Resolved Question: What to do about unwanted Craig's List ads?

I have an estranged ex-roommate who subleased out her room in March of 2010. At this point, all the leases are full. All current roommates do not have any plans on leaving before the lease termination in August 2010. However, while one of the roommates was cruising through Craigslist, we came across an ad posted on June 9 (Wednesday) with a PICTURE of me and my other roommate. Which is not okay for safety reasons. However, this was NOT the first time this has happened. We were not looking for a roommate this spring too, but had responses to an ad that was posted by her with, yet again, our picture. We had discussed previously that craigslist is somewhere we would NOT search for a roommate and once seeing MY picture on craigslist, we had a long discussion on how it was not okay to post it. We addressed this issue today by getting craigslist and other websites (roomster) to remove the unwanted and false advertisements (again..we are not looking for a new roommate and haven't been for months). I am scared though that after this confrontation, we will begin seeing our picture a lot more on craigslist and what not because that's how this girl works. (Oh, my roommate also got a lot of unwanted, blocked numbered, phone calls after the first original incident with craigslist...we believe the ex-roommate also posted her number somewhere on the website, but we are very unfamiliar with locating things on craigslist, as it is a website we try to stay away from) My question is, what can we do if we do begin to see more unwanted ads on internet websites? I have already spoken with a lawyer for other matters pertaining to the ex-roommate (she wouldn't pay bills and stole many things). Should I contact him again for harassment? I know its hard to fight internet cases because the internet laws are still very vague. Any feedback or advice would be GREATLY appreciated. PS. Logical reasoning does NOT work with the girl. We have tried before, many times. She even denied posting the ads today even though on roomster it was posted under her name and correct age. more

Resolved Question: Charter Communications refused to give me what they promised me. What can I do?

I got a notice on my door from Charter Communications saying that I was receiving a signal and they would come out and cut it off. Feeling as if I was being accused of stealing cable when I had only a converter box and antenna, I marched down to the Charter guys and told them I have only a converter box and don't like being accused of stealing cable. The man said to relax and that he wasn't accusing us of stealing cable. Then, he tried to talk us into getting Charter installed. We told we didn't know that Charter was kinda expensive compared to other options and the man then proceed that if we took Charter, he'd give us a free month of cable to start us off. So, that reason I decided to take Charter instead of weighing my options. I then got my bill in the mail and I was billed for the first month (in advance). I was pissed that I was lied to (false advertisement) and so I went online to Charter. The woman on there apologized and said there was only so much that Online Support could do and gave me a number to call. So I called the number and they refused to do anything about the false promise they made me to get me to take their cable. She said there was nothing they could do. When a company makes a promise, they have to carry through with it. I was lied to, tricked, and deceived by a company so close to going under, apparently they're desperate to get customers no matter how big of a lie they have to tell to get them. It's false advertisement and fraud, which is against the law but when they told them that, it did no good. We just got stuck on hold for like ten minutes. I'm reporting Charter to The Better Business Bureau for fraud. And, I plan to take legal action. Just not sure how to go about it. So what should I do to get Charter to either give me what I promised or take legal action?I've already gotten the bill and when I called, they said it wasn't on my account to recieve a free month. A month won't straighten it out. It's not the money. It's the principle. Big companies defraud us and take advantage of us all time time. We have to do something to show them that what they are doing is wrong. It's okay. I just filed a complaint with the BBB of America. Like I said, I'm not in it for the money. It's the principle. You don't make promises you have no intention to keep. more

Resolved Question: whats the deal with cyberdefender?

My mother in law recently got rid of her Norton protection (because she thought it wasn't working or something) and switched to cyberdefender. She paid $90 for it but ever since she installed it she has been having ALOT of problems. she called the company and told her they were going to charge her $300 to speak with someone, she wouldn't pay that but they did tell her that "its impossible for ANY virus protection to get rid of all viruses." It turns out that she had over 280 viruses, witch is WEIRD because she NEVER downloads anything. So WTF is the deal with this company? Are they just scamming or what? They said they wouldn't refund her, but I mean her computer almost crashed over it, and she only got the computer 3 months ago. So can she get her money back for false advertisement or something? Has anyone else had problems with these people? And can anything be done to get people to stop using them?To cyberdefender: Yeah, I said in my note... IF YOU HAD READ IT that my mother in law had ALREADY called and was told she could NOT be helped unless she PAID $300 so BS on your part! CUSTOMER SERVICE SHOULD BE INCLUDED FOR FREE, SO DON'T GET ME RANTING OVER THIS BECAUSE I AM PISSED OFF ENOUGH AT YOU AND YOUR FREAKING "COMPANY" SO I SUGGEST YOU JUST BACK OFF BECAUSE WE TRIED YOUR DUMB IDEA AND IT OBVIOUSLY ENOUGH DIDN'T WORK OR I WOULDN'T BE ON HERE!!!! more

Resolved Question: Can you get a traffic violation ticket if you have never been pulled over?

I got 4 advertisement letters from law firms stating that I received a ticket for reckless driving. 3 of these letters were dated July 15. One was dated July 2. ??? So then, I called the Municipal Court because I never got pulled over nor received a ticket in the mail? They had told me that I was issued 3 tickets: 1 for not wearing a seat belt, reckless driving and last one was failure to stop at the stop sign on July 10 at 9am, the occurence supposedly happened 4 blocks away to my right from my house. However everyday, I leave home at 845 to get to work by 9am and I take a different route (I go straight down the block and make a left). How can I contest this in court? If I were a reckless driver, I would not have my job because asides teaching developmental disabled I am also a driver for them when we go out into the community. I am more responsible then that! So I would lose my job if I get these tickets. (We are required to have a clean license). Then I wouldn't be able to pay them, I wouldn't be able to continue my nursing school, I'd be homeless with my son and my mom who is a kidney transplant patient. :( only because of false information! Resolved Question: How do people feel about this letter to the editor over illegals? Illegal immigrants don't deserve any rights?

Illegal immigrants don't deserve any rights http://www.mycentraljersey.com/article/20090705/OPINION04/907050301/-1/newsfront/Illegal-immigrants-don-t-deserve-any-rights I'm writing about an article in the Courier News on July 1 about an illegal immigrant who was given the right to a pretrial program. If he is admitted into this pretrial program, all charges against him will be dropped. This is wrong. He is here illegally. End of case. Advertisement Every member of the appellate court who ruled that an illegal immigrant has the right to a pretrial intervention program should be fired and never be allowed to have any public office or judgeship ever again. The illegal immigrant was stopped in Bound Brook by a police officer, found to have a fake driver's license and false ID. He admitted to being here in our country illegally. The reason he was stopped isn't what this writing is about. He is in our country illegally. That is what it is about. Shame on Judge Edward Coleman who granted the right to appeal the original rejection of his admission into the pretrial program. Shame on the lawmakers of our towns, states and federal government for allowing illegals any rights at all. These laws giving rights to illegals hinder the prosecution and deportation of these illegals. Laws should be for the protection of the legal citizens of our country. If you are an American citizen born in this country of legal American parents and/or an immigrant who is here legally, then you have rights. Otherwise, the only right an illegal should have is the right to a plane ride back to the country they came from. And, that country should be paying all the expenses to have him sent back. When is the federal government going to see that much of the trouble in our country is because of illegals? Our Border Patrol forces should be increased and should be armed. Anyone crossing our borders illegally should be warned that they will be shot if they do not turn back. Mexico has armed border guards on their borders. I guess these guards are asleep when the traffic is going north into the USA. Our schools should be able to demand that foreigners coming in to our schools are here legally and foreign students coming in to our colleges must be thoroughly checked and monitored to make sure that they truly are students and are not here for terrorist purposes. We are the United States of America, for legal Americans. We should not have to give in to every group that comes to our country and starts demanding that things be their way. The Revolution was fought and the Declaration of Independence was signed so that we would have our own English-speaking country. We shouldn't have to demand that our country belong to us, and we should not have to press 1 to hear English. LOIS ROMANO Bound Brook more

Resolved Question: American kidnapped tortured and imprisoned -without trial - Is that OK with you?

WASHINGTON (Reuters) - The International Committee of the Red Cross concludes in a secret report that the Bush administration's treatment of al-Qaeda captives in CIA prisons "constituted torture," The Washington Post reported on Monday, citing newly published excerpts from the 2007 document. ADVERTISEMENT The account of alleged physical and psychological brutality inside CIA prisons overseas also states that some U.S. practices amounted to "cruel, inhuman or degrading treatment," the newspaper reported. The secret report strong implies that the United States violated international law prohibiting torture and maltreatment of prisoners, the newspaper said http://ca.news.yahoo.com/s/reuters/090316/world/international_us_usa_torture_redcross Because the CIA says it is OK when they do it to other citizens in other nations The headline is false I made it up --- No American has been kidnapped and tortured without trial on the accusation of terrorism --- Not one that I am aware of But ---- would it be OK if it did happen ? Why is it OK for the US to break the law and torture people ?perflexed Status crime --- which is what the US is operating under right now to do the things they are doing A Status Crime is a crime of being rather than a crime of doing. Examples of status crimes include addiction, homelessness or prostitution. The distinction with other crimes is that individuals are not caught in the act of a crime. For example, a cocaine addict would not be caught taking, in possession of, or with drugs in his system but simply be convicted due to reputation or confession. Status crimes are no longer enforceable in the United States due to unconstitutionality since the mid-1800s and have largely ended in most countries. http://en.wikipedia.org/wiki/Status_crimes A status crime is an illegal measure it is unconstitutional and offensive to the ethics of all But that is exactly the "law" the US and it's agencies are operating under in order to do what they are doing History shows us that at first a status crime is applied to foriegners then citizensNo Za Za It is not OK --- it was called what it was A war crime --------- Does the law apply to everyone or no one or just some people some of the time?********* Za Za I hear you -- really I do Look at some of the film footage of what Japan did to 18 yr old Canadian soldiers - They were just as bad as German camps It is a horrible sight --- these were kids no more and they looked just like any Nazi concentration camp victim when we got them out of there --------------- But if we become as bad as they were by committing the same acts they did then WE become the monster That is not acceptable and I refuse to give the monster that much power --- the power to turn us into sou less Nazis We must remain better than and above that Is sinking to the level of brute Nazis the answer for you ? I do understand the first knee jerk reactions -- but is it worth it to let the monster turn you into them ? more

Resolved Question: False Advertisement in Pizza Place? Anyone know about the law ?

Okay so at this pizza place i was at with my friends .. they have this little contest with a gumball machine. For 25 cence u buy a gumball and if u get a white one , you win a free large pizza. The EXACT words of the sign are "Get a white gumball, win a free large pizza" So my friend got a cracked one. It was a little les than have green, and the rest of the "shell" was cracked off, so it was WHITE. We brought it up to the counter and told them we should win because the sign didn't say it had to be FULL white. They said no, because it was originally green. We argued that fine, well it's a defetive gumball, so we should at leaast get a gumball. We were in there argueing at least an hour (dont ask.. haha. we were bored.. we were having fun arguing with the people that work there) Anyway, we want to go back in there tomorow and try to convicnce them that they are wrong, and the cheated us out. Does anyone know if this is like illegal or something? Since there sign didnt clearly stae it needed to be fully white? Any suggestions we could argue? Thanks so mcuh!Nooo. WE didn't chip the shell offf.. it was like that when it came out of the machine. So we were saying we at least wanted a refund for our defective gumball.. more

Resolved Question: Need help with this business law crap. Need one page what should i write?

The Controlling the Assault of Non Solicited Pornography and Marketing Act of 2003, known as the CAN-SPAM Act, was passed by Congress and became effective in January of 2004. It established a framework for federal regulation of unsolicited commercial email. It covers email the primary purpose of which is advertising or promoting a commercial product or service. It exempts email that facilitates an agreed upon transaction or updates a customer in an existing business relationship. It bans false or misleading header information, prohibits deceptive subject lines, requires that recipients be given an opt-out method and requires commercial email to be identified as an advertisement and include the sender's valid physical postal address. The Federal Trade Commission is authorized to enforce the Act, and the Department of Justice has the authority to enforce its criminal sanctions. Assume that a company which has regularly, and successfully, marketed their products through email challenges the constitutionality of this law. Their argument is that the law exceeds the authority given to Congress to regulate under the Commerce Clause. Discuss the merits of that argument. In your discussion, identify the scope of Congress' authority under the commerce clause. In general, what type of activity may Congress regulate? (5 points). Also, discuss whether this particular regulation a valid exercise of Congress' power. (15 points) Then, assume that the state of Tennessee passes a law regulating the same type of activity, but which, in addition to those prohibitions contained in the federal law, also prohibits email updates to customers in an existing business relationship. Identify the constitutional source of the state's power to pass such a regulation, and discuss whether this is unconstitutional because it violates either the "dormant" commerce clause or the supremacy clause. Resolved Question: Misleading Advertisements For Yellowbook AD Question?

I was sold 2 advertisements on misleading information from a yellow book agent where they told me that Yellowbook is the most used book, however in 6 months having the advertisement, I have only received 3 calls while my other advertisements are averaging me about 1-2 calls/week. As I researched this further, I found that Verizon had sued YellowBook back in 2004 over the same claim that yellowbook uses found here in NY Law. Verizon Directories Corp. v. Yellow Book USA Verizon Communications Winston recently garnered successful results for Verizon Communications in connection with a suit seeking an injunction prohibiting Yellow Book from continuing a nationwide advertising campaign that Verizon alleged was false and misleading. After a three-week bench trial in the Eastern District of New York, Judge Weinstein ruled that Yellow Book had violated the Lanham Act and New York state law by making false claims that more people use the Yellow Book than use the yellow page directories published by Verizon Directories Corporation. The parties later settled the damages phase of the case, which was scheduled for jury trial in December 2004. (http://www.winston.com/index.cfm?contentID=74&itemType=3) Do I have a case for a class action suit against yellowbook, or can I get out of paying for this wasteful advertisement that I am paying 240/month for? more

Resolved Question: Should we be worried more about President Obama than the leader of the GOP Sarah Palin?

source: http://www.lewrockwell.com/blog/lewrw/archives/023936.html For those who worry that Sarah Palin is going to become the next dictator of the United States or will lead the fascist yahoos of the Republican Party and the Religious Right to create something akin to the society of "The Handmaid's Tale," I really would not be too concerned. As we look at the upcoming Obama administration, it will do us well to remember that the main power groups of the Democratic Party which will call the shots for at least the next four years, and more likely the next 40, include the following: Labor unions, environmentalists, the American Trial Lawyers Association, the hardcore Religious Left, and ACORN. All of these groups are united in their visceral hatred for free markets and for personal liberty in general (except in areas of sexual freedom and in the "freedom" to kill unborn children). These groups will be unchecked in their Grand Vision that they intend to impose on the rest of us. Not only will Obama and Congress make sure that the Big Three automakers survive in some form, but their political allies will make sure that the other auto plants in this country owned by foreign subsidiaries are smashed beyond recognition. Al Gore wants to destroy most of the current productive capabilities of electricity and also require us to drive electric cars, despite the fact that the laws of science (not to mention the laws of economics) tell us that his Grand Plan is unattainable. Obama says that one of his first executive orders will be to declare carbon dioxide to be a "dangerous pollutant," which means all people are "dangerous polluters." Sooner or later, this government will force all of us to purchase "carbon credits" or face criminal consequences for polluting the earth with our exhaling. The Obama campaign sought to have criminal charges filed against people who they claimed ran "false" television advertisements" against him. Congress plans to bring back the Fairness Doctrine, and I am sure that there will be other sanctions, criminal and otherwise, against dissenters. Perhaps the Obama State will recall troops fighting abroad, and I hope that is the case. However, people with this kind of Grand Vision are not going to be satisfied if just Americans are doing their part to stop the supposed march to disaster through Global Warming. If the Chinese and others refuse to stop building those Satanic coal-burning electric generation stations, then I would not be surprised to see a "Green" retaliation against such environmental miscreants. No, by the time this upcoming hard-left government is through with us, Sarah Palin will not be a threat. In fact, whatever it was that she was espousing will look pretty good compared to what we are about to have imposed upon us. But, don't fear; there will be no U.S. Government led by Sarah Palin. more

Resolved Question: Is this against the law?

What I meant by that is I think it's against the law to kill the animals and then say your against it. I mean isn't that kind of like false advertisement? Voting Question: Is there a law against false advertisement?

What I always notice, and it annoys me so much, is that businesses constantly misadvertise. Once I looked for a used car. The dealer advertised a price for a car that seemed really good. I called and they said, yes, we have it. When I was there they of course did not have it, but had an older car of the same model with more miles for almost double the price. The issue I have is that these businesses constantly advertise like that. There are even businesses that offer you products they do not even have just to get you in the door. How can such business practices be legal and why isn't anyone doing anything against that? more

Resolved Question: Do companies have a legal obligation to honor the prices they advertise on-line?

I am planning a wedding in the USA while living in Australia. The difference in time zones makes it easier to do a lot of the planning on-line. The problem I am running into over and over is, many companies raise their prices considerably (sometimes several times) and fail to update their websites to reflect this. Are there any laws regarding this? To me it seems like false advertisement.  more

Resolved Question: Hannah Montana 3D Movie (this isn't a fan question)?

Not that I'm going to, but is it possible to sue Disney Channel for false advertisement because of Hannah Montana 3D? First, they [Disney] said that Hannah Montana was exclusively for one week... then they stretched it to one month... and now they're playing the movie on Disney for "one" time for, basically, no charge. So can I execute my first question? Second... if you're a parent that's annoyed by Hannah Montana consumerism, can you write it down? Please and thank you in advance! P.S. In case all you read was 'sue Disney Channel' - I'm not going to. This is just a project I'm doing for a summer academy I'm going to. It's for this law enforcement class :/ more

Resolved Question: Coke Zero - Isn't false advertisement illegal?

I think we've all seen the commercials and the slogan that it's "Real coca cola taste," etc, etc. Well, if you, like me, have actually drank the stuff we know for a fact that its a pretty far cry from the original Cocal Cola flavour. I've always been taught that false advertising was against the law, and the fact that they've been touting Coke Zero as having "real" Coca Cola taste, doesn't this fall under that category? more

Voting Question: If Internet Scams are so obvious and recognized, then why are they allowed to carry on?

I understand that the internet is a endless web of networks and people. and to try and restrict or regulate any certain group, even one with illegal or foul-play intentions, fueled by offers hiding behind hollow promises, candy coated with employment opportunities and $$, Sounds like a pretty endless battle, as there are too many existing paths for advertisement that even if there was a way to restrict those with ill natured, false or dishonest outcomes, from advertising or networking at all, they would still find a way around eventually, Right? Well,if that's the case for allowing these P.O.S. money hungry, prey on the weak and innocent, liars out there,to run their scam sites with dishonest lures that violate laws all over the world,is like admitting defeat and announcing that the W.W.W. is out of control.and will continue to become the worst technological advancement ever,if only it was controlled properly from the start, it wouldn't be so out of our reach of control today.Well obviously, those who've commented or relayed an answer thrive on stating things as to justify or make themselves feel better about subjects they do not wish to see the negative aspects of because it scares them. I never said that the Internet didn't have good points and an endless sea of knowledge and so on. I simply pointed out just one of the negative aspects I feel is not controlled because it's basically uncontrollable. Whether it's due to our government laws and regulations not extending into other countries or because someone is checking out sights that are unregulated-Whatever! It doesn't matter. It's still to some extent, an uncontrollable creation. The possibilities are endless, for good and bad-so it's a logical statement/opinion. That's all. I feel that from a negative viewpoint, doesn't mean I don't see from positive points too. Why is it that initial responses need to be so aggressive and argumentive? Calm down people! more

Resolved Question: Don't you think Sheriff Joe?

Arpaio pulls police protection from Guadalupe JJ Hensley The Arizona Republic Apr. 18, 2008 06:00 PM Two weeks after Maricopa County Sheriff's deputies descended on the small town of Guadalupe, Sheriff Joe Arpaio announced that the department would no longer offer police protection in that community. Guadalupe officials have 180 days to secure a new law enforcement provider, Arpaio said Friday afternoon. After that, the dozen Sheriff's deputies who patrol the one-square mile town tucked between Tempe and Ahwatukee will be re-deployed to other areas, Arpaio said. advertisement Guadalupe Mayor Rebecca Jimenez said city officials had already started exploring other options for police in the community of 2,500 before Arpaio's announcement. "I am disappointed that Sheriff Arpaio chose to issue this letter of cancellation to the media immediately after delivering the letter to town officials," Jimenez said. "This is yet another attempt by Sheriff Arpaio to garner more media attention for himself and his office." But the battle between Arpaio and Jimenez has been played out in the media ever since Sheriff's deputies and posse members came to Guadalupe for a "crime suppression operation". Jimenez claimed the deputies arrived under false pretenses - stating the operation was to curb crime and graffiti activity when it was really to look for illegal immigrants and Jimenez confronted Arpaio about his presence there in front of TV cameras. The town pays Maricopa County about $1.2 million annually for the police protection, which the Sheriff's Office has provided for most of the last 30 years. Town residents complain about the lack of consistent law enforcement in Guadalupe, but Arpaio said the small city got the protection it paid for. Now, town officials will have to find a new force. Arpaio said the Sheriff's Office would continue to police the community until another law enforcement agency is found, and would stick around if the residents and town officials wanted the agency. But if the Sheriff's Office remains the only law enforcement agency in town, Arpaio vowed to continue his stepped-up efforts to root out illegal immigrants. "I'm sure they're not going to hire a guy like me to come in there and lock up illegals," Arpaio said. "This isn't personal. (Jimenez) just made the comment that she doesn't want us. If they don't want us, why should we stay there?" The throngs of protestors that greeted deputies in the recent immigration round up in Guadalupe, and the signs that dotted street corners imploring Arpaio to leave were ample proof that residents were ready for a new police forcebasically said "sc rew u Guadalupe" since the HISPANIC mayor didn't want them there? I hope they have major OUTBREAKS of crime in that town now!!"keith" you are WRONG, i am totally in SUPPORT OF Sheriff Joe! more

Resolved Question: Is this news article from Yahoo about illegals good news or bad news? Central America migrant flow to US slows

http://news.yahoo.com/s/ap/20080413/ap_on_re_la_am_ca/mexico_fewer_migrants By OLGA R. RODRIGUEZ, Associated Press Writer 2 hours, 59 minutes ago ARRIAGA, Mexico - For thousands of illegal immigrants from Central America, the long journey to the U.S. starts here, on the groaning back of a freight train they call The Beast. ADVERTISEMENT But these days many don't get too far. Central Americans without documents now face increased security within Mexico, including checks on the train for stowaways. It's also harder for them to head north once they cross into Mexico because of hurricane damage to the train tracks. The result: The number of non-Mexican migrants stopped by the U.S. Border Patrol has dropped almost 60 percent from 2005, despite increased detention efforts. About 68,000 non-Mexican migrants — mostly Central Americans — were detained last year, compared to 165,000 in 2005. Non-Mexicans make up about 10 percent of all migrants caught by Border Patrol officers. Mexico itself is also seeing fewer illegal immigrants — 120,000 were arrested last year, a 50 percent drop from 2005, when Hurricane Stan hit and destroyed the railroad, according to the National Immigration Institute. Since President Felipe Calderon took office two years ago, Mexico has added more soldiers and federal police on its border with Guatemala and more immigration and military checkpoints throughout the south. Despite its efforts to secure its own southern border, Mexico does not try to stop its own citizens from crossing north illegally into the United States, beyond pursuing drug and people smugglers. By law, Mexico notes, Mexicans can go wherever they want within the country, including the border. They don't break any laws until they are on U.S. soil. Many Mexicans are also sympathetic to illegal immigrants from Central America, but the issue still causes some tensions that echo the U.S. debate. Isaac Castillo, owner of the Hotel La Posada in Arriaga, argues that Central American immigrants often end up working in Mexico, where wages can be double the few dollars a day they might earn at home. "The problem isn't just in the U.S., but in Mexico, because a lot of Central Americans want to stay here and compete with Mexicans for jobs," he said. The crackdown on Central American migrants has left them searching for new routes. Some pay smugglers $7,000 to go by boat into southern Mexico, then hide in tractor-trailers heading north. These boats and trucks try to evade highway checkpoints set up every few miles alongside most of Mexico's southern roadways. But migrants have been crushed to death when false floors collapsed under the weight of freight, and 22 Salvadoran migrants drowned in an October shipwreck off the coast of southern Oaxaca state. For those Central American migrants unable or unwilling to risk the sea, a cargo train — The Beast — remains the only option for the 2,000-mile trip to the U.S. The long trek begins at the Suchiate river, on the border with Guatemala, where for $1 they cross on makeshift rafts into sweltering jungles. Then they hike along the destroyed, sun-scorched train tracks to Arriaga for up to nine days. Arriaga, 200 miles from the Guatemalan border, is the closest place to hop a train since Hurricane Stan destroyed the Chiapas-Mayab line. As they head north, they pay off thieves, immigration officials, police and railroad employees. Juan Gabriel Ramos, a Guatemalan 17-year-old trying to join his mother in California, said he bribed a Mexican federal police officer and an immigration agent before even making it to Arriaga. "They both told me that if I didn't give them money they would send me back to Guatemala," Ramos said. When they're caught, migrants say they're often abused by Mexican authorities. In one notorious case last year in the northern city of Saltillo, migrants complained to the National Human Rights Commission of rectal exams done by immigration officials who said they were checking for cholera. "The mistreatment of migrants here is brutal, and no one does anything about it because everyone sees them as booty," said Heyman Vasquez, a Roman Catholic priest. He estimated 80 percent of migrants are robbed before they arrive at his two-room shelter in Arriaga. The slowdown in immigrant traffic is notable in Arriaga, a town of corn and sorghum farmers. Only a few clusters of Central American men and women linger around the mostly abandoned, graffiti-covered train station, where they wait for the first train they can grab. Many stay at a local migrant shelter, watching television or sharing stories of abuse. Sitting on a cracked sidewalk outside the shelter, one Nicaraguan man told of the time he saw a group of criminals gang-rape a woman and shoot her boyfriend. A Honduran couple talked of fleeing their country after gang members killed their teenage daughter, and leaving their seven children, ages 18 to 1, in hiding. It doesn't get any easier once immigrants hop a train. They must often bribe private guards and police stationed along the tracks. Many stowaways are too tired to hold on to the train and fall, losing limbs. The trip itself can be deadly. Jorge Guevara, a 21-year-old Salvadoran, said he first rode the train to the U.S.-Mexico border in 2001 and saw 20 people crushed, and probably killed, when cars derailed. He fled and never found out what happened. "That accident left me in shock, but I kept going," Guevara said to a group of first-time migrants, listening intently. "One doesn't think about the danger, only about getting to the United States. Once I'm there, I'll think about it." Guevara said he drove a forklift in Dallas until he was pulled over for a burned-out taillight and deported last year. It took Milagros Rivera and her family a month to reach Ixtepec, just 85 miles north of Arriaga. By then, the 36-year-old from El Salvador said they had been robbed three times. The first time was at the river crossing into Mexico. Soldiers demanded money before allowing her, her boyfriend, her 20-year-old son and her 18-year-old daughter-in-law to continue on. About 50 miles later, gunmen held them up along the tracks, forced them to strip naked and took about $1,500 they had saved, Rivera said. "It was a terrible moment because they took my daughter-in-law away, and we thought they were going to rape her," said Rivera. The thieves ended up freeing the girl unharmed. But then they were robbed by a local police officer of the $40 they had collected begging on the streets. Rivera said she is bound for Virginia, where friends have promised to help her find work. "There is a lot of suffering," she said. "But the hope of reaching your destination helps you to keep going." more

Resolved Question: Don't you just feel safe under New Labour?

A retiring chief constable has attacked the Government's failure to prevent violent foreign criminals returning to Britain after being deported. Steve Pilkington, 56, who retires from Avon and Somerset Constabulary today, said he was fed up with having to arrest and convict the same offenders repeatedly because of lax border controls. "What really concerns me is the way we allow violent, dangerous criminals to just walk through our borders. advertisement"It has damaged our communities, damaged the prospects of our young people and it has destroyed lives, particularly through crack and cocaine." In an interview with the BBC's Points West in Bristol, Mr Pilkington, a police officer for 32 years, did not specify the nationality of offenders. However, it was understood his remarks referred to Jamaican drug dealers, who have been blamed for a rise in violent crimes, including shootings, in parts of Bristol. Similar violence, mostly linked to the crack cocaine trade, has been seen in London, Birmingham, Manchester, Nottingham and other cities, involving some Jamaican Yardie gangsters and British-born criminals linked to them. Of the 9,000 foreign nationals in jails in England and Wales at the end of September, about 2,000 were from Jamaica. The women's prison population is dominated by Jamaican "mules" - drugs couriers - but many men have also been convicted. The Home Office has deported criminals to Jamaica, where some have been released and returned to drug trafficking, travelling between Jamaica and Britain on false documents. Highly-addictive crack cocaine has increased street crime and violence between gangs dealing in it. Jamaica's gun culture has become entrenched in some inner cities. Mr Pilkington said: "Deported criminals returning to Britain is a failure of border control. It is a failure of intelligence and I think it is a failure of resourcing. "I am simply fed up with having to catch and convict the same people over and over again for similar offences. "Once they have entered our country, abused our laws and abused our hospitality and they are convicted and deported, that should be it. And they should not be able to get back into the country." In 2003, for an eight-week period, Mr Pilkington put armed police on the streets of Bristol for the first time, amid heightened tension between rival drugs gangs. Police blamed an influx of Jamaican drug dealers for an increase in violent crime in some areas of the city, including the St Pauls area more

Resolved Question: Are "Mystery Spots" False Advertisment?

Places like the "Mystery Spot" in California are all optical Illusions. There owners know this, yet it does not stop them from claiming that they where created by supernatural forces or something of that nature. Is this false advertising as fare as the law sees it? Or is there some kind of stipulation thats states that a tourist attraction can market something being something its not to help business? I don't know, it just seems like false advertisement to me.... Am I wrong? Thanks more

Resolved Question: Landlord / Tenant Law Question?

I rented an apartment that advertised central heat and air. I toured the facility in the summer when no heat was necessary therefore a reasonable person would have never picked up on the problems. There were no vents in ANY of the bathrooms, and therefore the bathrooms are not heated whatsoever. They are about on average 5 to 10 degrees colder than the rest of the house. I have an 8 month old daughter who has reynaud's syndrome and is affected by the cold, I cannot chill her. I am going to break the lease for the following reasons 1) false advertisement, and 2) breach of warranty of habitability. I do not want to pay a dime more on rent including any penalties for my inconvenience. What is your take on my situation? Thanks. more

Resolved Question: File a law suit against the manager store?

- we bought a hoodie today for 29.99 (original price is 49.99).. and the thing is its buy one get one 50% off ALL entire stock.. so we bought another one (the same one) for $20 ( its only 20 dollars coz it has a damage, so we bought it for a discount..).. so we ask them, why is the price still $20? (the price should be around 15 dollars..) $15 dollars because half of $29.99 is around 15, and subtract our "damage" discount from $15....then they told us that, " the 50% off will be deducted from the "original price".. yea, i know that, but in the advertisement in front of their store, it says, "buy one get one 50% off, discount will be deducted at the store".. -it doesnt say "buy one get one 50% off of the original price". the thing is, false advertisement maybe? and plus, we cant return them becuase in their policy, it says no refund.. anothing thing is that, if one hoodie is 29.99, and if you buy another one, its ""49.99"" subtract the 50% off.. i guess the store can't do that.. because, overall, they're saying that one hoodie is 29.99 and the other price of the SAME hoodie is 49.99 !! i think that it should be:: one hoodie = 29.99 and if you buy another one, its the 50% off of the price of the same previous hoodie ( which is 29.99)... if their pricing is wrong, can we return one of the hoodie, the one with NO damage? more

Resolved Question: NY Times vs. Sullivan?

Alright, I'm having a bit of trouble understanding this case—I get the essentials, per se, but I guess the wording combined with the lack of sleep is getting to my head..Can anyone help me break this down and digest it? Question Did Alabama's libel law, by not requiring Sullivan to prove that an advertisement personally harmed him and dismissing the same as untruthful due to factual errors, unconstitutionally infringe on the First Amendment's freedom of speech and freedom of press protections? Conclusion The Court held that the First Amendment protects the publication of all statements, even false ones, about the conduct of public officials except when statements are made with actual malice (with knowledge that they are false or in reckless disregard of their truth or falsity). Under this new standard, Sullivan's case collapsed. more

I am listed as a 13 year old on Yahoo email. I did this to prevent this sort of advertisements. So why is it so easy to send porn to children on the web. Does Yahoo. filter this, NO, Why. The ads come with many captions that may be to get children to click on the link. This is transmitting porn to children period. So where is the LAW to stop this.......
