Open Question: Commercial Contracts. Can someone answer this question for me? Its for a Commercial Contracts University paper?

Question One Pris advertises her Porsche 911 for sale in the newspaper. Leon, a recent commerce graduate, answers the advertisement and inspects the car. Although Leon is handsomely rewarded as a member of the auditing staff of Nomosake Hobbes he is unable to pay the asking price. However he is optimistic of arranging a loan through his parents. He does not want to commit himself but wants to tie Pris down while he takes time to think the matter over. Pris types up a letter on her stationery which reads, “I, Pris, hereby offer to sell my Porsche 911, registration number ZXY 6166, to Leon for the sum of $100,000. This offer may be accepted by letter sent to my office at Mission Bay, and if so accepted shall be deemed to have been effected at the time the letter would ordinarily be delivered. I also undertake not to sell the car to any one else before Wednesday 7th July 2010.” Both Pris and Leon sign the letter. Leon, after checking his bank balance and obtaining a loan from his doting grandmother, decides to accept Pris’s offer. The post office is experiencing a go slow by its employees so Leon decides to fax his acceptance. He sends a fax to Pris’s office on Friday 2nd at 6 pm. But unknown to Leon Pris has already left for the weekend. The following morning, Saturday, Leon posts a confirmatory letter. In the meantime Zora, a friend of Pris offers her $99,500 for the car. As Pris has not yet heard from Leon she accepts Zora’s offer on Sunday afternoon. That afternoon she phones Leon and tells him she is withdrawing her offer. Leon tells her of the fax and the letter. He demands the car. Pris refuses. On Monday morning Pris checks her fax machine and reads Leon’s acceptance. Later that morning Pris receives the letter in the mail. Analyse each stage of the scenario in terms of offer and acceptance and advise Leon whether he has a valid claim against Pris. more

I wish I knew how many times I've read this piece... haha. Final Stop Leaning against the metal railing, I glance down at my cell phone, 7:23. The train should be here soon. On this humid summer’s night, the light rail station is rather empty. A mother holds the hand of her small child by the sign advertising one of the city’s more popular restaurants, Ellington’s. The advertisement pictures a happy couple, toasting to something— perhaps the luxury of a night for just the two of them. They look almost too happy, as if they’ve been slipped too many anti-depressants. No one is that happy, not in this small town, at least. Sitting on the wood bench by the ticket booth, an elderly man rests his tired eyes. A few teenage girls chatter amongst themselves at the far end by the vacant tracks. One seems dangerously close to the edge, just past the yellow line, the one that you’re supposed to be behind while the train approaches. My mind wanders, as my lucid imagination shows the girl tripping backwards over the edge just as the train barrels through as it slows, splattering the walkway with blood, just like that movie “Final Destination” – I love movies. But then I snap out of it. I have a vividly evil mind like that sometimes. I close my eyes and take a deep breath, and take in my sacred moment of solitude. A few minutes of my treasured bliss— my thinking time —is all I need, all I could have for now, as the slight breeze signals the approaching train. The distant horn blare sounds suddenly, causing my heart to race a bit. The breeze from the engine flies past— it’s close now —and it feels good, washing away the humidity for a moment. Finally, the doors swing open and we begin boarding the train. “Welcome and thank you for using the official light rail of Virginia’s Transit Association. Please take a seat and keep your ticket in hand; the attendant will be coming around shortly,” says a voice over the intercom system. Gripping my ticket, I place it in my pocket for safekeeping. I scan the train for an open seat, a window seat. To my dismay, the only seat is one bordering the aisle. I look around for friendly faces, noticing a few people my age. A girl who looks like she just got off work. An elderly woman with some department store bags. An eerie man with dreadlocks, wearing a Yankees cap and drinking something wrapped in a paper bag. An older man in the back with a hoody drawn over his head. With no choice but to otherwise stand, I sigh and take the seat next to the old woman. I place my bag beneath my seat, situate myself into a comfortable position, and slowly drift into a shallow, foggy nap. “And how are you today, young lady?” The question startles me awake, fogginess, huh? I open my eyes, look to my right to see the man with the dreadlocks. His greasy locks escape through the holes in his Yankee’s cap. His lips are still moist from the last drops from his mystery drink, and pungent like cigarettes and cough drops. His eyes are dilated with euphoric mystery. A bit dazed and confused, I look around the car— almost everyone has reached their destination and departed the train, except for the sleeping elderly man in the back. Wearing his hoody, he sleeps soundly. Maybe I dreamt somebody was talking to me? But he seemed to be looking back at me, as if anticipating some sort of response. Before muttering even the simplest response, my shy finger points to myself, and he does a quick nod raising his eyebrows and giving a tight, wide goofy smile, confirming his request for human interaction. Did he not see my eyes were closed? “I’m good, thanks,” says my sleepy voice, as I slid across the seat towards the window. He slips into the aisle and next to me in my seat. He looks into my eyes like the Cheshire cat with a big grin, as if he’s looking for diamond tear drops. I try to stay calm, but my eyes open wide, as I press myself back against the window, panic spreading paralyzing fear through my limbs. I’m wide awake now. “Your eyes,” he begins with a whisper, “your eyes are quite brown for green eyes.” I’m baffled. I guess the mystery drink is working magical wonders on this man. As my heart rate subsides, I figure maybe he’s a harmless drunk, but I continue to keep up my guard. Smiling, I give the tweaked eyebrow “you’re crazy” expression, but I realize that he’s waiting for some sort of reply. “Oh… well… thank you?” I pause to search for the right words, “you have pretty eyes, too?” I say reluctantly, feeling a bit goofy having a conversation with a creepy, crazy man on a train. The sheer thrill of my compliment rushes through him, brightening his day. He relishes in the idea of receiving a compliment, but after a few minutes of silence, the smile begins to fade and round two begins. “So, where are you headed this evening?” he says. During this short time, he’s developed a comfortable relation with me. Unfortunately for him, it’s not mutual. My clammy right palm clencMy clammy right palm clenches my clammy left. I suddenly feel uneasy and pretend not to hear him. He catches on, scrunches his eyebrow and repeats his question, “Where are you headed, young lady? It seems a bit late for you to be out alone!” What is he looking for here? Is he a sexual deviate? An escaped lunatic? A drunken paranoid schizophrenic? A caring stranger? DING, the voice on the PA system announces my stop is only two away. Next stop in five minutes. “I’m off to the movie theater,” I say quickly, hoping he takes note of my short answers. “I see, I see. I was thinking about going tonight.” I nod my head; count the seconds until my stop. He inches closer to me, “So what film are you seeing?” “I’m not sure,” I utter before biting my bottom lip and moving closer to window. At this point, he’s trapping me in my seat, like a hostage. I hope and pray the old man in the back is actually alive and, if I’m really lucky, an ex-marine who will rescue me.Helloooo, strange old guy, come help a girl out, pleeease. Be a good Samaritan who will wake up soon! “Well,” he pauses to cough into his sleeve, “maybe I should join you. We could see that new comedy with what’s his name, uh—” Terrified, I pretend to take a call, “Um, yeah, sure. I’m getting a call… sorry, I have to take this.” Without hesitation, he responds, “Who is it? Your boyfriend? I bet a beautiful girl like yourself has the boys lining up and down the street,” he says with a laugh, coughing, wet and phlegm, like a homeless guy with emphysema.*homeless man with emphysema.I ignore him and begin speaking to the invisible identity on the other side of the phone conversation. “Oh, hey, I was waiting for you to call me back. How have you been?” I listen to the sounds of silence and, every once in a while, I ask another question. “I heard you just got back from a trip, how’d that go?” As silence begins to share her story of a trip to the beach, the identity in my seat— blocking me in —remains patient. I look at him from the corner of my eye, and he smiles back, creepily tapping his wrist, glancing towards the back of the car and back to me. I shrug my shoulders, as he inches closer and places his sweaty, left palm on my hand. My breathing stops, my speaking stops, but my heart beats faster. With his right hand, he forms a tight grasp around my right hand and my cell phone. I’m numb. I’m frightened. I’m petrified.He slowly closes my cell phone, ending my call with silence. I’m trembling inside and out, but he strokes my hand— his attempt at keeping me calm and quiet. Frantically, I search for help from anybody on the train, but fear blinds me— I’m on my own. DING! PA system announces our arrival, as the train begins to decelerate. “So come on, my treat, let’s catch that movie,” he says gingerly, yet nervously, glancing back at the old man sleeping in his hoody covered head. It’s as if considering whether or not the old man will be able to ID Mr. Dreadlock once my beaten and butchered body is discovered in the river the next day. I don’t answer. I can’t answer. He draws his arms back and subtly returns to his normal sitting position. Still bewildered and confused, we look at each other. His eyes, once dilated with mystery, are now dilated with sadness; mine with trepidation. He suddenly seems sober.As the train comes to a stop, the doors swing open. I notice a young woman around the age of the mysterious stranger waving and smiling on the landing. Mr. Dreadlock looks back at me, as he leaves the car, smiling that Cheshire cat grin and hugging his girlfriend, swinging her around jovially. Huh? I’m confused and relieved, as the doors close and the train begins to pull away from the station. DING! Next stop is my stop, 10 minutes. My mind and body are exhausted from the excitement. Mind gets foggy, eyes heavy…..as a hand firmly covers my mouth from behind....Now that was obnoxious to do. Haha, comments?Aw guys, don't give me all the credit; most of it belongs to G Love. All I did was write a rough draft of the story and put in the some punctuation. G did all the imagery and all the amazing stuff. Haha, I just posted this piece because I couldn't post my edits on G's question... apparently, my answer was too long. Still, I'm glad you guys enjoyed it, but really, give the praise to G. :)P.S. UnKnown, I'm fourteen. If any fourteen-year-old can write like this on their own, well, I'd be just as shocked as you are. Haha, I do my own writing, too, but it's never anything like this.G, writing this wasn't obnoxious at all; it was the posting it that was obnoxious. I hate how they limit the number of characters that I can use. I mean, some people talk a lot (cough cough us cough cough) so we need extra characters. Haha, but you've convinced me on the humor/informality points. I think I'm going to put them back into the piece and save a copy on my computer. You know, years from now, I want to be like, "Hey, remember when we wrote this? Yeah, that's the summer that we spent all of our time on the computer." The popularity of shirts advertising Black metal is skyrocketing, There is plenty of serious Satanic Black Metal, a video game franchise about stealing cars and selling drugs is the top selling video game franchise, kids on my bus talked openly about drug use, some kids at my school when I tried to talk to them sometimes would only say stuff like "How big is your penis" etc. I've seen a person online drop the F-bomb on Jesus, Mary, St. Luke, other gospel authors and even St. Michael. Resolved Question: is there anything I can do to stop a car loan application ?

I bought a car knowing NOTHING about the process. turns out the advertised price which i have a copy of was $5,990. The dealer wrote on the Bill of Sale 7184.00 and even more for dealer fees. I am now furious its been less than a week and the bank has yet to approve my Loan still calling references. I do know the dealer had me sign the wrong type of loan contract and i need to re-sign a different one due to an odd payment of .25 cents. Can I refuse to sign the new contract and give the car back? is there something i can say or do so the bank wont approve my loan? please advice me.The dealer has also said that once she "gets the green light from the bank she will call me to have me sign the new contract".. at that point can i return the keys and ask for my money back? or can she still try to enforce the old contract?furthermore the car is not yet registered in my name and I never signed any bank loan papers yet.it clearly states on the back of my contract "For sales involving dealer arranged financing: this sale is conditioned upon purchase of your proposed sales contract..if not approved by finance company , you may cancel this sale and any downpayment you submitted will be returned to you provided the vehicle is returned within 24 hours of credit denial" it says nothing about charging for mileage or car rental fee more

Resolved Question: Should I try to come up with the money and pay her back, or take it to court?

Yesterday, I sold my old jeep to a young lady and her father. They had driven the car 3 times before deciding to buy it, and her husband and father inspected the vehicle and said it was good. They checked everything-the tires, motor, transmission, and after driving it, her father said it was a good car. Today, the girl called me, very angry and said that she wanted her money back, because the car wouldn't start, and the windows wouldn't roll up. Now, I was surprised because as I had told her before, the car had worked for me absolutely every time I used it. And the windows were working. She said it was false advertising, and her husband threatened to sue me. Now, from the people I've talked to, I know that once the deal is done, it's over. I signed the title over, they gave me the money, and that was that. The car was working just fine while I had it. So what should I do now? I will be speaking to an attorney tomorrow but I want to have an idea or at least a few opinions on what to do. I don't even have the money anymore, I used it for college. I feel kinda helpless. Resolved Question: I just bought a privately owned used car in BC... Did I get swindled?

Under a week ago I paid $1700 cash for a 199 vw golf that was advertised as being 149 xxx km with no accidents. We purchased the car, and THEN carfaxed it (I know, stupid me) and turns out it was totaled in 2004, and is now classified as 'rebuilt'. So hat was my fault, I figured I should just suck it up. But now, I was sorting through the papers again and I found another document wedged in the aircare pamphlet. It's the previous owners transfer form! It says it has 200 000 km on it... And it was signed by both parties. So... I have this government transfer form now that says this golf has 149xxx km (lie) no damage over $2k (lie). I haven't transferred the car to my name yet, and it's been under a week since I paid for it. Anyone have any idea what kind of legal rights I have here? more

Voting Question: Why do web-sites mis-represent themselves?

Has anyone else noticed how often that web-sites say "Free to Join", when the truth is the following: The only thing which is "free", about these sites, is to register. How many people have noticed that, even when a web-site has a page, which, clearly states that "Your credit card information will ONLY be used for age verification". "You will NOT be billed for this visit" Yet, when you check credit/debit card statement, you find that you HAVE been billed, from $30.00, to $100.00, by the web-site. Is it not openly deceitful, for web-sites to promote "free access", when access is not "free" at all? Shouldn't web-sites be required to change advertising to say "Visit/Tour is "free", but access will cost (how much). Shouldn't Age Verification be changed into the more truthful: "Your credit/debit card WILL be billed this amount for your visit, today"? Why do/are so many web-sites so openly in-correct, or un-truthful, about access fee's. Why do web-sites offer "free access" when, from the moment that users begin signing up, credit/debit cards ARE, immediately, billed, for this "free access"? When makes this type of mis-representation any different than a local car dealer, who promises that "This car is a gem", yet it breaks down before the new owner arrives home, and has to pay towing charges? Any suggestions? more

I have a grandma who is getting old and a very forgetful. My dad and my uncle (his brother) have been tense with each other after my dad found a bunch of checks addressed to my cousin who is in her 20's. She claims its for my grandmother's groceries, but each check is about $300 every other week. My grandma says she gives her the money because she's got two kids to raise and she's going through nursing school. What she likes to forget is that my cousin got pregnant at 16 and then again when she was 19, both to her then boyfriend, now husband. In my eyes this doesn't give her the right to collect money from my grandma, but that isn't the worst thing. My grandma has asked for my dad's help to sell her car since she can no longer drive. My dad claims that the car was promised to me (I'm 15) when i got my license. My grandma admits that but says she at least wants some money. We offered to pay $2000 for the car, which she agreed upon, then decided against, saying it wasn't enough. We don't have tons of extra money so we declined her offer of $3000. About a week and a half later, she asked my dad to put a sign on her car, advertising it for sale at $2000. My dad asked her why is it back at $2000 when she had said that was too little an amount. She says she knows that but she wants my cousin (as mentioned before) to be able to afford it since she has no cash flow. I've tried suicide, didn't work out so well. Since I can remember I have felt uncomfortable around people. Exspecialy large crowds or small children. I have purchased a dark blue 2006 Dodge Magnum in December of 2009 from North Coast Auto in Bedford Ohio. The car was found online and myself and my boyfriend worked with a John to make this car mine. It was advertised to have a new engine, keyless entry, tinted windows, clean interior, ect. A used car in excellent condition, sold for the bb value of excellent condition. John also informed us that while he was holding the car for us he noticed a crack in the windshield so he had that replaced. We had gone to the dealership the middle of December and put $400.00 down then arranged to take $2600.00 later to pick up the car. We had taken the rest of the down payment the end of December and the car was still not ready they told us. Then after about two more attempts to go pick up the car at a time that was convenient for me and my work schedule, TaRodd and I made it up there, John said it would be ready that morning. I called him multiple times and he ignored the calls so I left a voice message stating that I would be there at noon because I had to be at work at 1:30pm. The last time we spoke he said it would be ready as he said in the morning. Once we got there he looked a little surprised and said it would be one more hr, that they were finishing the detailing. He had me sign the papers, I didn’t feel comfortable signing the paperwork without seeing the car other than online but he assured me that if anything was wrong with the car we would shred the paper work and refund the down payment. Tarodd and I then waited and at 1pm I had to call in to my job and use 2hours of my paid time off so that it would not affect me attendance because the car was still not ready. We kept waiting and then I had to leave for work and they said that Tarodd could stay and look at the car and bring it to me and if I find anything wrong I can take it back. Well Tarodd didn’t leave the dealership until 8:45pm after they had closed. They then gave him the keys and left. Driving Back To Akron TaRodd then noticed that the engine light had popped on, he called john’s cell, to tell him what happened an that it needed fixed but was only able to leave a message. Once I got off work we noticed that some of the nuts on the outside of the hubcaps were missing also that the hatch back door did not hold itself up. Then it snowed and we noticed that something else wasn’t right and moisture was inside and the defogger was not working. We had to snow scrap the inside of the windows while driving or I wouldn’t be able to see outside. Then the check engine light came on, and the control arms were wobbling and would cause the car to jerk around. While these things were happening Tarodd and me were calling Jon and leaving messages demanding he called me back and that the car was unsafe to drive. When he did answer he apologized and assured me that the car would be fixed completely and told me that he hadn’t called me back because he gave my number to Bronco from North East Auto who was the garage that fixed their vehicles, and that he was supposed to have called me, but didn’t. He said he would call Bronco again and he gave me his number as well so that I could call him if I did not hear from him by the next day. When I did have to call Bronco the next day because he did not call me all he said was to bring up the car and he would fix it, but when I asked how long it would take he would not answer and said just drop it off. I asked when to bring the car he kept telling me to drop it off before 7:30pm but I worked until 10pm every night. I explained that to him and so did Tarodd and he then said have Tarodd drop it off. Tarodd drove up there the first time and they kept it 1 week and didn’t do anything except reset the check engine light and told him to bring it back on the weekend so they could finish fixing everything. So then 1 day after he got it back, prior to taking it back on the weekend, the check engine light came on and the car was still emitting lots of black smoke when it would get on the high way and when I would increase speed on the high way. It was clear when it snowed that nothing was done the week they had it because the windshield was still leaking. Then on the weekend Tarodd again dropped the car off on his way to class and they had it 8hours and when it was picked up they told Tarodd that they had to order parts and that they would need it for another week. Well we got the car and told them this is ridiculous and that they need to get everything together because this is a bigger hassle than needed. We then left multiple messages on Broncos and Jon’s phone requesting a call back regarding when they had all the parts. No one ever called us back. Then it was time to get new plates and I hadn’t gotten an E-check because the check engine light was on and would not pass so Tarodd and I drove up and told them we were on our way. I had a baby in November 2009. Since my boyfriend got his W-2 before me (in January), we decided to let him claim our son and have H&R Block do his taxes so we could get a RAPID refund. The preparer didn't know what he was doing. He ended up opting him out of the Earned Income Credit (without asking), typing in 2 months for the amount of time our son was "living in the home" for 2009 and accidentally checked 'yes' for the question "Did this person make more than $3500 in 2009?". When he was all finished he told us my boyfriend's refund would be about 900 dollars. I thought something was wrong, but didn't say anything and took his word for it. We paid for the rapid loan and we were expecting to get the money on our card within 2 days. I told my mother, who has been doing my taxes for years and never made a single mistake, and she pointed out that we were, in fact, supposed to get the EIC and Child Tax Credit. She got online and printed out the Publication from the IRS's website stating that if a child was born in 2009, you put 12 months, regardless of what month they were born in. They called my boyfriend 6 days later and told him there was a hold on the card and he had to come back up there to sign a paper to take the money off hold. We went back up there and showed them the mistake they made and ask that they amend them. The manager fixed it and gave us the forms to mail out and we asked if we still had to pay the fee they charged us to do this. He stated that we still have to pay the fee because that money is going to them for filing it originally. Yet H&R Block has the "Maximum Refund Guarantee" which states that if they don't give you your maximum refund you're entitled to, the tax preparation is free. We called the headquarters and even they are refusing to give us the money back. We mailed off the amended form and we are STILL waiting to get the check in the mail. We really needed that money to get our air conditioning fixed in our only car, not to mention we have a 6 month old and its 80 degrees outside in Virginia Beach right now. My question is should I take them to court? Why should we have to pay them for something THEY screwed up? I'm really not trying to make a big deal out of this, but this is just ridiculous and not fair. In my eyes, its false advertising for them to make a promise and not live up to it. more

Okay , so I am about to start training for a new job , which is a mobile auto detailing business... It is owned by a sheriff with about 11 workers..... 3 days before my training I ran into someone that worked for them .... said nothing but bad things , like they give you all the bad jobs and all the supervisors get the good ones ... He also told me that they make you drive to places like 30-45 minutes away to do a $30 car wash , when the cut is 60/40 ... So basically after wasting gas and toll money .... I will make like 5 bucks ... Another part of this job requires you to pass out flyers to businesses in my area so I can get more work , but what is stopping this guy from not giving me credit when my referrals call him , even though he is a cop. This coming saturday and sunday I have to drive 45 minutes away to meet a supervisor so he can train me for this job ..... I will make ZERO money while in training ..... so now you know my situation ... I want to start my OWN auto detailing business , I plan on going to the training and learning everything I need to know then quiting like a week later lol ..... have had BAD experience with this guy, let me tell you some thing that have happened WORD OF MOUTH advertising doesnt only happen when you do a GOOD job. he just drops us and dont even TELL us, canceled our listing, we had dropped our price by over $10,000 and he still couldnt even get ANYONE in our house to even view it. Resolved Question: Advice on cheap ways to spend nights during a road trip?

In a couple weeks time I'm going to have to make a very long drive. I can't do it all in one day so I'll have to spend the night somewhere before finishing the drive on a second day. I don't have much money so I'm looking for tips on how to pick out the cheapest hotels. I mean, like $60-$75 a night type hotels. I know I've seen signs advertising cheap hotels along interstates, but what if I'm just driving till I drop and then I need to find a motel pronto, where would be the best places to look? Or failing that, I'll sleep in my car, and would like advice on the best way to do that. Is it safer to park in a rest stop or a gas station and sleep, or would I be safer just parked on the side of a highway somewhere where there's no reason for anyone else to stop and notice me?I didn't think of camping, so thanks for mentioning it, but I don't think that'll work for me. I neither have a tent, nor would I really have room for one. My car is small and going to be packed pretty tightly as it is. more

Voting Question: Open an office - have basic questions?

I'm about to (or at least hope to) open my own office soon. I'm wanting to start small with technology, mainly a 2 or 4-line phone. My question is maybe simple, but I'm used to the in-house switchboard operated multi-lines, but I'm not in a position yet to need, nor be ready for that type of investment. My question is this: If I get either 2- or 4-line phones (probably 4 just to be expandable in the future without new equipment) and have lines hooked up to them, will I need to publish/advertise each number as an office number or can they be set up to have one "master number" that will ring the 2nd line if the main line is in use? And the same basic question for 4-line. If this can't be done with a "traditional" landline, could it be done with a VoIP system set to simulring? My second question is that office furniture is VERY expensive (at least as a startup) but also, at least in my opinion, very important since the customers first impression will be how your office looks. So, are there any places that rent/lease professional office furniture cheaply enough to make it worth not going ahead and buying it? I'm going to be in need of at least one desk for my office, a reception desk and one other desk for the front office, plus chairs for all of those, chairs for customer waiting, and customer chairs in the office(s). Also needed will be file storage, decorative/functional furnishings (bookcases/display cases/hutches), and all of that is going to cost a few months worth of earnings to buy outright - which as stated would be a huge strain initially. If anyone knows of a reputable, and cheap rental/lease company that would actually service SW Indiana it'd be appreciated (since the things I have found are Indy/St. Louis/Nashville). Other questions include how much should I budget for signing - which the space I've selected will only have door graphic signage, and a 18"x12" road sign space available if I desire. Sorry for all the questions, but I don't want to push myself into moving into my own office space if I'm going to jump in over my head. I *think* I've got the budget pretty well down - the space is $450, electric is around $50/mo, so I've got the bare basics, but if I'm going to be spending more than I'm bringing in it's not feasable. I should add I'm guaranteed $1500/mo for at least 6 months, plus my own income. But, I'm trying to budget for no more than $900 of that per month, since I've obviously got my own personal things to pay as well. I can stay in the office I have now - but I have no personal signage, and share an office building (and shared phone system) with 4 other people also making commission - so getting calls is like being a chicken in the alligator enclosure. I'm also going to have to pay $200/mo to stay there - with only a basement cubicle, and no personal phone line, no ability to set my own VM message @ my extension because the office manager is cheap and that requires the phone company to change, and drive about 60 miles/day round trip 5-6 days per week (appx $40/week in fuel + general maintenance). Obviously the private office will be a little more up front, but will save about 300 miles/week on my car, and allow for less competition over incoming calls and walk-ins. so i have a crush on this woman and we have been hanging out because we are planning an advertising campaign for an event together. I notice we get a long really well and our meetings are really sociable and drag on for hours. I have really come to like her and enjoy being around her. She's pretty down to earth and if anything romantic happened between us I'd be open to dating seriously. Anyhow, I can't tell if she likes me. We've been having meetings at my apartment and her house(she lives with her folks) and I notice that she does things around me like stroke and play with her hair, initiate touching, bump me, solid eye contact, and moving her hair and body really close when getting up and sitting down. I wasn't sure where she stood though cause she is pretty friendly and professional. so I used sensual body language and a relaxed attitude while testing her personal space a little by pretending to have excuses to get closer and she didn't seem to mind and we'd touch legs hands, shoulders etc.. I thought there was a good chance that she might be attracted to me too. But then today we just had another meeting at my apartment and she was doing those things. But I noticed she sat leaning back with her legs pointed towards me but crossed away and she was not making as much eye contact talking and her bag was between us on my couch.not good signs i know... instead of making lots of eye contact she talked while looking at some random spot in the air. I noticed this and thought I might be watching at her too intently or something so I tried not looking at her during the conversation for a while and I noticed that afterward her eye contact was pretty strong. When she left she bumped into me playfully but then i got the feeling as I walked her out to her car she was pretty much on her way instead of lingering though we did talk a bit. and then i went back out again cause we had mentioned meeting again tomorrow with another person and she was cool with it but i realized there wasnt any real reason to meet so even though i wanted to hang out it came out like i was kinda reluctant to. And when I said bye it was cool. And then when I had gone back in she called me again and I was all happy but it was just to ask for directions. Anyhow Im kinda confused. During our meeting the conversation was still very friendly and animated and stuff and she also initiated touch by touching my hand and I returned it and there were times of feeling flirty or connected and close proximity, but it seemed like she was a lot less relaxed and connected than previously. One thing to note was that todays meeting started off awkwardly on her arrival and she complained about feeling weird and being on her period. Could that have something to do with the mixed signals. I offered her some chocolate to calm her nerves a little, and over the course she got a lot more relaxed. We actually got a lot done compared to other meetings where we bullshitted and gossiped a lot more. Anyhow, I know I shouldn't waste time analyzing all the little things so much reading into every little thing, but i guess it just annoys me that I can't figure out objectively what the situation is.. I guess it might still be too early to tell either way. arg. i really don't know.. So what do you guys think? What should I do next? more

Hi, i have a few buyers interested in my car, i have advertised it myself. I just want to know how to handle the transaction correctly? What do i need to do in terms of paperwork? How do i register the car in the new owners name and sign it over properly? I have the service history and v5 (logbook), is it something to do with that? I've never done this before so as much detail as possible would be very much appreciated! Also, in terms of the road tax, do i just telephone to inform them i am no longer in possession of the car? I'm going to be staying at least from April 22nd to April 26th, possibly longer, although there is a vague possibility of checking out a day or two early if I am offered a place to stay by a relative. I DO NOT CARE if there is a layer of filth on the floor, I'm cuddling rats, and playing whack-a-mole with cockroaches. I do not care if the staff is rude. I do not care if I have to do an Olympic-worthy run through a bevy of hookers and drug dealers to get to my room. I want a bathroom (preferably with a tub), electricity, and a bed. Don't even need a tv, though I'd imagine its pretty standard. I've had pretty dark times in my past, so rest assured that such an environment wouldn't ruin my vacation at all; I'm trying to avoid sleeping in my car, because I think that would. In the past, when I've gone places, I've done internet research on motels and hotels, and always found something cheaper advertised on a sign when I got there . . . I remember once stopping in Illinois and a front desk staff member assuring me I'd find nothing cheaper than his $55 a night. At the next interstate exit, I found one for $24. In my experience the cheapest rooms are unknown motels that don't show up online, so I'm sort of interested in those. It's just me staying and I am a smoker so a smoking room is ok, but I don't smoke inside at home so a nonsmoking room is fine as well. No pets. No need for amenities. Anything within about 15 miles is good; further is also ok if its cheap enough to make up for gas. I plan to go to Disneyland or other touristy places, but the primary function of the trip is meeting long-lost family. I've found a room that is listed as $35 for weekdays and $40 for the weekends; after taxes the four-night stay comes to about $168. I know that's not bad, but I've already taken too many "little luxuries" regarding this trip. I didn't do comparative rates on my rental car at all, so I'm trying to trim the fat. Thanks. more

Resolved Question: I was involved in a motor vehicle accident with texting teens. HELP?!?

I was involved in a motor vehicle accident. The accident involved myself in my new car I had just bought several days prior and 4 young girls in the other car. The girl was driving a BMW and had (for no reason) was speeding, flew past me and cut me off without using a blinker. That had then placed me behind her once we came to a red light at a 4 way intersection. The turn signal appeared and she started to proceed forward and turn left into the inner lane. She was driving at approxiamately 10MPH. (I believe she was trying to make me upset.) Once I had gotten close to the road in which she and I were both turning on, I had went ahead and got into the right hand lane. (Outer lane)Once beside her I glanced over and couldn't help but notice she had been texting. (several girls were as well as the driver) I had sped up slightly and turned my blinker on to get into the left lane. I know I was atleast 2-3 cars lengths ahead of her when I switched lanes. (the right hand lane i was originally in was a "right only" lane, and I was proceeding forward) Once in front of the girl I believe she was trying to impress her friends or something and had sped up and proceeded to tail gate me for several seconds. She then whipped her car around into the right lane, lost control of her vehicle, started to fish tail and smacked into the passengers side of my car. My car had spun 1 or 2 times and I regained control, pulled over, turned my emergency lights on and ran to the car where the girls were. Once girl had gotten out and was (still) texting on her phone and freaking out. The authorities had came and put all the blame on me. Only one girl was injured but she was not wearing her seat belt and had been taken to the ER. All she had was a small cut to her forehead. But before I could get any information all the girls had left and the cops wouldn't tell me anything. I had asked several times for their information and they kept telling me "Just write your police report." They had refused to tell me anything and wrote me a citation for Willful and wanton disregard to public safety. Is there anyway I can justify that this wreck was not my fault? There were two cops up in my face and screaming at me and cursing at me when I was complying the entire time. They were threatening me with jail and all sorts of things when I had done nothing but comply. I had just received a phone call several days ago from an insurance company saying that the girls car had hit a bent a sign for their client's business they were advertising and told me I will be held financially responsible to an extent. I had spoke to a state patrolmen today and he thought it was ridiculous, but didnt say much besides that. So does anyone have any advice on what I could do to prove it wasn't my fault? COSTA MESA - The city of Costa Mesa has placed a moratorium on its anti-solicitation ordinance that civil rights groups say targets day laborers seeking employment on public streets. A month ago, the American Civil Liberties Union of Southern California, along with the Mexican American Legal Defense and Educational Fund and the National Day Laborer Organizing Network, filed a lawsuit on behalf of day laborers challenging the ordinance.The lawsuit alleged that the 2005 ordinance violates the day laborers First Amendment rights and bans "active solicitation" by, of or from people in moving cars and in commercial parking areas that have signs prohibiting such actions. "They know they are going to lose," said Naui Huitzilopochtli, a member of Colectivo Tonantzin, a day laborer advocacy group. "The day laborers are happy that they settled for the moment." The city of Costa Mesa has agreed to halt enforcing the ordinance pending a decision by the U.S. 9th Circuit Court of Appeal on a challenge to a similar anti-solicitation ordinance in the city of Redondo Beach, according to an ACLU release. The solicitation ordinance is designed to address conduct that creates a public safety hazard and obstructs the entrances and exits to public streets and parking lots, according to the city. The center – formerly on Placentia Avenue – opened in 1988 in response to complaints about loitering, traffic problems and unsafe conditions when laborers searched for work on streets and at parks. In September, police went to five hot spots throughout the city and arrested 12 day laborers for illegally soliciting work in three locations. The day laborers were later deported. Police Chief Christopher Shawkey said in a recent interview that police received 114 complaints from residents and business owners about day laborers intimidating customers and swarming vehicles prior to the September arrests. The day laborers were free to be in the locations if there were no violations of the ordinance, Shawkey added. He said the city has reached out to nonprofit and church groups to let them know about the guidelines of the ordinance. I had an interview with Premiere Productions Inc. for an Event and Wedding Planner position that they had advertised on Craigslist. I was interviewed by one person and she told me that I was perfect fit for the position and company which was odd to me because she hardly asked me any questions about my background and qualifications. The day after the interview I received an email and call from a man named Joshua Komer who told me that the position would require me to pay Premiere Productions Inc. $3500 to $11,000 for their training which they did not mention in their job listing or during the in person interview. Since when do you have to pay a company thousands and thousands of dollars for 12 weeks of training as a prerequisite for a job? I told him that I was looking for a legitimate job and career opportunity. I expressed my reservations and concerns about the costs associated with their training program. Joshua told me that they could assist me in taking out a loan and line of credit in my name to finance the training. He also made it a point to assure me that I wouldn't have a problem paying the loans off quickly because I would be making lots of money through various internships during the training program. If that's the case then why do I need to pay them so much money in advance and why can't they take it out of the earnings I'm going to make while I'm being trained. This fellow Joshua sounded like a used car salesman. I consulted a friend of mine who happens to be an attorney and he told me that this sounds very hokey and thinks that they're trying to convince me to take out a loan so that they get all the money up front and will be in the free and clear once I realize that Premiere Productions Inc. is a fraudulent scheme at which time the only recourse I will have is to deal with both Premiere Productions Inc. and the bank to seek financial restitution. Then Joshua proceeded to tell me that he is currently an Event Producer at Premiere Productions Inc. and was in my shoes just a few shorts months ago, but took a leap of faith and paid for their training program. If Joshua is really an Event Producer, then why is he spending all this time trying to sell honest job seekers on the hopes and false promises of their paid training program when he should be planning events and weddings as he was allegedly trained to do. I asked to speak to his supervisor and I was told that I would be contacted by a lady named Maria Cook. When Maria contacted me over the phone, I pressed her for more details regarding the training and job. I could not get a straight answer out of her regarding how I was going to get paid while enrolled in the training program. Although that didn't prevent her from trying to coax me into trying to sign a contract to pay them $11,000. When I told Joshua and Maria that I would not be signing up for their training program they got very hostile and angry. In addition I kept receiving hostile and harassing emails from them for several days. Is it me or is their job posting for Event and Wedding Planners a good ole bait and switch tactic to get people to pay money to get training for placement into a non-existent job? I put a $1500 deposit on a car. No financing papers have been signed because the car dealership doesnt have the title yet. I want to back out because the dealership said the sticker price was the lowest advertised and I found the car online on their site for $1000 less! Can I do this and get all of my money back? I live in MA.I guess Im wondering because I only put the deposit down 3 hours ago (unfortunately, they are now closed). Also, was it even legal for them to sell it to me if they dont have the title?NOTE: I have not left with the car. I still do not have the car. Resolved Question: tenants rights in pa and snow removal?

I have a balcony type deal that has stairs that lead to the parking lot. Due to the poor maintenance of the gutter above the stairs one set of stair becomes a solid sheet of ice. The lease that I had signed stated that it was the owner of the building that is responsible for all snow and ice removal. However they claim that the back stairs are only to be used as a fire escape, but the advertise it as having an exit to use. Also the parking lot that I have has only been plowed one and not the whole way plowed (considering that there is at least 16 inches of snow on the ground) and I had to dig my car out of the snow. Since I have signed a lease that stated that the owner will remove all the snow from the property is it my responsibility to remove the snow from around my car and the 5 to 10 inches of ice from the back stairs?the land lord also owns the parking lot more

I work at a restaurant and I was assigned to spread menus around our area. I come upon a ghetto apartment, started putting menus on some cars, until two elderly females with nothing better to do than knit, blocking stairs with their thighs of cellulite and waiting for their inevitable death shouted "No! Uh-Uh (wags finger left and right)" at my attempt to place a menu on a car. I waited maybe 5 seconds to see what else I can dish out of their disrespectful communication. I responded with "Don't you have anything better to do?". One of the grannies replied, "I'm watching you! I'm preventing you from 'destroying' other cars and there's a sign up front that says 'no soliciting'. To ease the tension, I decided to stop and leave before their blood pressure rises or get a heart attack. Resolved Question: Can a auto repair shop hold my car for pmt if they didn't disclose the type and amt of the diagnostic test?

I had my car towed to a repair shop in Chicago (87th Cottage Grove) by AAA around 1/13/2010. The car had sat a week in the 1st heavy snow of the year. After the car was taken off of the tow truck, I put the key in the ignition, and it started. I put my keys along with a detailed letter about what was wrong with the car, in the night drop box. I had called the shop that day and talked to the desk clerk, who instructed me where to leave the keys. I decided to leave a detailed letter explaining what was wrong. I kept a copy of the letter. I had used the repair shop before for an oil change, so they had my contact information, in addition to my contact info on the letter. They have a sign in the window saying a diagnostic test costs $39.99. I called for 3 days, asking when the car would be checked out. They finally checked the car out and told me that the problem was the motor. They told me another motor would cost $1,800. Or they said I would have to pay $100.00 for the diagnostic test, which is $60.00 more than the sign says in the window. I never signed anything, and now they say I have to pay storage charges, in addition to the $100.00 for the test. I'm willing to pay the $39.99 price for the test as advertised in the window, so AAA can tow my car to my home. What can I do?My point is about disclosure. Just like with my job as an Income Tax Preparer, our industry has all types of disclosures we must give to the customer (finance charge, filing options, etc). Whatever test they were going to perform, they should have explained it to me, along with the cost. --given me an option.They told me I wouldn't even get $70.00 for my 1995 chevy Lumina, but they were willing to take the car off of my hands, if I had the title. Ok, my dad is 50, a white male, married to my Asian mom, and he lives in a place where I used to live with with my sister two years ago before he separated with my mother. The home he lives in is in an upper-class area in a poor area of the town (we live in CA). My dad's an awesome guy, but he's had problems with these Latino neighbors, one of them named Gabe, who were involved in some drug distribution before, etc. They always have like 10 cars at their house, which makes it seem like it's a crackhouse. Right, this idea has been playing on me for a while, i'm a big photoshop user and come up with some great designs, i also have hand drawn images thrown my way to use every so often. My idea is to set up a T shirt printing business but selling my own stock of t shirts and hooded tops (zip up and pullover) and on the side line doing custom orders. Heat Transfer, Vinyl Printing and Screen Printing...Which one is best, for business? Also saying buy whole stock i buy a t shirt at £1.00 would selling them for £15.00 each be ok? and buying a hodded top for 3.50 and selling them for £18.00 is that a good price? I know i will need some capital to buy stock and printing equipment as well as setting up a website. I do have a long term plan which includes a lot of promoting incl' Car shows, fashion shows, word of mouth, leaflets also self advertising ( wearing a t shirt which company contact info ) as well as having my car carrying signs about the company. My ideal annual turnover is £248.725 with the wholesale costs, promoting costs, web hosting and printing costs deducted. How come tax would be taking off? We went to purchase a car (2004 Chrysler Sebring) after seeing it advertised online for $6700. Drove the car, loved it. Put $2500 down anticipating low monthly payment for about 3 years. I read the contract before signing which put the purchase price for $9175. They then tell me that the internet price was actually the price minus the down payment ie the amount financed. The actual price was over $9000. The said there was a disclaimer on the page. The disclaimer read something like the "internet price" represents the price when paid in cash in full. I said well I can pay in cash and we will not finance. They balked at that. I walked away. Has anyone every heard of tactic like that. Just curious. And this was a large dealership.... more

Voting Question: Auto Interest rates?...broad I know, I'm looking for a general idea of what to expect.?

I am buying a new car looking to finance about $11,000. I had my credit run at a dealership just to see if I would qualify...they denied my request saying that I have good credit but not enough history and that I would require a co-signer. My parents will co-sign, both have excellent credit. My question is what kind of rate should I expect? The average rate in my zip code for a 48 mo. new car loan is 6.78%. The lowest available advertised I've seen is about 4.75%. Should I expect something around the low (4.75) the middle (6.78) or the high (7+)? Am I in any kind of position to argue for a better rate if a high one is offered considering my co-signer vs my credit worthiness? more

Ok last year when my Benz needed the brakes done, I drove up to all the nearby garages first since stopping was a serious concern as my brakes were 80% gone they said. I saw a garage with a big sign in their window that said they "Service ALL cars, domestic AND import". Taking this as a good signal I walk into that place and ask them if they would work on the brakes for my Mercedes and the mechanic behind the counter frantically shook his head and said "No!" He looked visibly freaked out at my asking and totally shaken up at my question. You would think I waved a severed head in front of him. I later took my car to a Goodyear and they fixed the brakes awesomely with OEM Benz parts and the car has been stopping great ever since. Now why if the guy said they worked on all cars they couldn't do Mercedes brakes? Last time I checked the Mercedes is also a kind of car so why would they balk? It was them who brought it on themselves by saying they worked on all cars...oklatom, I wasn't there to talk to the mechanic, I was there to (hopefully) get my brakes fixed, when he said no I just took off in search of a place that knew how to do it.Sharp Shooter, that is my point! All cars being more or less the same in that they all have similar parts and components, what on earth would make them balk at working on my car? more
