Open Question: Can companies refund something you bought from them and then increase the price?
I placed an order for some floor tiles online, payed £106 for them but the next day I received an email saying it had been refunded. After looking at there site they had increased the price from £14 to £56. Are company's allowed to do this under UK law or the consumer goods act? Ok well in the recent past, I've been receiving phone calls from companies/corps/etc about advertising or winning some prize/gift. But the issue is that i never signed up for anything of the sort because I'm skeptical about winning online gift. Anyway every single contact on the phone stated my information correctly except for the Email. The email belonged to my ex-friend and i believe he is using my identity to sign up to ridiculous stuff. What can i do about these phone calls and my ex-friend? can he be charged with identity theft or anything? My situation is, I have an online shop at Etsy.com where I sell a particular handcrafted item. I will not link to the items, or say exactly what they are but what I will say is that with these items there isn't a situation where it's just a coincidence that someone happened to create the same product. With that said, I have a problem where there is another shop at Etsy who has replicated over 3/4th of my products. There are several sellers who sell the same products, and that's wonderful. But what flags a unique situation in this case is that this lady copies my exact design, my exact materials, my exact ideas, and then adds or subtracts one minor detail. I've contacted Etsy to see what it is that I could do. I would like this to stop, and I would like to peacefully sell my own items without having to worry about this lady duplicating everything I've created. I'd also like to mention that I am not the only one she does this to. She's done it to at least five others who sell the same products as us, but those have been removed. I'm very unfamiliar with copyright laws. Is there any law that even pertains to this particular situation? I have an idea for a law that would require online sellers to collect/pay tax, even when selling to customers in other states, but at a rate that is determined by how much spam there is advertising the business. For example, the law could be that for every 10,000 pieces of spam that advertise a website, there is an additional 1% tax on its sales or income. This would bring in money to the government without affected business that do not use spam. As an added benefit, (a) if the company had to pay the tax, it would send less spam, to keep down its tax cost, and (b) if the customers paid the tax, then they would avoid buying from the websites that were forced to charge high sales tax rates, so sending spam would result in fewer customers, not more, and websites would stop. Because this would official be a tax on the transaction between the customer and the website, not a fine or even a tax on the spam, it would not be necessary to prove that the company was responsible for the spam. The tax would simply be a tax on income/sales of any website that was advertised through spam, whether sent by e-mail or posted on Yahoo! Answers.It seems appropriate that the first answer to this question is spam that would subject a company to this tax. I purchased a game from an online shop. The game does not run sufficiently on my PC - not due to me not meeting requirements, but apparently the game isn't compatible with certain graphics drivers which is not advertised anywhere. I only discovered this issue with the game after i activated it, which you have to do to play it. The shop i bought it from said they cannot offer a refund because i activated it, but should go to the company that made the game. As far as i am concerned, my contract is with the shop because i bought the game from them and they took my money. It is there obligation to take it up with the game producers because they have a contract with them to sell the game. I run a few businesses in the UK, however one of my companies sources and wholesales 'grey market' designerware and footwear from manufacterers mainly in China and Italy to clients across Europe. I run and advertise this business completley online, even though the distribution of grey market products is legal under EU law. I still receive legal threats from brand companies even though the products were manufactered under licence, under my agreements with my suppliers I can not disclose the origin of the goods to brand companies to prove authenticity. Any advice on making this a completely anonymous operation through using an offshore bank account and web hosting. I in no way plan on evading UK taxes however I do not wish to be harrassed by large companies even though I tell them to shove it anyway. I personally think NDP is playing dirty politics, they have to come up clear on this tax... All I can find is information about laws regarding importing from Canada to the US... I live in Canada, and am suffering from EXTREME insomnia, and have only recently found out that all of the good sleep aids that are advertised, and sold in the US are not available in Canada. All we have is Temazapam and this stuff that makes you slightly tired, and makes everything taste like metal... Ambien and Sonata are approved for sale in Canada, it's just not sold... Sonata (or Starnoc, as it was here) was taken off the market in 2006 because Canada wasn't a big enough market for the company... Anyways... My doctor has wrote me four different prescriptions in the past few weeks for things I can't even pronounce, so getting a prescription shouldn't be a problem... I figure if it's approved in Canada, and there are distributors selling it online (only), why would there be any legal problems? --- Oh, and would my insurance cover it the same way they would if I just went to a regular pharmacy? This post is not some sort of cheap attempt to get a measly few more views on my site from this community. I genuinely want your ideas on my situation. My situation (A new beginning): I just started an IT business a few months ago on the Gold Coast (IT Support, Web design, Computer repair, Computer sales etc). I went all out and QUIT MY JOB to make this happen. Most of my available funds and time have gone in to equipment, general setup (server, web site, some starter clients). I have a couple of refered clients (from friends and family) but not nearly enough to cover my old wage as an Network Administrator. Dilemma (The news): Soon after Quitting my job to start this business I found out I AM GOING TO BE A DAD! Great news...! I am ecstatic! but fearful at the same time because of my situation. My wife will soon be unable to work and I will need to support the family myself. Doing the sums, I figure that unless my business makes an extra 10k in the next 2 months (to cover some financing etc) I will have to give up on the Business and look for work. That would not be a good option as it is hard to find a good salary in IT on the Gold Coast to cover living expenses for Me, My wife, My Mother in-law (living with us) and a new born due in in a few months. So you see, my business MUST WORK! I have no other option. About 5 - 10 new steady clients would do it, but how?! Here is the 10-point program that I propose: 1) These health-related magazine subscriptions [produced and distributed through private corporations -- thus we avoid the appearance of nationalized health care] would be made available in "public exchanges" online. 2) The magazines and their editorial policies would be thoroughly reviewed by federally-certified doctors to make sure they promote federally-approved drugs, therapies, and surgeries. 3) A primary aim of the program is to reach those people who currently lack health-magazine subscriptions. [The aim of this program is not to increase the profits of privately-owned health-magazine corporations and their corporate advertising clients.] 4) This program cannot really work efficiently unless all participate, that's why it must be a mandatory program. The price of health-magazine subscriptions has risen dramatically, because too many people are getting sick, and not enough healthy people are buying them. 5) This program would help slow the rising costs of health-magazine subscriptions, and who knows, could eventually even bring down the costs of health-magazine subscriptions. However, this program would require people to buy a scubscription at whatever the free-market prices are. [OK, perhaps technically that last bit should read be "enhanced free-market" prices.] 6) Forced buyers of low income would be federally-subsidized, and... 7) the best way to pay for this program would be to tax the people who have been the most successful. Since these people already have easy-access to health-magazine-subscriptions, they shouldn't mind helping to provide others with similar subscriptions. 8) This program would over time reduce the national deficit, because expert government accountants have done the projections, and that's what the projections show. 9) If people were forced to spend money as soon as the law were passed, they might not see the program in a balanced way -- so the forced-purchase part would only kick in about 4 years later (well beyond the next presidential election in 2012). 10) However, many of the taxes implemented by this program would kick in immediately. This reform would not be socialism or fascism, as long as constitutionally-elected and legally-lobbied representatives voted it into law. I purchased a 2004 Santa Fe from a used car lot. When I bought it, I believed it was an LX trim, with a 3.5 liter engine... as per the online ad on their website and on auto trader. However, I found out after purchasing it that it is the GLS Trim model, with a 2.7 liter engine. On kelly blue book the difference in value between the vehicles is: the GLS model is worth roughly 10% less than the model I thought I was purchasing. Now, the bill of sale does not list a trim. Just the make and model. However, I have a print out of both adverts, both with a picture of the car I bought, stating the 'false' specs. Is this enough to prove false advertising? I would ask for my money back, but I spent $75 registering the vehicle and $275 buying tires for it. I would need to be reimbursed for those costs should he offer a return. I have a mini-fridge which I need to secure shut. It's going to contain dangerous medication. The law requires it to be under lock and key, and I require it to be chilled. Many years ago I noticed my uncle had put a simple door latch and padlock on his fridge with normal wood screws, but I'm not sure about doing that. I don't mind if it works a little less well, but I don't want to risk completely breaking the fridge. I see advertised online adhesive fixed locks, but I'm not sure how strong they are. Aren't they just made to deter toddlers? I understand that without spending thousands, a grown adult will always be able to get through, but would this be strong enough that without a crow-bar or bolt it won't come off. Would an adult be able to simply tug it off by hand, or lever it away from the adhesive with a flat head screw driver? It needs to be stronger than that. A co-worker of my husbands (who I have never met in person) has decided to post pictures of my child (who is a minor) to her facebook account. I wrote her a message asking her to remove the picture because I do not feel safe with someone I don't know posting pictures of my child on the internet. One reason being I cannot control who sees the picture, she has a public profile and anyone in the world who wants to see the picture can. Another reason is that she listed the first and last name of my husband on the picture so they now have my child's last name. When I asked her to remove the picture out of respect for a parents wishes she refused and became hostile. I don't believe in posting pictures of children on the internet for their safety. Isn't it the right of the parent to decide whether or not their child can be plastered on the internet? There is a huge safety loop hole that facebook uses where they can take your pictures posted and sell them to advertising companies, so now not only can she post pictures of my child, but now anyone who wants it can have it and use it. I understand the copywrite laws, that she did take the photo, however she did not have permission to take the photo from both parents, and certainly not to post pictures of a minor online. Does anyone know of any laws I can present to her about posting pictures of minor children on the internet without parental consent? I would greatly appreciate it. Ok..I recently got scammed into a membership with this club...and I will be requesting a rescission of my contract for many, many reasons..one of them being this: __________(need you to help fill in the blank)__________ Ok, here's the deal....what the company does is advertise their prices to be 40-50% cheaper than retail, but I've come to realize that they 'hide' additional costs and charges from plain view, and you don't know them until you're about to check out.(both in store and online purchase..and before taxes are calculated). These extra charges eliminate any potential for savings. I WANT TO KNOW IF THERE IS A 'TITLE' OR 'NAME' FOR THIS UNFAIR PRACTICE. For example... They will advertise the same EXACT television make and model that best buy or any random retailer has and... Hypothetically speaking.. That particular television would be regularly priced at $500 through 'best buy' and in turn.....this scum of a membership club advertises it at $350ish for that same televsion... You would like to think that it is a great deal..but after you check out..you are hit with $125ish in 'freight fees'..and $10ish in handling fees..flat shipping fee of $25ish dollars..and lots of other miscellaneous charges. In the end, the item that should be discounted is wwwaayy more the the original retailer's price. What is this scenario called? My son in law in Oregon was discharged from the military a few years ago. Not sure what type of discharge for sure but I DO know it wasn't dishonorable. He is currently unemployed and there have been several jobs like working in the dept of corrections, 911 operator or working as a police officer advertised in his area but he CLAIMS that anything other then an honorable discharge means that he can't apply or work at those type jobs. As of yesterday I has learned of an ally of my friend who has typed his own phone number on a google search engine...and the results came back with a result of the number with his name attached. He became all upset about this and ended up debating at his house about who or what posted his phone number...even though he only had it for less than a month. From looking at his call log, he only use it to call his releatives and nothing else. However two week ago, a telemarketer called...and later contuine to call every so often. I am currently in the market to buy a home. I found a home that was a bank repo. We don't advertise ourselves as graphic designers. Often people will come in and ask us to print an image they found online onto a banner or poster. I have had many jobs from selling advertising to retail, and I had to pass a drug test, background, and credit check. Why are elected officials, law enforcement, and the justice department not held to the same standards? To go a step further, THEY WORK FOR US, although it seems to be the other way around lately. My husband and I are living in California, his parents are living in Colorado. This year, we decided to send my in laws a nice Christmas center piece from a supposedly reputable online floral shop. When I click on the photo of the item that I wanted to purchase, there was a drop down menu asked me about the recipient's zip code, and the desirable delivery date. So I put 12 / 24 / 2008. To my surprise, my credit card was charged (not authorized, but charged) right away without any delay. On 12/24/2008 2 o'clock in the afternoon, I received an email indicating the item couldn't be delivered on that date because the local florist was not working. I called them immediately, had to go through 4 people to reach a supervisor, and she promised me a 30% credit on my credit card and item redelivery the day after Christmas. Today, I got another email from them saying the item is no longer available and I have to choose an alternative item. So I called them back and chose another item, You know what they told me? They told me they would do their best to send my in law the exact same thing. If this is not fraud, I don't know what is. What do you think? thank you in advance. PS. The gift is for my in laws, they are both 75 years old, how many Christmas do they have left with us? My husband is furious. What do we do now at this point? Should we just let it go? The thing really bothers me is that the item looks like funeral floral arrangement, it does not look happy at all.
