Open Question: Did the car seller break English contract law?
I agreed to buy, from a private seller, an internet-advertised car without seeing it, and after a short haggle had a verbal "virtual handshake" with the seller over the phone. I made him aware that the funds I needed to buy the car were already on their way, having been ordered before I saw the car ad, and would arrive soon. I phoned him twice to say the money hadn't arrived yet, and asked/told him not to sell the car to anyone else. He replied, "Don't worry, Ed". That was Friday evening. On Saturday morning he said he was sorry but he'd sold it to someone who turned up with the cash. My funds arrived the next working day. I tried to put this behind me nut the car was absolutely ideal for my purpose and I can't find another one as perfect. I learned today the car is still at his house until Saturday when the buyer will come to collect it. This set me thinking and I feel I have been wronged by a Breach of Contract under English law. I read the Wikipedia entry on "English contract law" and it seems to back up my gut feeling. What should I do next. I really want that car at the price we agreed. The seller in question is a banker who obviously isn't poor and is well educated and intelligent.I twice offered to pay a deposit "to show my good faith" but he didn't take me up on it. This lead me to believe he trusted me to follow through, so I was surprised at what happened.I don't really want to going suing him, I just want to know if I have the law on my side. I am asking if i can sue my college, It is a private college, It is called Fortis College its in Ravenna, Ohio. I am going there for welding. The reason i ask if i can sue them is because, I think i am being taken advantage of, #1. The college is understaffed there are currently 2 instructors there. that teach around 50-55 students in the welding course. the night class has about 25-30 students with 2 teachers, Also There are 5 diffrent classes in the night classes. each one is in a different semester/mod. #2 So there are 2 teachers teaching 5 different things to 5 different classes. On top of this, since there are only 2 teachers we are all in the shop. at one given time. and the shop is about the equivalent to a two car garage. Which most of the space is taken up by about 10 Stick/tig and mig machines plus a 4 person burning table, and around 4-5 two full sized cylinder carts of oxygen and acetylene, there is also a horizontal ban saw, and table mounted grinding wheels on a table that is approximatively 12x12 feet. #3. the course i am taking was falsely advertised, they promised things that they are unable to teach such as a 6G certification. I have People that were also promised the same thing. With all that being said, i want to sue for (#1) inadequate learning environment, (#2) unSafe Learning environment (over populated in such a small space) And (#3) False advertisement. What i want in return is the return of my tuition in full, and some money compensating my time wasted. I'm not talking the channels that get rented out and only show commercials (Dish network does that with some of their extra channels) I'm talking channels that have been on for years. The most boring channel I can think of is Animal Planet because my sister has watches that stupid "Big Cat Dairy" show, she's watched about every episode about 20 times and I'm getting sick of looking at these stupid cats walking around in Africa all the episodes are the same just stupid cats walking around and boring stuff and "Meer kat manor" was the same thing but they wasted alot of money advertising for a show that didn't get much views its really her fault I hate the channel, most of the time when I'm at home I can leave and go to another room most of the time but if its raining at a motel and she has the retarded channel on I can't go anywhere to get away from it. Why do all their documentary shows take place in Africa too? is it because the animals there ain't scared of cars and people and it's flat and easy to film there? I haven't learned anything off that channel in about 7 years why can't they film animals that live in North Amica? Hey Yahoo! users! How effective do you think it would be to use a 2010 Chevy Camaro for advertisement purposes? My beef with traditional TV commercials is that so many people record shows and fast-forward through commercials, or just change channels when commercials come on. So, companies are spending money on advertisements that aren't even being seen! But what if the advertisement was presented in a way that people *wanted* to look at it, i.e. a flashy car such as a Camaro? I myself always gawk when I see a Camaro on the road or in a parking lot, and as far as I can tell, so does pretty much every other guy (and some girls). To me, it seems like the Camaro would be a perfect means for advertisements. People already look at the car, so painting it in corporate colors and using catchy slogans would expose the company to many people. Plus, the Camaro is cheap (relatively) compared to commercials: 30,000 compared to (potentially) millions. Anyways, that's my thoughts on the matter? What do YOU think? We all know it's all about the money. But nevertheless the top paid Bollywood actors have amassed colossal fortunes having played their roles in countless movies. You'd think some reserve, modesty, pride and ego should be kicking in as a restraint. But no, from cookies to cars they accept anything you throw at them. Since our beloved Star Trek Experience has been bound up in red tape and politics for what seems to be a life time. I was doing some very hard thinking about the past and how our forefathers and mothers dealt with such issues as we have here with our predicament. Back in the days of the original series a serious letter writing campaign helped change the minds and hearts of the huge producers and well... the rest is history as they say. But in these precarious times we have seen letter writing campaigns not work, neither does petitions or vocal oppositions. I have seen this countless times in government and in the public sectors where the ones in “control” don't care or respect what us people in the “under class” thinks or wishes it is only about the money that they can squeeze from us! So how do we make a difference? WE the people have to step up and MAKE the difference. Here is my idea , all of us (us being every Star Trekker /Trekkie or any name we go by) chip in and WE build the Experience ourselves. Hear me out before you shoot me down with cat calls and laughter. . In these days when all the news is bad and depressing we would be a ray of sunshine, a place to go for hope for the future. Of course have fun all the way! And if done right make some money along the way. Here is my ideas 1.Every fan chips in $1000.00 Think about it if we get 1000 people to contribute $1000.00 that is 1 million dollars! A million that can buy a large building that can hold a lot of people, displays, rides etc. Of course we will not be in prominent places like the strip in Vegas but more like an empty strip mall or ware house with access to transit and car traffic. Basicly we would rebuild the Experience! But with one big difference WE would be in control of OUR future. I know this is a lot of cash for a lot of us, me included, but those who contribute will then be held as presidents meaning they will be helping make the choices in the beginning, until we set up elections and promotions then everyone is elected into office of Presidents, Admirals, Captains. Each rank responsible for different areas of the Experience. Like accounting, engineering, promotions, etc. More money contributed the higher the rank till elections occur. After set up then we disband and the elections happen with ALL ranks voting so that way everyone has a chance to be anything they want to be and not a place for the rich to buy their way in. Other words you have to work hard to get to the top and not buy your way into the position. Now if one can not afford to contribute there is lots for you to do, you can do sweat equity into the Experience, think about it this way, everyone out there is doing things for a living right? You are all electricians, plumbers, accountants, cooks, etc. So there is our construction crew, and book keeping and different labour sectors. After a set number of hours of volunteering you get your rank into the Experience depending on the number of hours, you put in, the higher the rank. So everyone can move up higher in rank the harder they work until officer rank then you have to be elected. Everyone including the ones that contributed money has to work in the Experience a set amount of hours per month every year to keep their rank active and keep there shares. And this is the beauty of the thing everyone can do something from grunt work to office work to even blogging. There is work for everyone with every physical ability. You can work anywhere in the world, all you have to do is something for the Experience to grow and prosper, for instance you can set up advertising for us on the internet and on local TV, as well as spread the word of us by word of mouth, maintain a web page for us etc etc. The first few years we would need a steady flow of cadets coming into the Experience to make this work, and at this stage of human evolution money as well. We will need to constantly have fund raising actives. As well as contributions from all our new and old members. All money will be transparent and everyone from Presidents to the lowest crew-member can see the books and help dictate where the money goes. As well as what the Experience will look like and where we will go in the future. By way of monthly meetings and online votes and polls. And every crew member that is active will have a share in the Experience depending on rank and years into the project. 2. Now here is the hardest part of all !! Getting Paramount to give us the right to use the images and insignia of Star Trek and all its parts. Basicly getting a licence to use the name!! This will be the hardest part of all, they will be hesitant and unwilling to share. As was the case in Vegas, they just kept bickering till nothing had a ghost of a chance to work. My family member bought car they found on ebay. They did not complete the purchase through ebay since it was local. The ad states that the car is in good condition. The owner started the car up, it sounded good and did disclose that the heat does not work and it had not been driven since last year. Since it had no current tags they did not test drive it and towed it home. After driving it around the block at home they found the speedometer does not work and it overheated. The seller states that he knew nothing and "can't help that". It has been a matter of hours. You start school at 5, and finish at 20, which will be the legal age. Drugs that are psychoactive are illegal. Weapons are banned from people who aren't police, or in the military. We have a powerful military, so war can be avoided at all costs. People can drive cars at 20. People can marry whoever they want, and can marry as many people as they want (any dislike of polygamy is cultural, but since this is a new country, it can have a new culture.) Minimum wage will be 1/5th of maximum wage. People can eat anything that is edible except other people (any dislike of the consumption of things like horses, dogs, cats is only cultural.) Animals must be killed humanely. This includes a bullet to the head, or a quick decapitation. Knives and CO2 will not be used. Government isn't done the same way. There will be people who study the economy under one branch, there will be people who make ethical decisions, and there will be people who will make decisions regarding foreign relations on the last. Each branch will have 100 (congresspeople) to run it. People can say what they want if it isn't threatening, hateful, or discriminatory. People are allowed to criticize the government. Currency will only be used to purchase amenities like vacation, cars, games, toys, homes, etc. Everyone who works will have access to medical care, and food. Only people who have proven themselves as highly intelligent, competent, and wise will get into government branches. They will have one term, and will serve for one year. People who commit serious crimes (this includes murder, abuse, and treason) will be banished to a second island for criminals. They will be separated from the island of people who won't work, so they aren't hurt or killed. People who commit minor misdemeanors will first be given warnings, their second act will be considered, and a punishment will be decided. People are innocent until PROVEN guilty. Circumstantial evidence isn't enough. Corporations that spread lies through advertisement will not be allowed to advertise, judging by the severity of what they did. A public service announcement will air, saying that their claims are invalid. There will be extensive food regulation, so people cannot make crappy products and lie about it. People put way too much trust in advertising. I mean, how can you be so stupid as to not realize a gymic or a clever ploy when they see one? For example, all those car insurance ads that state "people that switched to (insert company name here) saved an average of $300." Most people think, "wow, that's a lot of money to save. I could save that much too if i switched," but logic says "well no duh. people aren't going to switch companies if they aren't going to save, therefore that statistic has no significance." There are things like this in advertising ALL THE TIME. Hi everyone, id like to describe my current situation which is probably all too familiar to most of you I come from a lower(working) class family in England. Im a 17 year old guy studying A levels, living with two younger sisters and my parents in a rented house. As with many families in at the moment we are X thousand pounds in debt, im not sure of the exact number and it isn't really important. i see a lot of advertisements on the TV advertising 'get out of debt solutions.' i have to say resorting to one of those campaigns really isn't something i want to do. i do not plan to earn a lot of money in my life, im focusing instead on Karate and my study of Philosophy, both of which i am very passionate about. to me those to subjects are far more important than making money, however it is clear that most of us will have some money problems at some point, so i ask for any tips you can give me to avoid getting in debt in the first place and owing money to anyone, i don't want to end up in the same situation as so many others. as it stands at the moment, i try to keep my personal costs as low as possible, i do not own a car, i use public transport and ride a bike-that's a few thousand per year off already. i also rarely eat out, go to expensive social places, i don't drink/smoke/gamble ect for various reasons. so yeah that's me, apologies for the length but are there any other tips you give me to avoid debt? thanks in advance moreResolved Question: second hand cars please help i have an issue?

I saw what I thought was a good deal on Craigslist. A lot of items typically resold on ebay for $500. This type of lot is not uncommon on Craigslist. As an experienced ebay seller, I could have made about $1500 on this lot. I got ahold of the Craigslist poster, and he promised the lot to me for $500. I told him I could come over immediately, and he said that he was unavailable, but that he could meet 5 days later. I was in a situation where that day/time did not work out for me, but I changed my schedule so that I could drive the one hour trip to meet him. We conversed several times over the next 5 days, verifying that he was going to meet me and sell me the lot. When the day came, literally as I was in the car leaving to get to him, he called and told me the price has changed to $1250 and if I wanted the advertised and agreed to lot for $500 lot, I'd have to pony up double the money. Is this legal? We had a verbal contract. Can I sue him for bait and switch? It costs $31 to bring him to small claims court. FYI: I live in India. Please Note: I am neither Racist nor Casteist. But I am person with several genuine problems and absolute bewilderment. I am website designer, and I have extremely good communication skills. I rate myself as a very good at civic sense and social manner awareness. I am trying to run my small family (4, including myself) with the earnings out of my shoestring business. I am always polite to my clients, I make sure they are comfortable with every technical aspect of their website, I make sure the site is Standards Compliant for the client's sake, despite them not even knowing what W3C Standards are. I try to keep my prices as comfortable as possible, and relatively low. Yes, I am somewhat more expensive than the general market, but the cost of having an unruly, brutal joke of a messy website "design" is more than the price of owning a good website. Also, I never spit on the road, refuse to relieve myself on the pavements like so many other people do despite desperate urgency, always say "excuse me" before I do anything remotely assertive. I respect women, pay my taxes on time. Despite all this, I barely manage to scrape by, financially speaking. I am usually at the mercy of my landlord, and begging all the people I owe money to, to wait "just a few more days". Then, I get a small respite in the form of a new client or two, and I am forced to spend all the money on my commitments. This basically leaves no chance for me to improve upon my life, or the conditions therein. I am always stuck in this vicious cycle of debt and repayment. Add to my woes is the fact that we as a family have no source of support from our relatives, and hence zero investment capability; I can't even afford to advertise my services in the local newspaper classifieds. I am forced to rely on the poorly maintained and extremely unreliable public transport system, since I don't have a vehicle. Yet, I do try to work hard, against all odds. CONTRAST THIS WITH THE FOLLOWING: All I have to do is to take a short walk onto the main road, and I see multiple swanky cars on the road. In a majority of these expensive vehicles, there are people who are unruly, wear arrogant looks on their faces, and drive like shit. A lot of them don't look educated (you can tell the difference, though it sounds preposterous). They don't hesitate to pull down the window and spit copious paan onto the roads. They don't hesitate to open up their fly and start spewing on to the footpath, even in the presence of women on the road. They wear large chunky jewellery on their sweaty unhygienic bodies (trying to demonstrate their wealth), but display the social sense of a bacterium. WHAT THE HELL IS GOING ON! How is this happening? Its quite complicated - Firstly - We have been together for about five years. He has his own business so I bought a house which is in my name. We agreed to do this in case his business folded and i wouldnt lose the house. Anyway - he does F@@k all to help me in the house - No help with DIY, no help with cleaning or maintenance. When i ask him why he says Its not his house so hes not intrested!!!! I feel really crap - he keeps throwing in my face even though it was his idea. He has a flat above his business and sometimes he still stays there, esp if we have an argument he just goes back there. Because of this set up he wont help me pay any bills on the house. He stays up till 3 in the morning using electricity. He gave me a credit card a while ago but im not allowed to use it so i have given it back to him. I dont know what to do - I work for him and I get a small amount of money for doing this but its not enough to live on at all. I have a son to support and my bf is just not helping. To top this off - I said to him I really dont know I can financially go on and am looking for another job. I joked about becoming an escort and he said he found that really horny. So horny in fact he nagged and nagged me to join an agency. Then because i joined he did too. That same day they said they had a booking for him - it made me feel sick. For everyone, the body has either very little or zero tolerance to alcohol. When alcohol is overused, the mind loses its ability to make good quality decisions and the organs of the human body get wounded. This can result in many bodily illnesses, diseased, and perhaps cancer that all can cause death and a miserable life. The inability to make good quality decisions can also cause many troubles ranging from the inability to maintain a relationship to being the cause of a car collision from driving under the influence. Furthermore, the use of these commercials is also advertising a substance that can cause a financial crisis. Alcohol becomes addictive to many people because it brings the mind to a relaxed state temporarily relieving stress, anxiety, and more. Overtime, as more alcohol is being consumed by the human body, the human body is building tolerance to the alcohol. When the body is building tolerance to the alcohol, the body is required to have more alcohol in order to enter the relaxed state that had been previously experience and in order to consume more alcohol, more money will need to be thrown away. This church advertises on the net asking people to donate money to help the needy. I will tell you who the needy are. It is run by Rev Dr Leslie Mary Trombly who has a lovely lifestyle in USA. She goes without nothing. Her hobby is running the church from her wheelchair online. It makes her feel important. Under her we have Abp Paul Baker, an old man now, married with kids and grandkids. He supposedly sorts out the money and gives it to those who need it etc. But this is what we found out about him, and all of this is proven. You can read an article about it. Sunday People newspaper, UK. Very Bad Men and other tv programmes are thinking of making a programme about this guy. His last church threw him out because of "money discrepancies". He has borowed huge sums of money from parishioners and others. One lent him £8000 and then he nagged her to lend him another £7000 which she refused. Most people have to work a year to earn this. This guy then insists that he is sorry but he cannot pay it back and pleads poverty. Yet in the meantime he has about 5 holidays a year, long expensive ones, buys cars, bought a boat, joined the golf club, and takes his family out for very expensive evenings. In other words the people who lend him money end up paying for his luxuries and lifestyle. Other churches in his area refused to deal with him because he didnt pay his bills or over charged. Other jobs he had always sacked him. He is almost bankrupt and owes the bank a great deal. Yet he continues to spend a lot. Usually other peoples money, which they think he will pay back, but he never does. Although this man is married with kids and grandkids and very old now, he also pesters women at the church for sex !! He told one much younger single woman that he loved her and wanted to marry her. He bought her an engagement ring, got officially engaged to her (forgetting to tell his wife). He also virtually moved in with her, making out to his wife that he had to work very long hours and that is why he was rarely at home. He did this for EIGHT YEARS and it only ended when the girlfriend ended it, it would still be going on now otherwise. He became so loathed and distrusted where he lived, and his wife knew that she was an outcast in the town, and she was scared that if they stayed he would keep pestering this woman to see him again. So they had to move a long way away. The church knows all this, yet they are happy to keep him. Happy for parishioners to trust him with their money and their lives. I have a grandma who is getting old and a very forgetful. My dad and my uncle (his brother) have been tense with each other after my dad found a bunch of checks addressed to my cousin who is in her 20's. She claims its for my grandmother's groceries, but each check is about $300 every other week. My grandma says she gives her the money because she's got two kids to raise and she's going through nursing school. What she likes to forget is that my cousin got pregnant at 16 and then again when she was 19, both to her then boyfriend, now husband. In my eyes this doesn't give her the right to collect money from my grandma, but that isn't the worst thing. My grandma has asked for my dad's help to sell her car since she can no longer drive. My dad claims that the car was promised to me (I'm 15) when i got my license. My grandma admits that but says she at least wants some money. We offered to pay $2000 for the car, which she agreed upon, then decided against, saying it wasn't enough. We don't have tons of extra money so we declined her offer of $3000. About a week and a half later, she asked my dad to put a sign on her car, advertising it for sale at $2000. My dad asked her why is it back at $2000 when she had said that was too little an amount. She says she knows that but she wants my cousin (as mentioned before) to be able to afford it since she has no cash flow. That is a lie since my cousin is out of college and working as a nurse, plus her weekly withdrawls from my grandma's bank account. That is the point where my dad somewhat lost it. I listed my car on Cars.com and I received a call [from an Unknown number] from a company called 'AutoMarketingGroup' who has been calling me claiming to have a 'client' who wants to buy my car and it sounds as if they are the 'middleman' or the financing company, maybe both. Of course they are trying to polish the deal and make it sound really good and sweet talk me and then as expected, wham! They ask for a Visa/Mastercard for a $500 in "advertising/profile/securities fee" that I am guaranteed to get 100%back. I tell them I will call right back and do some research. I haven't been able to find out definitively whether this company is a scam or not so I called them back and told them I wouldn't be dealing with their company and not to waste their breath. The 'finance manager' says he will take $250 instead and I request a contract be emailed to me. Wouldn't you think if they were legit they would send it FIRST, before taking a credit card? I know it sounds bad and I am very wary of Scammers. I don't want to be naive but even though these guys sound shady maybe there is still a deal to be worked out here? I've tried suicide, didn't work out so well. Since I can remember I have felt uncomfortable around people. Exspecialy large crowds or small children. Thoughts like : I hate this ****, these people myself over n over. I start visualizing killing others. Shoving my ring into thier eye socket twist n rip. Shove pen into jugular. Getting anything as a weapon. These thoughts run through my brain till I can't even hold my pencil without breaking it. Has anyone ever sold or bought a car from One Stop Motors? or even heard of them? I placed an add for my car on ebay and within 3 days One Stop Motors contacted me saying they could advertise and get my car sold for $499 non-refundable for more than what I was asking, that they would continue to advertise it until it was sold, and it would come up on the top 3 of any search engine. However, being skeptical I said sure if you could mail or email me a list of the services and advertisement sites you plan on using that you just described to me over the phone.... well that's when all hell broke loose.... and they had me check out their website and read their blanket agreement online and do everything but send me a contract or description of exactly where, how long, and how many websites / ads they planned on marketing my vehicle. The only way they would divulge that information was in an invoice that I would get only after I paid them my $499 non-refundable. They just seemed shady especially if they do not offer their to-be customers with a solid assurance of where their money is going to be used towards and it is non-refundable. Hi long story short. We just moved from British Columbia to Toronto area, because i had my daughter and wanted to be closer to my family. My boyfriend was a professional painter in BC for years. As we moved to a slightly high class area where people `have money,` we thought that him opening up a painting company was fool proof and would take off immidiatley. NOW we are having trouble paying rent and buying food, with another baby due in 2 months and don`t know what else to do to advertise. There is NOT to much competition at all in this town. He did get a few small jobs from my dads friends in the area but it is not enough. The things we have done to advertise are: Flyers and magnetic cards on mail boxes as they are the multi ,ail boxes one for each street. Put a add in the local paper. Handed in cards to the local paint store. Got magnets to advertise on the side if the car. Drove around and looked for homes that needed painting and knocked on there doors to hand them a card. We still get no calls to quote. With the flyers we put up there are at least 5 of the phone number tabs riped off each one and we placed about 100 around town. What more can we do we just dont understand. more
