Open Question: How to report false advertising?

How do you make a complaint for false advertising? Is it a government agency or does it have to be a class action-style lawsuit? Just really mad at a couple of companies: - Sprint's Everything Data plan: If I want to get a 4G phone, I have to $10 extra per month, if I want to tether, I have to $10 extra per month, if I want to use a 4G phone as a wifi hotspot, I have to $30 extra per month. That's not "everything data". That's not even half of everything data. - Time Warner Cable: "The home of free HD", but they want an extra $7.95 a month per HD receiver for an equipment lease... and they don't let you buy your own HD receivers. Not feeling very "free". more

Voting Question: Anyone else want to join me on a Class Action Lawsuit for false advertising on Unlimited Mobile Broadband?

I have Cricket Wireless and they claim to have Unlimited Mobile Broadband. That is not true, they have a 5GB limit, and your speed is then dropped to near 56k dialup speeds after your 5GB is used up. 99% of Internet Browsers timeout webpages at that slow of a speed. It basically doesn't work at all. So what do I need to do to file a Class Action Lawsuit?I saw the commercial, and it said unlimited mobile broadband. I raced out and got the service. Then when I realized how it actually worked, they told me all the information is on their website. I didnt have internet, that is why I got their service. How am I supposed to see it on their website, if I am using them to get internet? It wasn't on their commercial. I have pictures of their site from months ago when it was a lot more misleading as well. more

Resolved Question: Lifelock class action settlement amount?

I have been a member of Lifelock for 3 years, and about a week ago, I got an email that there had been a settlement in a class action suit against Lifelock, basically for false advertising claims, and that I am due a payout. I'm sure it isn't much, but I'd like to know how much. I sent an email to the attorney listed as the contact person to find this out, but there has been no response. I do know that there is a 35 million settlement, of which 11 million goes to the feds and an undoubtedly huge chunk goes to the attorneys, but does anybody know how much goes to the allegedly wronged 'class'? Thanks in advance for any help. more

Resolved Question: Does your child watch Baby Einstein videos (3 questions)?

I just read a few articles about how Disney has admitted that their Baby Einstein line of videos does absolutely nothing to increase or exercise the intelligence of young children. Spurred by a threat of a class action law suit for false advertising, they are offering refunds or exchanges for up to 4 Baby Einstein videos! Just thought you all might want to know. http://www.ktla.com/news/landing/ktla-baby-einstein,0,7241282.story http://www.nytimes.com/2009/10/24/education/24baby.html?_r=1 http://www.commercialexploitation.org/babyeinsteinrefund.html 2. Also, have you bought these videos for your child? If so, do you think they helped increase or exercise your child's intelligence? 3. Do you think Disney should have to reimburse parents for purchasing these videos and"buying into" the snake oil? Or do you think it's a buyer beware situation and people should be forced to live with the decisions they make - ie. to believe the hype and purchase these videos?Josephine - So sorry to bore you with "bla bla old news" Everyone else, thanks for the great answers! I'm actually very pleased to see that most people agree that it's ridiculous that Disney should have to reimburse parents for these videos. Society has indeed gone crazy. more

Resolved Question: have you been scammed by priceline?

I did a name your own price for a hotel. When the offer came back, it was for 3 times the cost that I named. The company says I'm stuck, even though I never saw their supposed counteroffer. Is anyone working on class action suit for false advertising. I've called HQ, VP of Hotels, VP of Cust Service and VP marketing. They all say I'm stuck because their computer did not send me some supposed counteroffer. I was naming my price but they stuck me with their own. Class Action anyone? more

Voting Question: Isn't this a case of false advertisement.?

Now I'm not much of a lawyer but my mom is, however she's a divorce attorney so she isn't 100% positive on the answer of my question. Now I've read a lot of cases about people who sue companies for millions of dollars for really stupid things. And a couple of weeks ago in my Social Actions class we were discussing false advertisement and we talked about how everything has to be sold exactly how it is advertised or it is false advertisement. So that same day I saw a Burger King commercial and I thought it was pretty funny, it was the one with the whopper jr and his father, so I kind of remembered it. But in the commercial it said the burger was only 1 dollar. However I noticed the other day when I entered a local Burger King that it was actually $1.19. Isn't this false advertisement? Not that I'm going to try to sue BK but when you think of the amounts of people who buy whopper jr's everyday thinking their a dollar BK must make millions out of it. I mean supposed with taxes its 1.07, you multiply the the 12 leftover cents by lets say, 1 million burgers a day. That's a lot of money. I just found it amusing and also interesting how such a big industry could make such a stupid error. more

Resolved Question: Misleading Advertisements For Yellowbook AD Question?

I was sold 2 advertisements on misleading information from a yellow book agent where they told me that Yellowbook is the most used book, however in 6 months having the advertisement, I have only received 3 calls while my other advertisements are averaging me about 1-2 calls/week. As I researched this further, I found that Verizon had sued YellowBook back in 2004 over the same claim that yellowbook uses found here in NY Law. Verizon Directories Corp. v. Yellow Book USA Verizon Communications Winston recently garnered successful results for Verizon Communications in connection with a suit seeking an injunction prohibiting Yellow Book from continuing a nationwide advertising campaign that Verizon alleged was false and misleading. After a three-week bench trial in the Eastern District of New York, Judge Weinstein ruled that Yellow Book had violated the Lanham Act and New York state law by making false claims that more people use the Yellow Book than use the yellow page directories published by Verizon Directories Corporation. The parties later settled the damages phase of the case, which was scheduled for jury trial in December 2004. (http://www.winston.com/index.cfm?contentID=74&itemType=3) Do I have a case for a class action suit against yellowbook, or can I get out of paying for this wasteful advertisement that I am paying 240/month for? more

Resolved Question: Can I bring a Class Action suit against a church?

This is meant as a joke, just poking fun. They promise salvation through Jesus and can provide no proof of their claim. They collect money to keep spreading their unprovable message. Promising something and not being able to provide is false advertising. Class Action suits can be brought against false advertising. So, could one take a church to court?Sigi H: ya, I know that. I just don't want to seriously offend anyone.tuyet N: EXACTLY that is what i have posted on more than one occasion. I keep getting thumbs downs and hate mail. more

Resolved Question: How Can Movie Theaters Get Away With Advertising False Movie Start Times In Order To Show Ads?

Movies in most theaters normally start about 15 to 20 minutes after their advertised times. The theaters are generating captive audiances in order to show car and cell phone ads as well as promos for other movies the want to sell to their patrons. Local newspapers condone this by advertising these false times as well. Some consumer protection group should do something about this. For as much as I dislike law suits this is a situation which merits class action on behalf of all theater patrons. more

Resolved Question: Should We Sue......?

Music TeleVision (MTV) in the US for false advertising? We could do a class action lawsuit claiming false advertising, fraud, and other violations. They only play music 5 hours a day now. around 20% of the programming is music. Around 80% of the programming are reality shows. How about a Class Action Lawsuit and get and injunction to get them to play music at least 51% of the time (over 12 hours a day). What say you?Now they are showing reality shows on MTV2 as well. They are lying to us.An even better idea would be to buy 1 share of company stock and vote the management and board of directors out for poor performance. more

Resolved Question: How do you start a class action suit against a major company?

DON'T ANSWER UNLESS YOU HAVE ACTUALL LEGAL KNOWLEDGE. Verizon wireless is false advertising "unlimited broadband access" for a flat monthly rate. I signed up in response to that advertising, and in the store the salespeople also used the words "unlimited", yet they sent me a letter stating they are disconnecting me next month because; "The terms and conditions only permit internet browsing, email, and intranet access....Streaming and or downloading movies/video are prohibitted." They claim my usage is too high. They are canceling my service, not refunding my device purchase, plus I bought a $1000 laptop (elsewhere) to go with this wireless internet card and now I have to search for a new provider, and it appears doubtful that I will find wireless service that is as fast, making the laptop useless to me. They are screwing people all over the country. How do we all get together and get back at these bastards legally? more
