Now Answers to Criminal Law Questions

Open Question: Why do so many cops look like Nazis?

I do not mean to say that cops are Nazis (though quite a few of them appear to be aspiring to that characterization). It's just that most of the ones I see sport the jack-booted crew cut look. My suspicion: the desire to be an officer of the law is very similar to the motivation behind joining the SS. A love of one's own authoritarianism often plays a significant role in such decisions. I suppose that this question isn't subtle; nor is my disdain for agents of the criminal machine known as the State. Call me a "radical" and an "anarchist" -- I won't deny those things.Banging My Head Against The Wall: Keep banging it -- maybe it will knock some sense into you. I have never been stopped by the cops for smoking a joint on the sidewalk. Nor am I claiming that cops ARE Nazis. I am only saying that many of them have an authoritarian mindset. Somebody else pointed out that a lot of them served in the military -- that doesn't help the situation. Obedience to authority is often portrayed as a virtue in our society. I disagree with that. Allegiance to reason is a far superior virtue. Many cops are incompetent and irrational. They are tax-feeders who meddle too much in other people's affairs; they don't have to please anyone but their higher-ups. We'd probably be a lot better off with private police forces. more

Open Question: I really need some help answering these questions before I dig myself into a deep hole.?

I was a Bank Of America employee and my official last day of work was 4/30/2010. I called in sick for three days and no call no show that thursday and finally made up my mind and quit on 5/7/2010. I had 67 hours of vacation time and 37 hours of time worked along with 2 hours overtime. I was told on tuesday when I called about my final paycheck that I was out of their system yet and my check wasn't ready. In the back of my mind I knew the California law was three days max no matter what. Also on that call I was told I was getting paid next Friday along with everyone else through direct deposit and no vacation was being honored and no overtime was being honored because I called in sick and used those hours up. So on 5/13/2010 6 full days after I quit I get a paycheck direct deposited for hours and amount I didn't agree with. I called and spoke to bofa's legal counsel and was told I get what I get and that's it. So I opened a case with the labor board but now on 6/5/2010 a full month later after I waited I get another direct deposit for on the paycheck stub says 17 hours of vacation time. Now mind you I haven't had insurance but yet that was taken out and so was other things like my 401k that I already cashed and closed out. I am beyond frustrated the whole reason I left was because they wanted me to lie to the customers who were in the process of loosing their homes already and that isn't right. So I feel like my rights as a employee was thrashed and I feel like I was really mistreated. I want to take these people to court because they are criminals who hide behind the banking name. Do I have a case here as far as collecting 100k for the abuse and lost wages and other things mentioned? more

Open Question: Will La Raza Holder Janet Obama file a major lawsuit the charge racial profiling?

Law enforcement officials apprehended a once-deported criminal who had a warrant for his arrest after the man led authorities on a foot pursuit beginning at Hesperia Lake, San Bernardino County Sheriff’s Hesperia station officials said. Jerry Mirrle Corriea, 27, gave California Highway Patrol officers and Hesperia deputies a false name when he was caught after leading authorities on a foot pursuit Sunday afternoon. A check of records later determined Corriea was an armed-and-dangerous parolee who was wanted out of Redding, Sgt. Colleen Kuhn said. CHP officers patrolling the area near the lake spotted Corriea’s vehicle and tried to pull him over for a vehicle code violation. Corriea jumped out of his vehicle and ran from authorities. Sheriff’s helicopter, 40-King, was called in to help search for the man from the air and eventually Hesperia station Deputy Jason Schroeder was called in to assist as well. Schroeder was able to locate and detain Corriea a short distance away on Damien Street, authorities reported. Officials did find marijuana in his possession but dug deeper to try to figure out why he would run, Kuhn said. Authorities were able to find his true identity and learned he was wanted out of Redding but what he was originally wanted for was unavailable. They also learned Corriea had been previously deported and illegally reentered the country. Corriea was arrested on a no bail warrant, for giving false information and for possession of a controlled substance. He was booked into Victor Valley Jail. http://www.hesperiastar.com/news/arrest-3440-pursuit-foot.html Obama did say it is illegal to ask an illegal to have an ID and doing so is a misguided law and results in civils rights violations , will all team up to sue the San Bernardino County Sheriff’s for asking him for an ID ? more

Open Question: What do you think Mexico feeling the impact of Exodus of Illegal Aliens from US?

It’s a fact, the SB 1070 law will be a true nightmare for Sonora. To the Sonoran immigrants who will return for obvious reasons, we must add the thousands and thousands of Mexicans who will cross the border daily to enter our country to avoid being jailed. I hope that the Federation and the State foresee this, because cities like Nogales are already suffering. The problem is not that they cross for a few days; the problem is that they stay; the problem is the unemployment that we have and that we see mounting in that area; the problem is the violence and the risk that many of those unemployed and desperate Mexicans will join the ranks of organized crime which, as we well know, has taken a liking to Nogales. From this arises the urgency of a true strategy in which the Federation might contemplate helping all those people so that they return to their places of origin and avoid this nightmare in the border areas of Sonora. The Arizona authorities in the past few days have toughened their campaign to find and deport undocumenteds. In Nogales, there are days when up to 1,200 men and women are deported and the disputed law has not yet even been applied. Can one imagine when that happens? This means it is urgent that the concerns become actions and for the implementation of a regulated plan. Then, how it appears, neither the “lovely” speeches by Felipe Calderon nor the good intentions of Barack Obama will be able to counteract this enormous problem. Unemployment is the darkest shadow our country will have in the coming months and Sonora will suffer before the others. Because of this, Guillermo Padres [Governor of Sonora] will have much work to do in Mexico City; he has to knock on many doors to avoid our border from becoming an uninhabitable zone. There is not the slightest doubt that Sonora will be one of the most vulnerable states. If living in Nogales is a risk now, just imagine what it will be with thousands of Mexicans who, day after day, return … It goes without saying, our state finds itself between a rock and a hard place, or better said, between a rock and the border.http://tucsoncitizen.com/the-cholla-jumps/2010/06/01/mexico-feeling-the-impact-of-exodus-of-illegal-aliens-from-us/ The Mexicans can’t even get it together to gather transportation to stem this problem at the border? They have a lawless Nation and they want to bring the US down to their level. They express concern that the peasants coming home might join gangs if they don’t have jobs...what do the Presidents of Mexico (on both sides of the border) think these invaders are doing here in the US when they don’t have jobs? We are being swamped with third world gangs and criminals."Maybe Calderone will take it upon himself to build the fence!"?? more

Open Question: I took up for this girl I like and ended up getting arrested?

I've always had a huge crush on this girl since grade school I'm 21 now. We used to play together and stuff and be friends. Her dad died a year ago and she's been depressed. She's dated this prick for over 2 years and I hate this guy he's a big egomaniac drunk bully. I always hear him yelling because he has moved into her house with her and her mom and screaming at her and her mom he bullies women. Last week he was real drunk on the porch slapping her and spitting on her demeaning her. I got real angry and went out and told him he better quit and he just kept doing it saying what you going to do? I went into their yard and I was like dude quit and he spit on me and said what are you gonna do i'll **** your mother. I ran up his porch and grabbed him by his throat and he tripped and we ended up going through the glass screen door. I started choking him but he grabbed a metal candle holder inside the house off the ground and started beating me in the head with it repeatedly til I was bleeding really bad from my face. I ended up leaving I was hurt. I went home and 10 minutes later cops show up saying itresspassed, assaulted, and broke into their house and I'm being arrested and I told the cops what happened and that he was assaulting her and hit me with a weapon and they said son it doesnt matter if you were right or wrong you broke the law. I have a criminal record and can't have any contact with either of them and I know she has nothing to do with all this it's all him. What do I do I want to help her I know she needs help but if I talk to her o I go to jail and if he finds out he'll call? Open Question: Why are Latino Leaders urging Obama to stop all immigration laws why do they also want criminals roaming free?

(Phoenix, AZ, June 2, 2010) The National Latino Congreso (NLC) held on May 31, 2010 an Emergency National Latino Summit on Immigrant Justice (“Latino Summit”) in the Gila River Indian Reservation located within Arizona. The Latino Summit reached agreement on a multi-level strategy for achieving just and practical immigration reform, beginning immediately with participants agreeing to call on Representatives and Senators to undertake the following actions: Latino Summit participants also agreed to an accountability plan that intends to organize turnout among pro immigrant Latino voters for November 2010. "Dubbed “Pledge to Vote Pro-Immigrant”, the effort will educate up to one million voters on how to be informed about the immigration policy views and records of candidates for federal office." Regarding the White House, the Latino Summit called upon President Obama to instruct DOJ to immediately challenge SB1070, and DHS to issue a guidance that the Agency will not cooperate with the implementation of Arizona’s SB1070. SB1070 is being challenged legally for unconstitutionally criminalizing immigrants and on other grounds. The Latino Summit also called on Mr. Obama to use his executive authority to declare a moratorium on deportations, end separation of families, stop deportation of youth who would be eligible for relief under the DREAM Act, terminate or suspend 287(g) and the Secure Community program, and end militarization of the U.S. Mexico border. http://latinocongreso.org/news.php?id=135 more

Open Question: Marijuana Survey (edited for easy reading)?

For those with ADD and other issues with doing research, I'm listing a much easier reference in a simply image : http://tokerville.com/images/history-of-cannabis.jpg This time line image takes 2 minutes to read and brings those that have been lied to for years up to date on the actual facts behind the law on Marijuana. For those that want more details read the research sources listed below. The resources are from Government, University and Medical sources and are all reputable. (Please inform yourself through the reputable resources from our own government, medical research and major universities such as Harvard before making your comment. The survey: 1. Do you smoke (explain how much or if at all) 2. Do you want it legalized A new report from the National Organization for the Reform of Marijuana Laws (NORML) pegs the costs of marijuana law enforcement in the United States at $7.6 billion annually and finds that escalating marijuana arrests over the past two decades have failed to have any impact on marijuana use rates or other indicators chosen by drug enforcers to measure "success" in the war on drugs. What marijuana law enforcement has accomplished, the study found, is hundreds of thousands of arrests each year, with the burden of criminal sanctions borne disproportionately by the young and the non-white. Current marijuana polices, which rely heavily on criminal penalties, are "wholly ineffective at controlling the use and sale of marijuana," the study concluded. Open Question: Boyfriend thinking of joining the AF or Navy?

He's 19 at the moment, and I'm 16 (I understand that we're still young), but we do indeed love each other despite the age difference. I've always wanted to study criminal law, and my boyfriend is thinking of trying for the police, and if that doesn't work out as planned, he's thinking of joining the AF or Navy in two years. I want him to do what makes him happy, but he wants to take me into consideration with whilst choosing his career, even though I told him not to. We've been dating for two years now, and once again I know we're young but in the future, we do plan on getting married to each other. The bigger problem is, I don't like being alone for long periods of time. I'm used to having him around and I'm sure that I would get depressed while he wasn't around. I'd wait years and years for him, I'd always remain faithful. But, I've heard so many stories of spouses who have gone into the Navy, promised they would never find anyone else, and ended up doing so. I t trust him, but this is what scares me the most. I love him more than anything, and would sacrifice anything to be able to be with him. Is there anyway that he and I would be able to live with each other while he was in the AF or Navy? I know we have to be married for the AF, I'm not sure about the Navy, and I'd like some more information on this. He tells me that we will work out, and he tells me all these stories about these people where their relationships have worked out. I don't want to constantly have to move around though, I'd liek to be able to live with him, and get settled but I know this isn't possible. These are a few of my biggest worries: -He'll become a whole different person. I love him just the way he is now. He's perfect, I'm afraid he'll come back taking things a lot more serious. -I'm scared something may happen to him -I'm afraid he's going to find someone else while there after reading so many of these stories -I hate being alone for long periods of time, not having someone to stay at night. All answers are appreciated, thanks in advance. more

Open Question: Why would an illegal from Mexico only get 14 years for killing 19 people?

The last defendant to be sentenced in a botched illegal immigrant smuggling attempt that left 19 dead in south Texas was sentenced to 14 years in prison today. Octavio Torres-Ortega, 44, of San Luis Potosi, Mexico, was sentenced by U.S. District Judge Vanessa Gilmore in the case in which most died in a sweltering tractor-trailer left near Victoria in May 2003. Torres-Ortega is the last of 14 defendants in the case to be sentenced He was extradited from Mexico to Houston in 2007 and pleaded guilty in 2008 to one count of conspiracy. The sealed trailer that transported at least 74 illegal immigrants in May 2003 was described by prosecutors at one time as a “rolling chamber of death.” Passengers clawed holes in the walls and punched out tail lights to try to get enough air to survive as the temperature rose and the air thinned. The victims — from Mexico, Honduras, El Salvador and the Dominican Republic — died of asphyxiation, hyperthermia and dehydration. They included a 5-year-old boy and four teenagers. The smugglers charged fees ranging from $1,800 to $5,500, half to be paid up front. Torres-Ortega admitted a role in illegal crossings from Mexico into the United States and in arranging transportation to a Harlingen safe house. “The sentencing of Torres-Ortega — seven years after the tragic events that triggered an intensive international investigation and resulted in several jury trials — brings to a close the criminal case against those persons responsible for the single most deadly alien smuggling operation in the nation,” said U.S. Attorney José Angel Moreno in a written statement. “While the lives lost can never be regained, the unwavering commitment of the federal, state and local law enforcement agents and officers who investigated this case and the talents and undaunted perseverance of the trial team have seen justice served on their behalf.” Torres-Ortega's codefendant, truck driver Tyrone Williams, was the first person to face a possible death sentence under a 1994 federal smuggling law. Williams also was the only defendant for which prosecutors sought capital punishment. He is serving a life sentence. Other defendants have received up to 23 years in prison. One defendant was acquitted and charges against another were dropped. Federal officials said this was the single largest loss of life in a human smuggling operation. The case was investigated by ICE, the Victoria County Sheriff's Office, Victoria County Fire Department, Quail Creek Volunteer Fire Department, Texas Department of Public Safety and U. S. Border Patrol. http://www.chron.com/disp/story.mpl/metropolitan/7040730.html more

Open Question: Why would an American man complain?

Why would an American man complain? His US born daughter was taken to Bahrain with out her American fathers consent. This is a crime under US law, because US law only cares about fathers paternal rights, not children rights or welfare, is this fair yes or no? The American father still has visitation rights in Bahrain as long as he agrees to follow the laws of Bahrain and gives his daughter and her mother the same respect as a US diplomat gives a foreign head of state, and does not have to pay child support. He also cannot file criminal charged against the mother in US courts, if he wants to get visitation rights. The child is very happy living in Bahrain with her mother. Open Question: What kinds of jobs in international law are there?

Hello fellow sisters and brethren, I am a California lawyer; graduated in 2005 and have about 3.5 years of working experience in civil litigation (insurance defense and asbestos litigation). I grew up in several different countries (Hong Kong, Canada, USA) and have travelled extensively. I can speak almost fluent spanish, conversational french, cantonese, and a bit of german. I also have a deep interest in other cultures and I stay in touch with world events, history, and geography. I am not exactly sure about working for the ICC, ICJ, or other international criminal institutions. However, as with all people I am interested in something that will take advantage of the above described attributes that I have, with a decent if not handsome compensation. I am sorry if the question is somewhat vague, but if any of you can list 3 or more fields/or specializations in international law that could really help me in finding the career of my dreams. My question is not just limited to lawyers or members of the international legal community, but please provide some reference. Thank you! more

Open Question: Are the points of law in the Gaza Flotilla Raid very similar to the the Brothers to the Rescue shoot down inci?

In 1996 Cuba shot down two private airplanes in international airspace above the Florida Straights. Even though the planes had earlier been in Cuban airspace, the courts eventually found Cuba guilty of criminal acts because they had waited and shot the plains down in international airspace. Almost 200 million dollars was award to three families of the victims. The circumstances, and points of international law, would appear to be very similar in the Flotilla incident. If Israel had waited until the Flotilla was in Israeli waters, would it not have been a very different legal circumstances than their having seized the ship, killed passengers, and held foreign citizens and property hostage for several days after having taken their initial actions in international waters? more

Open Question: U.S. Immigration and Customs Enforcement says that they will not support racist Arizona Law?

Most are just desperate for honest work, I'm in opposition to this law not because it is a violation of human and civil rights alone ...It goes against all human dignity, against the principles of most Americans I know The governor abdicated her responsibility to protect the human rights of every individual in Arizona not just from those who dont look like her? They have no right to dictate to the federal authorities how to enforce federal law. Hell, to anyone with any semblence of intelligence and understanding of Constutitional law, it is clear that the state has not authority under the Constitution to pass any laws that touch upon illegal immigration. It is impossible to round up all undocumented aliens and remove them to their country of origin. It would be a profound waste of resources, to. Why not have the police arrest people who commit crimes? If they happen to be here without authority, then they get deported. Chasing down the law abiding undocumented is diverting resources from the effort to stem the tide of drugs pouring into the country; drugs drawn here by the insatiable appetite of Americans. Every law abiding undocumented alien that is hunted down by the police in Arizona means that somewhere else in that state a criminal, native born or illegal, is still free.I find it shocking that many didn't learn from the original flawed language law they supported that left egg on their faces when Arizona had to change the wording to try and make it legal after they passed it. It seems to me that everyone should think about it before they blindly support something they do not even know is legal...particularly because it impacts other Americans. the fact is the arizona law is illegal and the federal government is not going to be a party to an illegal law. By picking up the illegals taken by the arizona law It becomes your word against the government's, even when you know and insist that you're a U.S. citizen Your word doesn't always count, and the government doesn't always investigate fully lol But does this mean we Americans, citizens of the greatest country on earth, should treat this ILLEGAL like an unwanted dog and kick him out of the country? I think not. most of them was born here, just like me, and possibly you too. My ancestors are not native to this country, and many hear will have similar heritage. None of us are really "from" this country. But this country was created on immigration. It is our heritage. We are the great melting pot of the world. Maybe it's time we come back to that ideology. I'm not saying that we should let illegals flood the streets of America, or that we should simply let in any and all who want to become an American citizen. What I am saying is, maybe we should begin to let go of our irrational fears, and start treating people as they are, and as we would like to be treated ourselves. We all want to be loved right? We all know we have a border problem so it takes no brains to recognise something must be done. Some want a solution and they don't care if it is legal or not. The rest want a legal solution and are content to establish that it is legal before accepting a blue eye/green eye law that impacts other Americans. I am of the last group. No way I want to look as foolish as those who accepted Arizona's first flawed law. I am content to wait until the courts make the call rather than look like a confident There are hundred of stupid laws still on the books.. remeber this law In Arizona: It is illegal for men and women over the age of 18 to have less than one missing tooth visible when smiling There was a day when the law did not allow women to vote, allowed one human being toown another and when United States citizens of Japanese descent were rounded up and placed ininternment camps and None of those laws were right.. There is a big difference between controlling the nation's border and discriminating by skin color, and Arizona's refusal to distinguish between the two undermines this nation's constitutional commitment to fairness and equality. The measure Gov. Jan Brewer signed into law last week gives police in Arizona broad powers to stop and arrest anyone not carrying proof that they are legally in the United States. The law sanctions ethnic profiling, and it underscores the need for a reasonable national policy on immigration. What is done to the weakest in our society ought to be a measure of that society Such accusations confuse what is legal with what is moral. American history is filled with people who broke unjust laws and were morally justified in doing so. The American Revolution was fought by men and women who broke the laws of England and of King George III. Had they been arrested, they would have been hanged for treason to the Crown. If breaking the law makes one a criminal, then the Founding Fathers were all criminals. But no one still believes that todayIt may be illegal for people to seek freedom and opportunity in this country, but it isn’t immoral. I admire the courage of immigrants who leave all that is familiar to them, risking life and limb on stormy seas and deadly deserts, in order to move to a strange land where everything is unfamiliar and potentially hostile. Most of our ancestors moved for freedom and opportunity, and we are the beneficiaries. Thank God they weren’t arrested and sent packing, as were violators of the Chinese Exclusion Act. Indeed, we might wonder whether we could have mustered the same measure of courage if we had been in their shoes.Protests continue across the country to denounce Arizona’s controversial new anti-immigrant law, which allows police officers to stop and interrogate anyone they suspect is an undocumented immigrant. We go to Arizona to speak with Pima County Sheriff Clarence Dupnik, who calls the law "unconstitutional" and says he won’t enforce itAmericans are right to be frustrated, including folks along border states. But the answer isn’t to undermine fundamental principles that define us as a nation. We can’t start singling-out people because of who they look like or how they talk or how they dress. We can’t turn law-abiding American citizens and law-abiding immigrants into subjects of suspicion and abuse. We can’t divide the American people that way. That’s not the answer. That’s not who we are as the United States of Americathe law will lead to racial profiling against Latinos and anyone who might appear to be an immigrant.. and The constitution clearly states that only the Federal government shall create and enforce immigration laws which includes determining status of immigration. Arizona's law has usurped this power giving authority to police officers to determine immigration status and therefore it is unconstitutional.Read the words "including power over immigration". Read the words "No state can add to or take from the force and effect of such treaty or statute, for Article 6 of the Constitution" There is no question that Arizona's law has authorized police to determine immigration status which is adding to their power unconstitutionally more

Open Question: Russel Pearce, Jan Brewer, Joe Arpaio, Tea-Baggers, Ignorant People or Racist?

In response to attacks she's received from some members of the anti-SB 1070 crowd who have suggested that Arizona's controversial immigration law is similar to what went on in Nazi Germany. In response, Brewer is quoted as saying "knowing that my father died fighting the Nazi regime in Germany, that I lost him when I was 11 because of that ... and then to have them call me Hitler's daughter. It hurts. It's ugliness beyond anything I've ever experienced." But in reality, he died in California 10 years after the war ended, Jan's dad never even left U.S. soil during WWII. Most people who insult Mexico or look down on it do it out of ignorance because they don't know any better. It doesn't matter how much news they watch or how much they read on it, they will never know the true essence of Mexico until they experience it first hand. The current feeling's expressed by tea-baggers and the Arizona "show me your papers" law are due to fear (mostly brought by the hard economic times, or worse "racism") and ignorance. Attitudes based on fear and ignorance are a problem worldwide, actions based on them are worse. There are closed-minded people everywhere. People who have preconceptions that they feel comfortable with and refuse to listen to anyone who contradicts there ideas with facts. Mexico is more then just violence, drugs, and corruption. Mexico is always being shown as bad in the news, everyone sees the US/Mexico border and thinks that's how all of Mexico is, which is not just go further down past the border and you'll see a whole different perspective. Mexicans are amazing people, but sadly they are discriminated, not all Mexicans are the same, you cant blame everyone over something that someone did. Take into fact, that Americans treat Mexicans as aliens or a threat, really? If Mexicans were that then why haven't they attacked the US or done a terrorist crime, Americans should be more worried about others like the Middle East. you have NO idea of the statistics of illegals verses legals or citizens,. Legally entering muslims committed terrorist attacks on our land and against our "citizens AND illegal aliens". They went through the right channels and paid more than others applying to enter this country to expedite their visas. They even renewed 1 to 2 times within their time here. Go to your states statistics or the federal statistics on prisons on criminal activities for your state. They will even have them by race and sex. Less than 12% of all violent crimes in this country are committed by those of hispanic descent. The majority of that 12% are in those states that have a high concentration of hispanic residents, California, Arizona, and Texas. New Mexico and Nevada have a percentage equal to the national average. In my state and those along the area where I live we have less than 2% of prisoners are other than black or white. Those that have committed violent crimes as you have listed are in that 2%. Most of those of hispanic descent that are listed in the local and state data base, here, have been convicted of repeat offenses of driving with invalid license (which means expired and with the new law that was implemented of those that do not have legal status can not renew their licenses - dumbest law to me, as an insurance agent) or by habeaus corpus, or failure to appear because of a lesser charge or past minor violation. Ooooooh, they are just soooooo vicious? In other words, if you are trying to discredit all illegals by your false accusations, you need to make sure in the future you know what you are talking about and have the info to back it up, like myself. http://bjs.ojp.usdoj.gov/ http://bjs.ojp.usdoj.gov/index.cfm?ty=fun#262 http://www.dhs.gov/files/statistics/immigration.shtm http://www.dhs.gov/files/statistics/publications/yearbook.shtm Do your own search for your state by putting your states name in the space plus -crime statistics as well as doing a search for your states prison statistics. I know I will get a lot of thumbs down because none of you will actually look for the facts and would rather rule your decisions with fear and ignorance and try to get others to follow your lead. Hey, misery loves company and so does ignorance. That thought process is what has us in this predicament as we speak. You constantly talk a good talk but you, like thousands of other Americans, have only been to the border or tourist areas. You have no real idea how life is in Mexico, or Central, or South America. You base your statement on propaganda and what you see from the outside. We Americans say we don't care what other countries think of us, but secretly we do. Statements like many of those above about a group of people they have no idea about other than what they see or read on the media, which is what causes the distrust and misunderstandings. more

Open Question: What financial incentives does BP have not to stop the oil leak in the Gulf?

The oil spill is costing the company billions already. Attorney General Eric Holder had opened criminal and civil investigations into the spill and based on federal law BP could end up paying minimum fine of $1,000 per barrel of oil spilled. more

Open Question: Is OBAMA ABOVE THE LAW? CAN HE IGNORE U.S. CONSTITUTION?

Has anyone in the Obama administration read the AZ law? Remember it is based on federal law. Governor Jan Brewer’s office has put out a video to help called Arizona Sing-A-Long: Read Immigration Law! Illegal is as Illegal does. Is Morton stupid enough to be saying that if you do not like a law you do not have to follow it? Is the Obama administration justifying the breaking of federal immigration law to let criminals enter the U.S. and walk around your city? Obama appears to be “nullifying existing law” and Morton should be fired if he fails to enforce federal immigration law. Fox News reports that Sen. Jeff Sessions, R-AL said that, “If he (Morton) feels he cannot enforce the law, he shouldn’t have the job,” and “That makes him, in my view, not fulfilling the responsibilities of his office.” Sessions said the U.S. government has “systematically failed” to enforce federal immigration law and claimed Morton’s statement is an indication that federal officials do not plan on working with Arizona authorities regarding its controversial law as reported by Fox News. Fox News said Sessions continued, “They’re telegraphing to every ICE agency in America that they really don’t intend on cooperating with Arizona,”… “The federal government should step up and do it. It’s their responsibility.” The Obama, Holder, Janet Napolitano and other lawyers and politicians in the White House respond and: •Admit they have not read the 10 page Arizona Immigration Law (Select Here See AZ Governors Video) •Will not necessarily process illegal immigrants referred to them by Arizona authorities •Threaten to sue the State of Arizona •Race pander for Hispanic Votes Being in the U.S illegally is already a crime and checking ID’s is sensible? OF COURSE it is — but the federal government has FAILED in its duty to put a STOP to the illegal immigration INVASION at our southern border; so, the people of Arizona have “stepped up to the plate” and done it themselves! Even though this is a law that EVERY STATE IN AMERICA SHOULD PASS, Arizona is coming under attack by the forces we’ve fought so many times before: the pro-illegal immigration lobby. Now Obama and his White House are breaking the AZ law and are refusing to protect American communities. The Obama government is failing on border security. It’s time to FIGHT BACK — and we’ve got just the way to fight them! TELL EVERY SINGLE GOVERNOR AND MEMBER OF CONGRESS TO SUPPORT ARIZONA’S NEW LAW: SEND YOUR FAXES NOW! Simply put, the new Arizona law will make it a crime under State law to be in the country illegally. It would also require local police officers to question people about their immigration status if there is reason to suspect they are illegal immigrants. Other provisions of the bill allow lawsuits against government agencies that hinder enforcement of immigration laws, and make it illegal to hire illegal immigrants for day labor or knowingly transport them. As Gov. Brewer said when signing the law, this “protects every Arizona citizen,” and she said the state MUST act because the federal government has FAILED. “We in Arizona have been more than patient waiting for Washington to act,” Brewer said after signing the law. “But decades of inaction and misguided policy have created a dangerous and unacceptable situation.” EXACTLY. Arizona alone spends $3 billion a year to educate, medicate and incarcerate illegal aliens. But, as has happened with every other State facing this invasion, the federal government has done NOTHING to stop the flow of illegals from the south. Of course, the response from Barack Hussein Obama and his liberal cronies in Congress was exactly as expected: cries of “racism” and “profiling,” instead of listening to the voices of the American people DEMANDING they enforce the laws that are already on the books. In fact, numerous polls show a HUGE majority of public support for this new law, and many polls conducted over the last few years show that 81% of Americans believe that “local and state police should help federal authorities enforce laws against illegal immigration” — 81 percent! But despite all of this, supporters of illegal immigration are trying to REVERSE Arizona’s law, STOP Congress from enforcing existing laws, and PREVENT any other State from passing a law like Arizona’s — and that means WE have to take action NOW! more

Open Question: White collar criminal punishment is practical?

For a law debate, I must argue that the punishment for white collared criminals in Canada is fine. So the sentences they receive are already harsh enough. Does anyone have good reasons to support my opinion or any websites that would be useful in helping to defend my opinion? more

Resolved Question: Should Sharia be allowed in America?

It has already being implemented in British Islamic communities. Sharia, or Islamic law, influences the legal code in most Muslim countries. A movement to allow sharia to govern personal status law, a set of regulations that pertain to marriage, divorce, inheritance, and custody, is even expanding into the West. "There are so many varying interpretations of what sharia actually means that in some places it can be incorporated into political systems relatively easily," says Steven A. Cook, CFR senior fellow for Middle Eastern studies. Sharia's influence on both personal status law and criminal law is highly controversial, though. Some interpretations are used to justify cruel punishments such as amputation and stoning as well as unequal treatment of women in inheritance, dress, and independence. http://www.cfr.org/publication/8034/ http://www.omdurman.org/sharia.html http://www.timesonline.co.uk/tol/news/uk/crime/article4749183.ece more

Open Question: Why do Asian guys complain about supposed media portraying them as Nerdy, yet cite examples 15-50 yrs. ago?

When the Media portrays White men as idiots, need to be told what to do by wives (when they're married or in a steady relationship) can't dance (they're are a lot of White guys who can dance, more so than in the past but Gene Kelly and Fred Astaire were both white) or are child molesters (even though whites don't commit that out of proportion to other races) or murderers (law & order portrayed more white male murders in 1 season than in ALL year for the actual new york city) and cutthroats. Latino men are either gardners, old guys who can't speak english, young gangbangers or angry La Raza types. Black men get portrayed rather well: they're always shown as cool, or telling white men what to do in comercials. In TV they're often cops and almost never petty criminals. BUT in movies the black dude is always the good friend or good guy, or the loudmouthed sidekick. They're rarely the villain or murderer, a lot of black actors want to play the villain because that's usually the more interesting role. Asian guys are rarely seen, that's part of the problem. But they're often shown as having an attitude and telling off dumb white and black guys. So why are asian dudes bitching? They have tons of websites devoted to how much they hate white people, like goldsea.com asiafinest.com yellowworld.com, bitterasianman.com angryasianman.com fighting44s.com etc. Why would White girls want to date you if you're obsessed with white girls (but curiously don't whine when black guys date asian girls) and put tons of videos over YouTube.com of either asian guys kissing white girls or Asian guys bitching about White girls. Screw you hypocritical racists.@ Johns L I was a white minority in a mostly black area, and they didn't treat white people well. You're worried about how White people look at you in a restaurant? Try seeing white girls in your school getting their hair and clothes ripped out and stomped by a bunch of people. I saw that happen to a girl in my school, and attacks on students and teachers were common because they were white. But the thing is, black people don't seem nearly as preoccupied with talking trash as Asian guys. They have whole websites full of nothing but racist threads on non-Asians or white White girls won't date them (but nothing about black girls??) well it's because they're racist themselves.@Luis. Read the paragraph fool. I'm talking about scripted scenes where the Asian guy is the smart funny guy with an attitude and the white or black guy is just a dope. You see that quite a bit, an example of that is in knocked up or the new movie with jaden smith where the guys like "yo, I'm from Detroit" after the kid says something to him in Chinese. I've noticed Asian guys, even Asian immigrants copping that same attitude like they think that we'll take that kind of rudeness in real life. They quiet up real quick when they're told to stfu right back. more

Open Question: In UK law, how can you distinguish between battery and ABH?

I understand that ABH is any infliction of unlawful violence which causes minor harm to the victim, including bruising and wounding. However, I also here that if the harm is so trivial and insignificant it should be charged as battery under S.39 Criminal Justice Act (please, correct me if I'm wrong - this is for a law exam tomorrow). Where do you draw the line between ABH and battery cases?Yes sorry I meant in England and Wales more

Open Question: If Mehico is so great , why dont we copy and enforce some of their laws up here?

At a time when the Supreme Court and many politicians seek to bring American law in line with foreign legal norms, it’s noteworthy that nobody has argued that the U.S. look at how Mexico deals with immigration and what it might teach us about how best to solve our illegal immigration problem. Mexico has a single, streamlined law that ensures that foreign visitors and immigrants are: in the country legally; have the means to sustain themselves economically; not destined to be burdens on society; of economic and social benefit to society; of good character and have no criminal records; and contributors to the general well-being of the nation. The law also ensures that: immigration authorities have a record of each foreign visitor; foreign visitors do not violate their visa status; foreign visitors are banned from interfering in the country’s internal politics; foreign visitors who enter under false pretenses are imprisoned or deported; foreign visitors violating the terms of their entry are imprisoned or deported; those who aid in illegal immigration will be sent to prison.Lonewolf, I totally agree with you. Open Question: Advice on statements to law enforcement?

If I agreed to cooperate with local law enforcement and the local police brought in federal agents from burea of criminal apprehention as well as federal dea agents. During a initial interview if Miranda rights were read and intent of cooperating with them led you to answer questions about your own prior criminal involvement should I be concerned? I am worried that the Feds wanted me bad enough to indict me for distribution of methanphatamines. By cooperating with them in answering their questions truthfully agreeing to do controlled buy for them on very large ammount of narcotics and even agreeing to testify for them in court if need be at one point witness protection and relocation was mentioned but at the end of that recorded interview the agent made sure it was known that no promises were made about anything inexchange for my testimony. I asked the agent at a later time if I was making a statement that was going to end up admitting so much guilt about my own activities that they would later charge me he said he could not answer that question only the prosecutor could decide who would be charged. They have already got enough information from me that they could pursue the person I agreed to help them get. Now the Feds ae asking me to start out with a buy from someone local they have been trying real hard to get! At what point do I or can I demand in writing immunity and acceptance in the witness protection program for the information provided and also have agreed to testify and would keep my word and be willing to fully cooperate is it likely that if I do cooperate that they will provide me with immunity and witness protection? At what point would a person be granted this? After a controlled buy occurs there is always a chance of the person who did the buys identity being exposed would that be the point when a person is relocated or do they wait till after the court trials? more

Open Question: Should I be a doctor or a lawyer or something completely different?

Hi, I'm yr9 (14) and I'm thinking about what I want to do when I'm older, and am really keen on medicine and law, but I can't really come to a conculsion. (for my gcse's i've done triple science, 2 languages and other academic subjects to keep my options open so I should be alright for both for now) Ever since I was young I've been fascinated with the human body, and I really love biology in school, and learning about diseases and doing dissections. But I'm worried that I'd just be overworked, have little time for family, and just generally have to work long and unsocial hours thoughout my career. Also, although I accept that death is just another part of life, I'm not sure how I'd react if a patient did die even if I wasn't attached to them - sad situations just make me sad. Do you think I'd get over this? I've also always liked the idea of being a lawyer, mainly criminal law, but recently, corporate/commercial law has caught my eye, and the notion of hunting through small print looking for loop holes, forming arguments and stuff like that seems quite fun actually. I'm really good at english, and the hours seem to be better than that of a doctors, but I don't know if it would just get boring after a while, and I really want a job where I'm always learning, but I don't know if law would give me that. Also, I hear that there just aren't enough jobs. So what do you think sounds better for me after reading this. Ideally, I want a job where I'm always learning, and that's mentally stimulating, and medicine perfectly fits the bill for this (correct me if I'm wrong), but I wouldn't want to be a gp, I'd prefer a hospital environment as a physician so I'd be on call and everything and I don't know if that would take it's toll. So any personal experience or advice would be really really helpful. Also, other science-y type things have caught my eye, like marine biology and to some extent toxicology but I'm not so sure on these. Any experience with these too would be really helpful Thanks :)I'm 14 years old, in year 9 in the uk more

Open Question: Why do police patrol cars ride around with their lights flashing?

It's not just the marked cars. I just saw an unmarked car, with a retractable light, riding around with its light flashing. What's the point here? Giving a heads up to criminals. "Oh, there comes a patrol car, I should hide until it goes by." I can almost accept the idiotic nature of the regular patrol cars doing this, as they consider themselves to be somehow inducing citizens to follow the law. But a friggin' UNMARKED patrol doing that? What's the point?NOTE: The police have the OBLIGATION to catch criminals in the act of their crimes. They are NOT obligated to inform criminals of their presence. BAD, BAD answer!!!!Potatoetomatoe, the above response was directed at you. Yeah, police and emergency vehicles need the right of way at times. But what's the point of advertising yourself, AT TOTALLY UNNECESSARY TIMES, to criminals you want to catch?????Plenty of nothing.... they should be trying to identify wrong-doings, not notifying of their presence. Law ENFORCEMENT not law notification to keep you from being caught.Plenty of nothing.... All they are doing is TELLING the criminals that they are coming. Be real!!!!Note to Dumb Blonde.... Yes, I am talking about Japanese police cars. Anybody ever tell you that your screen name fits? more

Open Question: I am offended by my sister-in-law's e-mail, how should I respond to it? (see detail)?

She left this in my inbox. How can someone be this ignorant? This is for everyone to know, I've have had enough! For those who are overly sensitive, and get butt hurt easily, I suggest you grab a box of tissues. I will no longer apologize for myself or my husband. I am sick in tired trying to be politically correct, and worried if someone has been offended. God Bless this Nation 1. I am a proud American and Support our military to the fullest, and I love this country. If you are Anti-American, Get the hell out of this country. If you do not support the troops as they give all of us American’s the freedom we have today, than you should not have the right for anything. It is the veterans who gave their lives so you can live in this country with all of the benefits you have. Remember the troops and the sacrifices that they have made for you this Memorial Day. Religion 2. I believe in God, and I pray all the time. I still have the same old bible a dear friend had given to me years ago. I do not feel that I have to go to church in order for God to hear me and to walk thru the gates of heaven. I don't like the uncomfortable feeling of walking on my tippy toes when around religious people trying to recruit me. There is a church on almost every corner. If I want to go, I will go. I feel that I am a good person and I try to do right for others and follow the Ten Commandments. I shouldn't be looked down upon if I want to drink or to gamble. Gays, Fags, Rainbows, etc. 3. I can care less what people decide to do behind closed doors. But leave it there. I can't stand the ones who are flamboyant and want to be seen, heard, and must be noticed. Why do they change their voices? That's not necessary, I at times use the phrase "That’s Gay" or "What a Fag" is it right? No probably not. Am I offending someone? Most likely. Race 4. Am I a racist? No, but I am prejudice, there is a difference. I have no patience for the ghetto. There are a lot of people who use the word Nigger including myself from time to time. Does that make me a racist? If I say things like Beaner, Spic, Chink, Eggroll, Hick or Cracker, those are hated and racist remarks. If I use a word against a race, it’s for a reason! Is it a good reason? Could I choose a better word? Yes probably, but I choose to use the word, I feel fits best for what I’m pointing out. For the record, I am part Spanish. I will be damned to think its okay for illegal immigrants to come here and ruin our country and suck the tit dry. Politics 5. Guess what everyone? I'm a Proud Republican. I believe in the law, and if you commit a crime, you shall pay the time. I believe we should be tougher on punishment. We should have fewer rights for criminals, and more rights for the victims. I believe in the second amendment! Break into my house and allow me to show you what a bullet feels like in between the eyes. I believe if you want something, you should work for it. I believe in less government, they need to keep out of our health care, automotive, and small businesses, in this nation and stick to government business. This doesn't mean I believe in every subject. I have mixed feelings about abortions. I feel it should be the women’s choice. No one should have the right over your body, but that doesn’t mean use it as a birth control method. I did not vote for Barack Hussein Obama, and I won’t support him. He is a disgrace to our nation. Anyone who voted for change because he is black is a racist. You should vote on what a person stands for not color. I will have to cut my politics short being that I can write a book. Conclusion 6. The next time you feel offended, grow some balls and let the person know that you are offended. Don’t keep your tail between your legs and say something when you have an issue. So any misunderstandings can be cleared up. more

I am looking for some SERIOUS answers. If you don't know much about the Canadian politcal parties please do not bother answering. These are my PERSONAL beliefs and opinions: I am not attempting to spark a debate or offend anybody so if you do not agree with anything I say I am sorry but these are just my opinions. I know this is a really long post, but any help would be much appreciated. Healthcare: I believe that the healthcare system should remain public and that the federal government should set standards for all provinces to follow. Everyone has a right to healthcare and deserves the same treatment regardless of their financial situation. It may limit the amount of money doctors are able to make, but they make enough of it as it is. Guns/Gun Control: I believe that the government should enforce a mandatory gun registry. I personally don’t see why anyone would need a gun unless they use it for hunting (which I am strongly against), but in any case some people may legitimately need them for protection. There are people that misuse them and therefore the government should strictly enforce the gun registry. I also think people with a criminal record should most definitely not be allowed to bear arms even if it is for their own security/protection. Immigration: I believe that the system should remain as it is (there should not be tougher standards put in place to restrict entry). Canada needs immigrants right now considering the huge, aging baby boom population. Environment: I believe the environment is very important and the government should be doing more to protect it (look into alternative energy, public transit, going green etc.). Homosexuality: I believe 100% that if people are homosexual and want to get married it is their choice and they should have to right to do so and receive spousal benefits. I am, however, on the fence with whether they should be allowed to adopt children. I understand that they could be more loving and caring than straight parents and I am definitely not doubting their ability to raise children, but I just don’t know if it would be best for a child to grow up in that type of environment. On the other hand, I don’t see how it could be much different from a single parent and it would most definitely be better than having a child live on the street or in a bad orphanage. So I guess I am okay with them adopting (a bit hesitant though, not really 100%). Abortion: I am 100% pro-choice on abortion. I think more should be done to prevent unwanted pregnancies and I do agree with people who think it is wrong for someone to carelessly have unprotected sex and then get an abortion. On the other hand, there are many situations where women NEED to get abortions. Many times their lives could be at risk and they could die during childbirth, they could have been raped or they could just not be at a place in their lives where they are capable of raising children. I would rather people had abortions than children grew up in absolute poverty, without parents, without a father, in a home where they were unwanted to begin with, living a poor quality of life etc. Education: I 100% do not believe that religious schools (including catholic schools) should be funded. All schools should be public HOWEVER the school could offer courses or evening/weekend programs in different languages/cultures/religions. I also think that Canada needs to have some sort of national board exam (SAT type of thing). It is ridiculous that university admissions are based on marks alone when teachers who teach the same course vary greatly in easiness/toughness of the course and exam and giving out marks etc. Crime/Law: I am 100% against the death penalty and I also think that penalties for youth/children should not be THAT harsh unless the crime committed was especially horrendous/heinous. I am 100% pro-science and support stem-cell research as well as research on cloning. I think that marijuana should be legalized and taxed. And that there should be an age limit (just like alcohol). Although I DO NOT support its use, people do it anyway and legalizing it may reduce its appeal for teenagers. Also, I don’t understand why alcohol and smoking is legal while marijuana isn’t. What’s the difference? I am not really 100% on this though. I am not very religious and I believe religion has NO PLACE whatsoever in government/anything public I believe in freedom of press/media and no censorship whatsoever I do not believe in welfare/food stamps/whatever else. I do not think that it is fair for people to rely on these systems while others have to work hard and pay taxes to support them. These people need to get jobs! I do not know m more

Open Question: What are some good search terms for and/or good places to look for government jobs....?

I have been busy looking for jobs in the criminal justice system for jobs in like law enforcement, the courts or in the background like being a criminal analysis and stuff like that. Though jobs i can live on independently and self sufficiently etc. On sites like indeed.com or monster.com etc., you have to enter search terms to look for job listings. But I have been focusing mainly on the background stuff like criminal analysis stuff in which I can move upwards. I always use search terms like security officers, police officers, crime analysis, and the like. What are other search terms to get such jobs that I have been looking at that I just described? Plus, I usually look at USAJOBS.gov, indeed.com, monster.com, and careerbuilders.com? Are there any other places I can be looking (other than the classifieds) online and what are some good search terms. more
