other items, get away with showing you one item, and then make you a sad knockoff when you order your food. If you were to go to a store and buy an item and when you got it, it was smaller, or had less parts than what was advertised, the store or manufacturer would have a lawsuit on their hands. Resolved Question: Corporations, Fraud, and Who Is Responsible?

If a corporation is sold to another entity, and the acquisition contract states all previous and future liability lies on the purchaser, who is responsible for fraudulent advertising claims later on in the corporations life? Note, the corporation was making the same advertising claims before and after the sale. I am asking about what the FTC will do about this. For example, owner A develops a website with false advertising claims on it. Owner B acquires this corporation with the understanding he or she was responsible for all liability related to corporation. Owner B runs business as usual. FTC files lawsuit against corporation with new owner. New owner claims website was made by previous owner, and not his or her fault claims were false. Who does the FTC punish? Resolved Question: Are today's socalled conservative republicans really a mockery of what a true republican is?

Looking back at our American history Thomas Jefferson was the first to Identify as a republican. He was vehemently opposed to the federalist papers and ideas he was a deitist and didn't believe in organized religion(science and knowledge is truth religion is tyranny). He also would never have supported a standing army or sending our troops overseas. The republican party of lincoln was from the north and supported equal rights hence the emancipation of the slaves.religion wasn't part of the party until if I remember right lincoln was slipped a part about god in the gettysburg address. Now the party has none of the lincoln northern states and is almost overrun with conservative federalist.Would it be proper to say Jefferson is the true republican and todays should have to give up the name because they falsely represent the true republican values.Kinda like a false advertising lawsuit.Actually I was a registered republican till 2004 and have never been a democrat I am registered ua right now and hoping the religiuos conservatives get out of the party they are destroying it with hate in god's name or saying your not american if you don't agree with them. Also I am a berlin vet so I know what communism Is and I have been to more revolutionary era historical sites than probably most people. So if you don't like what my question implies kma. more

I live in Nevada so there are no consumer protections against anything, but I visited the one in California and they're all sue happy so I think I have a chance. Any lawyers out there that would like to take this case and stop the lies? We need to protect the innocent consumers out there who just wanted to dine on an Okapi to help it gain endangered status. Resolved Question: Should We Sue......?

Music TeleVision (MTV) in the US for false advertising? We could do a class action lawsuit claiming false advertising, fraud, and other violations. They only play music 5 hours a day now. around 20% of the programming is music. Around 80% of the programming are reality shows. How about a Class Action Lawsuit and get and injunction to get them to play music at least 51% of the time (over 12 hours a day). What say you?Now they are showing reality shows on MTV2 as well. They are lying to us.An even better idea would be to buy 1 share of company stock and vote the management and board of directors out for poor performance. more

Resolved Question: False advertisement lawsuit?

This has been bugging me for a long time, everytime I go to taco bell the pictures of the burrito's and tacos are EXTREMELY full to the brim with whatever particular ingredients are in the wrap, but the actual portions you get are no where NEAR the advertised picture...Im being serious here, am i the only one who thinks this is completely unacceptable lol....lawsuit??Wanted to point out Im not really talking about the way the food looks, smashed, stale etc, Im mainly talking about the amount of, lets say meat lets say is clearly 50% to the top of the shell, and what you get is 15%, and as far as the comment about how that is before it is handled and packaged, this clearly would have no effect on the beef since it is cooked fresh right? correct me if im wrong more

Resolved Question: Could I sue if i bought healthcare products that the salesman claimed to be FDA approved and werent?

I bought skin care products from a saleman in the mall and he swore up and down that ALL of his products were FDA approved, being stupid I believed him and bought them. Turns out, I searched the company's website and NOTHING about FDA approval. I believe this is illegal, but the only ones who heard him claim these things were me and my fiance. Is there a valid lawsuit here or am I going overboard? This is horrible to me that someone could get away with this. False advertising, false claims, its horrible. more

Resolved Question: I need legal advice?

in 2003, yes 3 years ago I had signed up for an AOL trial account for 2 months, when I attempted to cancel this account, the representative that I spoke to offered me a free month (to help me reconsider about canceling), and when I called to cancel that month the representative offered me 1 free month, then when I called to cancel that, the representative offered me 2 free months, and I finally got tired of it and canceled it. Now 3 years later, I get bill from a collection agency saying that I owe 95.60 for 4 months of service (the free term, so if they charge me they had lied, and false advertised to me), and are threating to put a negative mark on my credit for it. Anyway, after dealing with AOL they told me they had some technical problems with billing in 2003, but I'm still responsible for the money, even though they don't have my 3 year old records, and will HAVE to send away for them which they might be able to do. I told them to do this. Now...who do I talk to to file a lawsuit?AOL has never attempted to contact me ONCE about charges I owed, as well as the fact the representive 3 years ago, said there was no balance due at ALL. more

Resolved Question: Can religions be sued for false advertising?

Resolved Question: Is this a problem?

I drank a lot of coffee this morning; as a result my bladder is acting hyperactively. This last trip to the urinal, I started unzipping my pants about 5 feet from the washroom, and continued walking towards the door. By the time I got to the door and opened it, I had prematurely whipped out my schlong. This was an error in judgement on my part. Usually the washroom is empty; it is very rare for someoone to be in there. However, this time, my boss was washing his hands at the lavatory, whilst I was standing there with my weiner pointed towards the ground ready to serve as a conduit for the urine I was about to excrete. Things got really awkward really fast. My boss told me to leave and never come back to the office again for indecent exposure, as it looked like I was just showing him my willy.
