My parents recently handed in their notice to vacate the apartment they are in and have paid the last months rent. the place is a mess at the moment and my mother has told the real estate that on this date they can have as many inspections as they like (the date is 2 weeks prior to their Expiry date to vacate and they are month to month) The realesate agreed to this but obviously wasn't communicated to another agent who put an inspection for that weekend, 4 days before the date my mother said they could do an inspection, and the lady was extremely rude, saying it is their procedures basicallt trying to intimidate my mother as she screwed up by advertising the inspection. Now I don't think they have the right to force inspections on your property when it is still legal yours as you have paid the rent for that period, am I right???

I am seriously considering becoming a real estate agent. I have wanted to be a realtor and own a real estate investment company since I was 12. But I have a couple of basic questions I would love to have an answer too. You have to be 18 to get your license right? But can I start studying for it before then? (I am 17, 18 in March) How long does it take? Is it like a year long process or a couple months, weeks, what? Where is a good online place to take these courses?
The BIG question is that I live in Iowa right now, but I really want to be in California doing real estate (and don't say "oh, you really should do it in Iowa, a place where you're familiar" because I will never stay in Iowa. haha) I know its hard to build a customer base but I don't have any other option. So back to the question at hand, can I live in Iowa and get my license and then move to California a little later on? (for example, get the license in the Spring and move late Summer early fall) or do I have to live in Cali for this whole process?
Do you have any suggestions on what I should take for college courses? Right now for the fall semester I am taking Selling, Principals of Advertising, Principals or Marketing, and Digital Photography. I was just taking classes that I thought I would enjoy and that may be beneficial.
Any other info you have please feel welcome to share! I know the market is not the best but LA is really where I want to be and Real Estate is what I love so I figured I should go for it, I really have nothing to lose and everything to gain.

Hi Everyone... I am in my forties.. and self supporting. Lost my job ..and was approved for a training program to acquire necessary skills. However..the program I chose was Property Management. I did not at the time know.. or was even told all it entails.. which means to be on call.. break ins.. and a desk one said filled with paperwork.. responsible it all. I am not .. computer savvy.. only my home PC. I have attended a computer class that was like latin to me. Its not my nitch. But.. goes with the job. The instructor said she has more jobs/connections then students to fill them. But..there is no computer classes in this program that will take me a year to complete then I would have to take additional non credit computer classes.. and I have to pay for my books. This will all take me about 1.5 to complete. She got me with.. the fact she pretty much guaranteed me a job. There is also an internship. She said I would get only salary . She is the instructor and an Attorney. She would know. She said I would start out at 30 a year.. which has been my goal that I have never yet reached and to me that is a reasonable goal. The problem is.. although I am self supporting.. I am caring for my mom whom has cancer. I am more concerned with finding work right now. I am juggling a lot alone. I am not sure.. if this is the right path for me to be honest.. I know they are paying... and she guaranteed me work. I will also be able to sit for my Real Estate and Broker License. I am not sure if I am being intimidated by all my fears.. Or.. if they are very real.. and it will hit me like a ton of bricks crashing on me. Especially the computer learning for the job. I understand I can be a broker from home.. I am to be honest more interested in traveling to sell vacation rentals.. but.. that can also get old fast and be hectic. I am a home body.
So.. I thought of two alternatives..Or back up choices.. Paralegal.. which law is to me interesting especially environmental.. Patent and Immigration Law. I could also be a Real Estate Paralegal. Attorney's I do know Pay you a lot and it is also Salary. I know a legal secretary making well over 60 a year. But Attorneys aren't cheap but can be jerks I hear to work with. I would I am sure.. learn computers and West Law in that program.. but I would have to go to Globe or one of those real expensive schools .. Or. to the County College for an associate.. but that would take me 2-4 years longer.. So.. you pay double or triple for a faster program to get out and working. I think they call it legal assistant. Or... the other choice which was my first one.. originally was to get my cosmetology license. I can go at night.. and get some kind of part time job days.. whilst taking my mother for her treatments. Days would require full days and I have to be available for my mother. The Property Management Program was two nights a week .. then when they are done .. its two days.. a week.. and one on line.. Then back to two night .. two classes only at a time. But.. its doable around my schedule for my mother.. BUT .. just because I was approved and they are paying .. I don't want to have to feel I should or am meant to do this. I am not sure if I can go get a brokers license here separate somewhere else or not. I just wanted to achieve a salary of 30 or so a year. But the Cosmetology unless I go at night does not seem that doable days. But I can go at night if I had to. It may take over a year to complete. Its more creative. They probably make 30 a year with tips.. and I seen many jobs advertised including where I live.. and manager jobs for salons and spas and you can do nails etc. There are many avenues that can bring in money. I like moving around .. more then sitting all day. I am just afraid to mess someones hair up lol.. But.. I suppose that is what they teach you. It seems like the most fun job out of them all. Please Help.. I am creative and artistic.. love make up.. but my age is a factor for employment .. although I must be well preserved because this young girl told me to go for it.. and convinced me to do that originally.. before everyone told me I can't count on commission and tips. My head is spinning. If ... I had a second income .. it wouldn't be such a major decision .. but I don't. I also don't want to go through .. all the other training to hate being a Property Manager. I just think a man would be better at this.. because if there are fights.. or plumbing issues or break ins..

She wants me to help her find potential buyers, and would like to pay me a finder's fee or commission, in the event that I have introduced her to the person who ends up buying her house.
I am not a licensed real estate broker or agent, and I do not want to run afoul of real estate broker/salesperson licensing laws.
How can I legally do this?
Some possible ideas that come to mind include:
1 - what if I am her employee - can I then receive a commission on the sale of the property?
2 - (how) can I set up a company, partnership, corporation or LLC which would receive a commission without having an officer or employee of the company being a licensed broker?
3 - (how) can I receive a commission on the sale of a property for performing other work, for example, by providing advertising, printing, web development, building rennovation/contracting or similar services, without being a licensed broker?
4 - apparently in the State of California it may be legal for the seller to pay a "finder's fee" commission to someone who helps locate the buyer - do other states allow this? What do you have to do to avoid crossing the line into territory that is reserved for licensed brokers and agents only?
5 - is there any other way that I can receive a commission from the seller of a FSBO (for sale by owner) property without being a licensed broker or real estate agent?More info:

does not seem to be correct, because Maine statute Title 32, section 13002, "Exceptions" states that "real estate brokerage does not include the following: 1. Transactions by owner or lessor. Transactions conducted by any person who is the owner or lessor of the real estate, or to their regular employees with regard to the employer's real estate, provided that:
A. The real estate transaction services rendered by the employee are performed as an incident to the usual duties performed for the employer; ...
So that would seem to permit me to accept a commission for assisting in the sale of her real estate as long as I am her employee and primarily perform some non-real-estate related work for her.

I have my house listed with a Realty Firm for sale. I have it listed for about 80 days and so far no buyers. The economy is tough and we have actually decided that we will rent it to a couple that we know for the next couple of years and hopefully, ride out the storm a bit. Is there normally a time period that you have to wait until after the expiration of the contact that applies if you decide to rent it instead of sell it? Minimum wage in ill is 7.50. Be reasonable to make sure your store makes a profit. due to Fica and unemployment the true cost for a business is higher.
Step 4: Insurance costs money. Telephone, electricty and water do too. Business pay for garbage collection too. You may want to advertise your business or itemize a list of additional costs for your business.
Step 5: Write a recenure and cost equations using a variable to represent the number of items that your business sells. The time frame of these equations could be daily, weekly, monthly, or annually. For the purpose of this project use a weekly time frane.
Your revenue cost is based on the selling price and the number of products you sold. the cost equation is more complicated. Part is variable and is based on the wholesale cost of the product your selling and the unknown number of items sold. The other is fixed and is the sum total of costs listedn in parts 2,3, and 4.
Write your equations in function notation. so revenue should be written as R(x) = linear something. Cost should be C(x) = linear something. amounts can be rounded to the nearest dollar.
Part 6. You need to know ur limits. If your selling coffee your not going to sell a million cups ina week. Of course the lowers you can sell a week is 0 items. For the Maximum number pick a value which makes sense. the number should allow the business to make a profit. Now take your maximum number sold and dirive it by 5. This will be
the step increment that you will use in finding points for each equation. Starting with the variable = 0 and increasing by the increement you will find 6 points for the revenue and cost equations.
Example if 100 is the maximum sellable in a day the increment will be 20. So you will use the values 0,20,40,50,80 and 100 and substitue them into each equation.
Also solve for the break even point for the business. Let y be the fuction value for each equation and solve each equation simultaneously. You don't need to show all the work for the project but just the important steps. Example: the set up and solution for each should be given. List all these values in a table for each equation. Each equation should have 6 or 7 points
Part 7. Using a graphing utility like excel or by hand on graph paper, graph the table of points which you found in part 6. Graph both tables on the same graph using a different color. Clearly mark the axes and your scale.
Pat 8 The project is to be typed. Calculations do not need to be shown in the typed section but all setups and solutions should be clearly presented. a calculations page should be included at the end.There should be a final summary paragraph outlining your results. State your results and give a brief summary of what you learned during the project.

Ultimately I had to get a real estate company to rent it out for me anyhow, which cost me another months' rent. This was 2004, right when the rental market in our area plummeted (because, instead of renting, people were all buying homes with no downpayment and ARMs). Since then I've always used a real estate company.
What do other landlords do? First, I have been on unemployment for about 6 months. It looks as if it's about to run out soon, but I have taxes coming out of it (which I will change for the next check).
I opened an online business a month ago on Etsy and I only have two sales so far. I wanted to get my business license, but one of my friends told me to wait 6 months to see if I make a profit then get my license.
Recently, money has been tight and I applied for a PT job helping a real estate business with their advertising. My new boss signed me up as an independent contractor, where my taxes are not taken out. Would this new job conflict with my business/unemployment come tax time? Should I get an EIN? Should I get a business license?
I'm so lost about everything!

We recently purchased a forclosure "as is" without an inspection for a great price. It was advertised as having city water but when we went to get it turned on we ended up figuring out that it actually has a well!
Is there any type of action we can take considering the property was listed wrong and the real estate agent told us it had city water??It was listed as city water on the website and she verbally told us. It is outside of city limits but it is very common in our area to still have city water. The well is concealed and is not visible. We did have someone inspect it - they even remarked it must have had city water becuase they did not see a well. me and my father moved to peru indiana september 14th 2009 and we are currently renting. we have been looking at houses since january 23rd because we are tired of renting. we have run into a lot of shady deals. for example we put in an offer on a house that was on the market for 3 days. when we heard back from the real estate company they said that an "offer" was placed a day before we made an offer. turns out it was a back room deal and the real estate company literally threw away our offer to get double commission.
Now we have run into this problem. We decided to pay full price for a home that was 31,900. It said on the MLS sheet real big THIS HOME DOES QUALIFY FOR A HOMEPATH MORTGAGE 3% DOWN NO PMI.
so we thought great! not so much...they wouldnt give us the loan because the forclosure DOES NOT qualify for a homepath mortgage. you can only pay cash. we are tired of getting screwed around on back room deals and shady advertising. can we sue for false advertising since we put $1,000 earnest money down and are not even sure we can get that back. HELP

The general consensus seems to be that Regulation Z applies to real estate brokers (e.g. in Real Estate advertising they say if you put the monthly payment, you have to put the APR in order to comply with Regulation Z. See http://www.realtor.org/archives/doyouradssdenarchive1996dec).
But when I read Regulation Z, It states: "In general, this regulation applies to each individual or business that offers or extends credit...". (See: http://www.fdic.gov/regulations/laws/rules/6500-1400.html ).
Most real estate brokers don't offer or extend credit; they are not lenders/creditors. Why would the consensus be that "Regulation Z" applies to real estate brokers? I notice that Zillow.com shows monthly payments without showing the APR.

If it makes a difference...Our product is a private mortgage on pieces of single family real estate. We pay 8-10% Annual Returns with interest payments made monthly to the investor. The money is secured by a low loan to value note on a property. We have been doing this for 8 years and had phenomenal success.

I'm concerned that if I get a real estate agent to sell my house, he or she might just list it and put a sign up, then sit back and wait for buyers. Meanwhile, if I didn't list it with a real estate agent, I could do a lot more to sell it myself. I could advertise it in a lot of different places, and give a discount equal to the agent's fee. I could keep finding more and more places to advertise it. Etc. But if it's listed with an agent, I'm stuck with that agent. The agent might even turn out to be an obstacle. Some agents get tired of prospects who ask too many questions, etc. For example, I was recently communicating with a Century 21 agent about a house I might be interested in buying. But that agent got tired of my questions, and reached a point where she was no longer willing to even try to find out the answers. The question that seemed to be the last straw was how they determined the asking price. She said they used a CMA and it was also appraised a few years ago. So I asked if I could see a copy of the appraisal. That seemed to make her angry or something, and from then on she seemed to be no longer interested in communicating with me, and I never did see the appraisal.
If I get an agent to sell my house, I would want one who has almost infinite patience to answer buyers' questions, no matter how silly or tedious the questions may seem. But how could I find out, other than testing each agent the way I tested that Century 21 agent? And what if all of them flunk the test? By then I might have been able to sell it myself already.
Assuming I do sell it myself, where are the best places to advertise? I'm selling it at a bargain price because of how bad the market is now. Maybe I should advertise it somewhere a lot of bargain hunters look?

My boyfriend and I are planning a move to Raleigh, NC in late June early July. I've been looking at jobs online since about November, and I'm not sure where to start. Do I fill out applications even though I will not be there until June/July? I want to continue doing this when I move, but it seems there are no openings for anyone with out a degree. My husband and I have been looking at an apartment to rent. The advertisement posted the rent as $695, and $100 off the deposit if we could move in by a certain date. We were then told that the $100 off the deposit would not be applicable anymore, because there were so many inquiries. We started packing and making arrangements, and today my husband received a phone call from the real estate company asking us if we would be willing to pay more because there was another couple interested in it. Basically, it was like the apartment was up for bid, which was a contradiction to what the price it was advertised as. Earlier in the day, before that phone call, the agent called us and said he was going to email a contract for us to look over. We feel like we have been promised something, and then now we are getting nothing. Although nothing was yet in writing, we feel that this is unfair. We live in Utah. I am 26, married, and trying to figure out a good career path to get started on. I went to school to be a product developer in the fashion industry but I realized after I met my husband that the fashion industry is not very family friendly. We are trying to have a baby and I would love to be a stay at home mom, and fortunately we are comfortable enough on my husbands salary to do that. However I would like to start going to school and training for a career in case something were to happen to my husband and I would have to step up as the bread winner.
So I plan to go to school over the next 4-6 years and then find a career that I can do part time with the option of moving into full time work if needed. Then when the kids leave the house I can start working full time again. I am incredibly horrible at sales so I definately cannot do that.
Here are some career choices that I have thought of:
Nursing: I am not sure if I can find part time work doing this, however many nurses work three 12 hour shifts rather than five eight hour shifts so I'm sure I can make it work (with the help of my moms babysitting services). I especially would like to work in an OB office or as and L&D nurse.
Vet Tech: basically a nurse to a vet. I can get certification to do this in two years at a community college. Most vet tech positions that I have seen advertised are part time and are clinic hours, which would be perfect. I also love working with animals and my husband and I dream of owning a dog daycare one day, so this experience would help if we were to ever realize this dream. Eventually I would love to become a vetrinarian, but the schooling is $300,000 and they don't make that much money so I don't think I could justify that much student loans.
Property Manager: My whole family is in real estate and I have helped manage some of their properties before. I would have connections, leads, and referals so it would give me a leg up. I could either work for an apartment building or a real estate company. I would need to get my real estate license, but that shouldn't be a problem.
So those are the three things that I have thought of. If anyone has any experience in one of those careers I would love to hear your input. Any info such as pay, hours, job availability, job outlook, etc. would be greatly appreciated.
