Resolved Question: Should I try to come up with the money and pay her back, or take it to court?
Yesterday, I sold my old jeep to a young lady and her father. They had driven the car 3 times before deciding to buy it, and her husband and father inspected the vehicle and said it was good. They checked everything-the tires, motor, transmission, and after driving it, her father said it was a good car. Today, the girl called me, very angry and said that she wanted her money back, because the car wouldn't start, and the windows wouldn't roll up. Now, I was surprised because as I had told her before, the car had worked for me absolutely every time I used it. And the windows were working. She said it was false advertising, and her husband threatened to sue me. Now, from the people I've talked to, I know that once the deal is done, it's over. I signed the title over, they gave me the money, and that was that. The car was working just fine while I had it. So what should I do now? I will be speaking to an attorney tomorrow but I want to have an idea or at least a few opinions on what to do. I don't even have the money anymore, I used it for college. I feel kinda helpless. Under a week ago I paid $1700 cash for a 199 vw golf that was advertised as being 149 xxx km with no accidents. We purchased the car, and THEN carfaxed it (I know, stupid me) and turns out it was totaled in 2004, and is now classified as 'rebuilt'. So hat was my fault, I figured I should just suck it up. But now, I was sorting through the papers again and I found another document wedged in the aircare pamphlet. It's the previous owners transfer form! It says it has 200 000 km on it... And it was signed by both parties. So... I have this government transfer form now that says this golf has 149xxx km (lie) no damage over $2k (lie). I haven't transferred the car to my name yet, and it's been under a week since I paid for it. FYI: I live in India. Please Note: I am neither Racist nor Casteist. But I am person with several genuine problems and absolute bewilderment. I am website designer, and I have extremely good communication skills. I rate myself as a very good at civic sense and social manner awareness. I am trying to run my small family (4, including myself) with the earnings out of my shoestring business. I am always polite to my clients, I make sure they are comfortable with every technical aspect of their website, I make sure the site is Standards Compliant for the client's sake, despite them not even knowing what W3C Standards are. I try to keep my prices as comfortable as possible, and relatively low. Yes, I am somewhat more expensive than the general market, but the cost of having an unruly, brutal joke of a messy website "design" is more than the price of owning a good website. Also, I never spit on the road, refuse to relieve myself on the pavements like so many other people do despite desperate urgency, always say "excuse me" before I do anything remotely assertive. I respect women, pay my taxes on time. Despite all this, I barely manage to scrape by, financially speaking. I am usually at the mercy of my landlord, and begging all the people I owe money to, to wait "just a few more days". Then, I get a small respite in the form of a new client or two, and I am forced to spend all the money on my commitments. This basically leaves no chance for me to improve upon my life, or the conditions therein. I am always stuck in this vicious cycle of debt and repayment. Add to my woes is the fact that we as a family have no source of support from our relatives, and hence zero investment capability; I can't even afford to advertise my services in the local newspaper classifieds. I am forced to rely on the poorly maintained and extremely unreliable public transport system, since I don't have a vehicle. Yet, I do try to work hard, against all odds. CONTRAST THIS WITH THE FOLLOWING: All I have to do is to take a short walk onto the main road, and I see multiple swanky cars on the road. In a majority of these expensive vehicles, there are people who are unruly, wear arrogant looks on their faces, and drive like shit. A lot of them don't look educated (you can tell the difference, though it sounds preposterous). They don't hesitate to pull down the window and spit copious paan onto the roads. They don't hesitate to open up their fly and start spewing on to the footpath, even in the presence of women on the road. They wear large chunky jewellery on their sweaty unhygienic bodies (trying to demonstrate their wealth), but display the social sense of a bacterium. WHAT THE HELL IS GOING ON! How is this happening? Will I ever succeed in life? Will I ever overtake these creatures? And pray tell me HOW _SO MANY_ of them are ending up so RICH! I have a car/bike website. I advertised on craigslist for writers to help me. I got quite a few responses and was really excited about the project. Once it was launched, I was down to one other writer and myself. And lately I haven't heard from him. I know that actually paying my writers would probably help some, but they all agreed to contribute and try to build it up into a paying gig. I have one more month on my site. Its quite complicated - Firstly - We have been together for about five years. He has his own business so I bought a house which is in my name. We agreed to do this in case his business folded and i wouldnt lose the house. Anyway - he does F@@k all to help me in the house - No help with DIY, no help with cleaning or maintenance. When i ask him why he says Its not his house so hes not intrested!!!! I feel really crap - he keeps throwing in my face even though it was his idea. He has a flat above his business and sometimes he still stays there, esp if we have an argument he just goes back there. Because of this set up he wont help me pay any bills on the house. He stays up till 3 in the morning using electricity. He gave me a credit card a while ago but im not allowed to use it so i have given it back to him. I dont know what to do - I work for him and I get a small amount of money for doing this but its not enough to live on at all. I have a son to support and my bf is just not helping. To top this off - I said to him I really dont know I can financially go on and am looking for another job. I joked about becoming an escort and he said he found that really horny. This church advertises on the net asking people to donate money to help the needy. I will tell you who the needy are. It is run by Rev Dr Leslie Mary Trombly who has a lovely lifestyle in USA. She goes without nothing. Her hobby is running the church from her wheelchair online. It makes her feel important. Under her we have Abp Paul Baker, an old man now, married with kids and grandkids. He supposedly sorts out the money and gives it to those who need it etc. But this is what we found out about him, and all of this is proven. You can read an article about it. Sunday People newspaper, UK. Very Bad Men and other tv programmes are thinking of making a programme about this guy. His last church threw him out because of "money discrepancies". He has borowed huge sums of money from parishioners and others. One lent him £8000 and then he nagged her to lend him another £7000 which she refused. Most people have to work a year to earn this. This guy then insists that he is sorry but he cannot pay it back and pleads poverty. Yet in the meantime he has about 5 holidays a year, long expensive ones, buys cars, bought a boat, joined the golf club, and takes his family out for very expensive evenings. In other words the people who lend him money end up paying for his luxuries and lifestyle. Other churches in his area refused to deal with him because he didnt pay his bills or over charged. Other jobs he had always sacked him. He is almost bankrupt and owes the bank a great deal. Yet he continues to spend a lot. Usually other peoples money, which they think he will pay back, but he never does. Although this man is married with kids and grandkids and very old now, he also pesters women at the church for sex !! He told one much younger single woman that he loved her and wanted to marry her. He bought her an engagement ring, got officially engaged to her (forgetting to tell his wife). He also virtually moved in with her, making out to his wife that he had to work very long hours and that is why he was rarely at home. He did this for EIGHT YEARS and it only ended when the girlfriend ended it, it would still be going on now otherwise. He became so loathed and distrusted where he lived, and his wife knew that she was an outcast in the town, and she was scared that if they stayed he would keep pestering this woman to see him again. So they had to move a long way away. The church knows all this, yet they are happy to keep him. Happy for parishioners to trust him with their money and their lives. I have a grandma who is getting old and a very forgetful. My dad and my uncle (his brother) have been tense with each other after my dad found a bunch of checks addressed to my cousin who is in her 20's. She claims its for my grandmother's groceries, but each check is about $300 every other week. My grandma says she gives her the money because she's got two kids to raise and she's going through nursing school. What she likes to forget is that my cousin got pregnant at 16 and then again when she was 19, both to her then boyfriend, now husband. In my eyes this doesn't give her the right to collect money from my grandma, but that isn't the worst thing. My grandma has asked for my dad's help to sell her car since she can no longer drive. My dad claims that the car was promised to me (I'm 15) when i got my license. My grandma admits that but says she at least wants some money. We offered to pay $2000 for the car, which she agreed upon, then decided against, saying it wasn't enough. We don't have tons of extra money so we declined her offer of $3000. About a week and a half later, she asked my dad to put a sign on her car, advertising it for sale at $2000. My dad asked her why is it back at $2000 when she had said that was too little an amount. She says she knows that but she wants my cousin (as mentioned before) to be able to afford it since she has no cash flow. That is a lie since my cousin is out of college and working as a nurse, plus her weekly withdrawls from my grandma's bank account. That is the point where my dad somewhat lost it. He told my grandma that she was picking favorites and then he told my uncle to control his daughter before she sucked my grandma dry. This caused the rest of the family to turn on us. Who was right? I bought a vehicle off craigslist early last week for $1,700. The car appeared to be in pretty good shape and ran pretty smooth, I put about 200mi on it and parked it only to notice it was spewing transmission fluid everywhere. I took it in to a shop where I know the guys and they told me it was a torn front seal and they recommended to another shop since they didn't work on transmissions. So after getting an estimate of about 600 to do the job I wasn't to upset, I figured something would go wrong with it. Then after a couple hours the shop called me back and told me that it was very bad on the inside and that the best route was a rebuild or a new transmission. The quote on the rebuild is $1,800...We called the private seller asking to help pay for part since in his ad he claimed "transmission in good working condition", I've put down 800 already and I'm trying to get a loan to pay the rest, my question is, can I take the seller to court for false advertising?To STEWIE: I paid cash for the car, all 1700. A few days ago my little brother grabbed a flyer that was on our doorknob that was advertising a free carnival for kids set up by a Christian Church a few blocks away. He is 8 and I am 16, and I babysit him often, as well as a cousin who is 6. A few days later while driving with both of them in my car they saw the lights and stands in the church parking lot. They begged me to take them down the street to this carnival and my mom said to take them, because they were making a fuss. When we got there it looked pretty lame. They had very few games and free cotton candy and popcorn, but they enjoyed themselves, even though we were there for less than an hour. Well when I walked in there they asked me to write my name, address, and kids name on a paper so they could mail an evaluation to my home on this carnival. Well today two ladies came to the door and said that they were going to be picking up my cousin and brother for their bible study on Sunday around 11 am and to have them ready! I told them that I don't think my mom will allow that and that we are not non-denominational Christians, we just went to the event because it was free. They then said that they wanted 20 dollars, 10 for each child who attended the event, and that it was only free to families who wanted to enroll their kids in the youth program! I then mentioned that I would have never wrote their names on the paper, I was told it was for a post evaluation. Well needless to say I told the lady not to come by on Sunday, because they won't be going and I was not paying anything and closed the door. Has anyone ever sold or bought a car from One Stop Motors? or even heard of them? I placed an add for my car on ebay and within 3 days One Stop Motors contacted me saying they could advertise and get my car sold for $499 non-refundable for more than what I was asking, that they would continue to advertise it until it was sold, and it would come up on the top 3 of any search engine. However, being skeptical I said sure if you could mail or email me a list of the services and advertisement sites you plan on using that you just described to me over the phone.... well that's when all hell broke loose.... and they had me check out their website and read their blanket agreement online and do everything but send me a contract or description of exactly where, how long, and how many websites / ads they planned on marketing my vehicle. The only way they would divulge that information was in an invoice that I would get only after I paid them my $499 non-refundable. They just seemed shady especially if they do not offer their to-be customers with a solid assurance of where their money is going to be used towards and it is non-refundable. Hi long story short. We just moved from British Columbia to Toronto area, because i had my daughter and wanted to be closer to my family. My boyfriend was a professional painter in BC for years. As we moved to a slightly high class area where people `have money,` we thought that him opening up a painting company was fool proof and would take off immidiatley. NOW we are having trouble paying rent and buying food, with another baby due in 2 months and don`t know what else to do to advertise. There is NOT to much competition at all in this town. He did get a few small jobs from my dads friends in the area but it is not enough. The things we have done to advertise are: Flyers and magnetic cards on mail boxes as they are the multi ,ail boxes one for each street. Put a add in the local paper. Handed in cards to the local paint store. Got magnets to advertise on the side if the car. Drove around and looked for homes that needed painting and knocked on there doors to hand them a card. We still get no calls to quote. With the flyers we put up there are at least 5 of the phone number tabs riped off each one and we placed about 100 around town. I have purchased a dark blue 2006 Dodge Magnum in December of 2009 from North Coast Auto in Bedford Ohio. The car was found online and myself and my boyfriend worked with a John to make this car mine. It was advertised to have a new engine, keyless entry, tinted windows, clean interior, ect. A used car in excellent condition, sold for the bb value of excellent condition. John also informed us that while he was holding the car for us he noticed a crack in the windshield so he had that replaced. We had gone to the dealership the middle of December and put $400.00 down then arranged to take $2600.00 later to pick up the car. We had taken the rest of the down payment the end of December and the car was still not ready they told us. Then after about two more attempts to go pick up the car at a time that was convenient for me and my work schedule, TaRodd and I made it up there, John said it would be ready that morning. I called him multiple times and he ignored the calls so I left a voice message stating that I would be there at noon because I had to be at work at 1:30pm. The last time we spoke he said it would be ready as he said in the morning. Once we got there he looked a little surprised and said it would be one more hr, that they were finishing the detailing. He had me sign the papers, I didn’t feel comfortable signing the paperwork without seeing the car other than online but he assured me that if anything was wrong with the car we would shred the paper work and refund the down payment. Tarodd and I then waited and at 1pm I had to call in to my job and use 2hours of my paid time off so that it would not affect me attendance because the car was still not ready. We kept waiting and then I had to leave for work and they said that Tarodd could stay and look at the car and bring it to me and if I find anything wrong I can take it back. Well Tarodd didn’t leave the dealership until 8:45pm after they had closed. They then gave him the keys and left. Driving Back To Akron TaRodd then noticed that the engine light had popped on, he called john’s cell, to tell him what happened an that it needed fixed but was only able to leave a message. Once I got off work we noticed that some of the nuts on the outside of the hubcaps were missing also that the hatch back door did not hold itself up. Then it snowed and we noticed that something else wasn’t right and moisture was inside and the defogger was not working. Honestly, I don't know much about gas other than what octane to put in my car. I see commercials for Valero that advertise that it is 100% American gasoline. And the same basic question for 4-line. If this can't be done with a "traditional" landline, could it be done with a VoIP system set to simulring? My second question is that office furniture is VERY expensive (at least as a startup) but also, at least in my opinion, very important since the customers first impression will be how your office looks. So, are there any places that rent/lease professional office furniture cheaply enough to make it worth not going ahead and buying it? I'm going to be in need of at least one desk for my office, a reception desk and one other desk for the front office, plus chairs for all of those, chairs for customer waiting, and customer chairs in the office(s). I purchased a 2004 Santa Fe from a used car lot. When I bought it, I believed it was an LX trim, with a 3.5 liter engine... as per the online ad on their website and on auto trader. However, I found out after purchasing it that it is the GLS Trim model, with a 2.7 liter engine. On kelly blue book the difference in value between the vehicles is: the GLS model is worth roughly 10% less than the model I thought I was purchasing. Now, the bill of sale does not list a trim. Just the make and model. However, I have a print out of both adverts, both with a picture of the car I bought, stating the 'false' specs. Is this enough to prove false advertising? I would ask for my money back, but I spent $75 registering the vehicle and $275 buying tires for it. I would need to be reimbursed for those costs should he offer a return. And for those cars that weren't repossessed but late on payments I always managed to get them to pay within 12-24hrs of speaking to them. I bought a car from a dealership in Ohio. The price was $2300 and I just needed a car to give me kids to get to school. I bought the car as is, knowing only that I had to change the tires ( that's the only thing they told me that needed fixing) so I bought the car and took it back to my home in Michigan. The next day I took it to a mechanic and they told me the car had a blown transmission and it was missing a head on the gasket on top of regular servicing. They told me I was even lucky that the car didn't blow up on the way back home. But they told me it would cost 2000 extra to fix and i don't have the money to fix the car at all and i don't want to keep going out of my way to take my kids to school before work. My first visit to Tokyo was a life changing experience. I did not want to go to Tokyo and I expected it to be a dull and boring trip, but I was provided with an experience of a lifetime and a new view on life. Walking out of the air conditioned train station with my mother, a blast of hot humid air surprised me and nearly pushing me backwards. As I walked out onto the sidewalk, I gazed up to the sky and saw many tall glass-plated skyscrapers. “Mom!”, I exclaimed, “what are these tall buildings for?” “Well Kurt”, she replied, “these are office buildings, where businessmen work.” “Will I ever work in one of these buildings?” I asked. “If you work hard in school and try your best you will one day” she explained. Walking down the street, I was surprised by the hustle and bustle of city life, the amount of people on the sidewalk and the amount of cars on the roads creating a never ending traffic jam. The sounds of hammering from constructions sites, the loud blasting music from stores and restaurants, the sound of cars honking, people talking and advertising campaigns was like music to my ears. These were the real sounds of a big city. Walking around Tokyo and taking in the sights and sounds, as sweat ran down my forehead, drenching my shirt, I was speechless. The city felt like a never ending maze with streets that led to streets upon streets. Walking past an alley, I noticed homeless people digging through dumpsters and sleeping in old, dirty stained clothing. “Mom, why are those people homeless?” I asked. “Because they do not have a job and do not have any money,” she explained. “I don’t want to end up like that when I am older,” I added. “Work hard, get a good paying job and make lots of money. Finally, after purchasing the tickets, we made our way over to the train which was filled beyond its doors. Two men, wearing white gloves and police like uniforms, pushed people into the train as they tried to get everyone in. After the chaos of getting onto the train was done, I could only notice how full the train was. “Why are there so many people on the train,” I asked quietly. “Because most of these people are going to and from their jobs,” my mom explained. The train was like a giant sauna and there were so many people no one could move. Luckily, our stop was next and I did not have to bear the train ride any longer. The walk to Tokyo Tower was peaceful and refreshing. The route to the tower was through one of the few parks in Tokyo and it felt like I was in the middle of a forest, not in a city. I could hear the branches swaying in the wind, the birds singing and the bugs buzzing. As I approached the tower and looked up, I was impressed by how the tower stood out like a diamond in the rough. As the elevator went up, the city began to emerge before my eyes and I felt at ease to be out of all the chaos. I felt like I was on top of the world looking down at a never ending concrete jungle. Looking out at the view, I felt mesmerized by all the tall buildings. “What kind of people live at the top those tall buildings,” I asked, as I kept my eyes glued to the view. “People who have worked hard all their life,” answered my mom. “Why do they try so hard?,” I retorted. “Because you only live once and you should do everything you can to make the most out of life,” my mother stated, hoping that I will do as she says. Starring at the view, I was impressed and inspired. Just like the never ending view of the city, I realized that there is a never ending amount of opportunities and possibilities in life. In conclusion, my visit to Tokyo turned out to be more than a trip. The visit changed me as a person, taught me what was important in life and that I should work hard for what I want because things do not come easily. The city of Costa Mesa has agreed to halt enforcing the ordinance pending a decision by the U.S. 9th Circuit Court of Appeal on a challenge to a similar anti-solicitation ordinance in the city of Redondo Beach, according to an ACLU release. I had an interview with Premiere Productions Inc. for an Event and Wedding Planner position that they had advertised on Craigslist. I was interviewed by one person and she told me that I was perfect fit for the position and company which was odd to me because she hardly asked me any questions about my background and qualifications. The day after the interview I received an email and call from a man named Joshua Komer who told me that the position would require me to pay Premiere Productions Inc. $3500 to $11,000 for their training which they did not mention in their job listing or during the in person interview. Since when do you have to pay a company thousands and thousands of dollars for 12 weeks of training as a prerequisite for a job? I told him that I was looking for a legitimate job and career opportunity. I expressed my reservations and concerns about the costs associated with their training program. Joshua told me that they could assist me in taking out a loan and line of credit in my name to finance the training. He also made it a point to assure me that I wouldn't have a problem paying the loans off quickly because I would be making lots of money through various internships during the training program. If that's the case then why do I need to pay them so much money in advance and why can't they take it out of the earnings I'm going to make while I'm being trained. Then Joshua proceeded to tell me that he is currently an Event Producer at Premiere Productions Inc. and was in my shoes just a few shorts months ago, but took a leap of faith and paid for their training program. If Joshua is really an Event Producer, then why is he spending all this time trying to sell honest job seekers on the hopes and false promises of their paid training program when he should be planning events and weddings as he was allegedly trained to do. I asked to speak to his supervisor and I was told that I would be contacted by a lady named Maria Cook. When Maria contacted me over the phone, I pressed her for more details regarding the training and job. I could not get a straight answer out of her regarding how I was going to get paid while enrolled in the training program. Ive been involved in small car lots before. Even helped start and worked at one for 2 years back in 2006. We sold 20-25 cars per month out of that store. Nice building, garage, nice lot and good location. - The building can still be available to me. ($850/month) Other than tax time, what do you think of going back into that business, but instead of carrying 30 cars like we did, maybe 10 + Quick Detailing. He prepares his morning breakfast, bacon and eggs. Joe's bacon is safe to eat because some girly-man liberal fought for laws to regulate the meat packing industry. In the morning shower, Joe reaches for his shampoo. His bottle is properly labeled with each ingredient and its amount in the total contents because some crybaby liberal fought for his right to know what he was putting on his body and how much it contained. Joe dresses, walks outside and takes a deep breath. The air he breathes is clean because some environmentalist wacko liberal fought for the laws to stop industries from polluting our air.He walks on the government-provided sidewalk to subway station for his government-subsidized ride to work. Joe has to pay his Fannie Mae-underwritten mortgage and his below-market federal student loan because some elitist liberal decided that Joe and the government would be better off if he was educated and earned more money over his lifetime. Joe also forgets that his in addition to his federally subsidized student loans, he attended a state funded university. Joe is home from work. He plans to visit his father this evening at his farm home in the country. He gets in his car for the drive. His car is among the safest in the world because some America-hating liberal fought for car safety standards to go along with the tax-payer funded roads. He arrives at his boyhood home. His was the third generation to live in the house financed by Farmers' Home Administration because bankers didn't want to make rural loans. The house didn't have electricity until some big-government liberal stuck his nose where it didn't belong and demanded rural electrification. He is happy to see his father, who is now retired. His father lives on Social Security and a union pension because some wine-drinking, cheese-eating liberal made sure he could take care of himself so Joe wouldn't have to. Joe gets back in his car for the ride home, and turns on a radio talk show. The radio host keeps saying that liberals are bad and conservatives are good. He doesn't mention that the beloved Republicans have fought against every protection and benefit Joe enjoys throughout his day.
