Open Question: I have been a temporary worker for 3 years in the same job. What are my rights if any?

Due to the economic climate there has been a 'recruitment freeze' during the duration of my assignment here. I have a 100% attendance record and exceed all targets placed in front of me with a 0% error rate. I am paid 40% less than my colleagues who are doing the exactly the same job, albeit worse in my opinion as I am clearing up after them generally, with no entitlement to holiday pay and/or bonus. Surely this cannot be legal after this amont of time?? Now I know that new legislation has to come in to effect by October 2011 (Agency Workers Directive) in that legally you have to be paid the same as a permenant member of staff for doing the same job after 12 weeks of the assignment, but does this mean that companies will just get rid of you before this takes effect?? I have made my boss aware of my feeling of complete lack of appreciation/motivation in my current plight (I.e Not have a permenant job and/or being paid the same) but they just state oh our hands are tied and you cannot get a job because of the recruitment freeze. To top this whenever a position is advertised in my department we get somone from elsewhere in the company who I have to train and mentor. Any constructive thoughts would be much appreciated.... Open Question: Con_Artist Advert scam UK Media Group?

Dear Sir, I am in dispute with UK Media Group as I have been mis sold advertising for an advert outside the ASDA store in Canterbury, Kent, UK I signed an agreement, it was the day before I was due to leave on my summer holidays, so my mind was on other things, as the salesman told me the agreement was for 12 months and cost £495+VAT - I paid in good faith. But then advert was published but it was not in the location stated, nor was this a 12 month agreement. The advert was supposed to be located within the covered over door of ASDA, the figures they (Smooth talking saleman) gave me for potential footfall were fabricated I checked them with ASDA in Leeds, the advert was not ready on the date they stated i.e.1st September 2010 in time for the new influx of students to Canterbury (the main reason I agreed to the idea). I would have been within my rights to cancel but it was beyond the cooling off period. I then received an email in June asking me to confirm the second half of the contract - this was the first I knew there was a second half. Now having read the poorly worded contract it states that it was for 24 months but makes no comment about renewal costs - I do not wish to renew and have taken legal advice - now they are asking for £800 + VAT (£940) I do not have that sort of money. Have anyone else received any other complaints about this [sharp practice] - I contacted the ASA but they recommended I contact Trading standards in Colchester. I am a very small one-man business who has been conned by smooth talking saleman who no longer works for the company. I have contacted the Legal Team of the FSB who have said they need to see the contract that I signed, i have been in contact with the Company today and they are emailing it over to me. What recourse do I have - If I refuse to pay they may take me to court to recover the sum they claim I owe, or worse still sell my debt on to a debt collection agency? more

Open Question: Mis-sold holiday... What can I do?

I am seeking some advice about a holiday that I believe has been mis-sold to me. I booked through an online travel agency (which I have used before in the past and provide a good service). The reason why I believe it has been mis-sold is because the images of the hotel I booked and the star rating provided by the agency (after some extensive research by myself), I found are wrong. The hotel was decided upon because the pictures looked idylic and although being picturesque, the location stated is actually right in a lively area (in Corfu, Greece) and rated 4 star. Looked perfect. The pictures, star rating and description sold it completely. In excitement, I've been researching the hotel most nights. It came as shock to me to find out that there is a completely different hotel with a similar name on the complete opposite side of the island, nowhere near the location I have been provided in the description or on my final booking confirmation. On the website for the different hotel, I managed to find the exact images which had been provided to me by the travel agency, for hotel I had booked. The images are clearly the same and the website for the other hotel also shows a map with the location on the opposite side of the island. Then on to the star rating. For the booking I made, it was shown and stated that it was a 4 star hotel (along with the images of the different hotel). I searched for the name of the appartment I had been provided and there was nothing under that name, only under a slightly different name but in the resort I had been sold. These apartments (which must have been the one I have been sold) are only rated 3 star. So therefore, although the description and the final booking confirmation show the location which corresponds to the advertised appartments, the star rating and all of the images are of a completely different hotel on the other side of the island. I have read through the travel agency terms and conditions and it does mention that I will be provided with the described hotel and it says that the star rating they analyse and advertise will be the star rating I receive in correspondence to the general ratings of that country. The holiday leaving date is not for another 3 weeks. I was wondering what my rights are in this situation seeing I have clearly been sold the wrong hotel and if it wasn't for me researching somewhat after booking, then I would never have known and neither would the many other people that may have booked the same hotel. I believe that this is a blatant case of false advertising and if possible I'd like a full refund so I can book somewhere else as the more this case unfolds, the more I'm put off going to this place. It is supposed to be a relaxing yearly holiday and I've already been completely mislead into looking forward to a beautiful idylic hotel when actually I'm booked into a rowdy, 18-30 prime location which looks bland and plays loud music 24/7. I'd greatly appreciate any advice on this matter. It's just something I really don't need. It's the first holiday with my current girlfriend and she's never flown before. OK.. so i was drawn in by this scammer who told me he had 3 free puppies needing a good home due to his work commitments.. i had never heard of this scam.. but fowarded my details.. my name.. address.. post code.. and tel number he told me he lived in scotland and the fee to transport would be £80..(for one) i offered to pick up the puppy myself but he ignored this offer, and went on explaining the delivery service. i told him i would have the fee amount by monday the 5th july.. So i haven't yet paid any fee.. i wanted to check online.. and stumbled across this scam!! so i therefore sent this email Hello, again, Im really sorry to have to do this.. whether you are a genuine person trying to home your puppies or whether your another one part of these scams.. i am NOT willing to go ahead with homing this PUPPY, i was advised that i read up on transporting agencies.. when stumbling across this absolutly disgusting scam, of advertising free puppies.. which infact there were no puppies There are over 50 stories ive read today.. Your first email sounding very very similar, when offering to pick up this puppy myself you avoided this offer and continued to agree on transporting the pup. I am distgusted in how this can be done to people that are willing to help these animals in need of more attention and care than they are already recieveing, i too was one of them, and gullabull i may be.. i cannot risk handing money over to .. we could say.. a stranger.. The problem is that something as important as the re-named “struggle for security” ought not to be carried out under subjective criteria and personal perceptions. The cost in lives during an armed struggle increases when light diagnostics are carried out. It’s understood that the PGR (Department of Justice equiv.) may not have the capacity to thoroughly investigate the 22 thousand deaths associated with organized crime during this administration. One must assume, therefore, that the rest of the one thousand 200 previous investigations – more than 20 thousand – are in the hands of the state attorneys’ offices. Unfortunately, the situation in those agencies is the same or worse than in the PGR, not only because they refuse to get involved in crimes which – they say to justify themselves – are under federal jurisdiction, but because they lack the capacity for a serious, methodical and scientific investigation. Faced with that deficit, the first thing the federal government should be doing is to set the example. In order to obtain the backing of public opinion on this issue, and to have society see how necessary the “struggle for security” is, the federal government must begin with coherence. Instead of trying to convince people that the dead are insignificant because they’re hired killers, the President could show that at least matters of public relevance are really investigated in an objective fashion. The cases of the Tec students (making reference to a number of Monterrey Tech Institute students killed in a crossfire) and the murdered children – according to indications – at a military checkpoint in Tamaulipas were a perfect opportunity to show this coherence. Police officers in a small Arizona border city are on heightened alert following a tip that a Mexican drug cartel will put them in its crosshairs if they conduct off-duty busts. The threat stems from a marijuana seizure made this month by two off-duty police officers riding on horseback in an unincorporated area east of Nogales, a city of roughly 20,000, Police Chief Jeffrey Kirkham told FoxNews.com. "The word was that these particular officers would be targeted if they were ever in that area again and were not on duty and intercepted any drug trafficking," Kirkham said. "It said they should look the other way." The unidentified officers were able to confiscate roughly 400 pounds of marijuana during the seizure in early June at a known smuggling corridor along the U.S.-Mexican border where there is "relatively no fencing," Kirkham said. No arrests were made, and the smugglers were able to retreat into Mexico. Kirkham said his department, which employs 62 officers, learned about the threat through informants and has been unable to determine which Mexican drug cartel is behind it. Kirkham noted that two drug trafficking organizations -- the Los Zetas and the Sinaloa Cartel -- are currently trying to gain a foothold in the Nogales area. "Which one, we can't establish," he said. "They're not ones to advertise who's behind this. It's difficult to establish." In response to the threat, Kirkham said everyone in the department was advised to be armed while off-duty. Officials at the Drug Enforcement Agency and U.S. Immigration and Customs Enforcement also were notified, he said. "We let them know that if they are to go out there, they are to be armed," Kirkham said. "This is quite credible that the cartels would threaten police officers, on-duty or off-duty," Grayson told FoxNews.com. "They, in fact, are more likely to threaten local police than to go after the [Drug Enforcement Agency] or FBI, which really raises hackles in Washington when you have your federal law enforcement agents threatened." The Los Zetas criminal organization -- a rival of the Sinaloa Cartel -- had previously operated in the Nogales area, Grayson said, but the area is now probably controlled by "El Chapo," which is Spanish for "shorty." Grayson said Sinaloa is believed to be one of the biggest suppliers of cocaine to the United States, and its members are known to be well-trained and well-armed. "These officers should get medals for bravery, either on- or off-duty, because I doubt they have the firepower these cartels have," he said. I have a bachelors degree in Mass Communications with a concentration in Journalism from a four year university, but the competition is the advertising/PR/marketing industry is fierce. I got a good education, but my curriculum didn't really focus on the Adobe Design Suite and can't put together a portfolio; I understand that both is needed for advertising agencies to even consider you. I'm seriously considering the Art Institute of Dallas to get a bachelor of fine arts in either media design or advertsing design because I'm not super savvy with software programs on my own, but I learn quickly. I know that it's expensive, but I love school and want to continue my education. I live in the Dallas area and can't find any other accredited art schools besides AI. Anyone a copywriter or in the advertising field that has any advice? Will this give me a competitive edge with agencies? Any AI graduates that can give advice or share their experiences?? more

I work as a contractor for a recruiting agency and they sponsored me for an H-1B/working visa, and supposedly for a green card thereafter. My H-1B was approved and in effect. We were getting ready to file for my green card when the company's immigration attorney said that they cannot move on with the process. They said I need at least 5 years of experience in the IT field and I have none, or obtain a Masters degree in order to be considered for the EB2 category. They said by law, they need to advertise the position, as a requirement by the labor certification. Upon doing this, they said there would be a lot of applicants who would be more qualified than I am. My question is, is there a way to file now without going back to school or waiting 5 years to gain experience? I asked about filing under EB3 and my employer seems to think that is not an option. They already took off a portion of my salary for the H-1B and GC processing, so I know they have to do it for me. Any inputs or advice would be appreciated! more

Good morning good people, I am in a 15 year strong and very loving relationship with my partner and we are now thinking of having a child through surrogacy. The thing is, we are having difficulty finding a surrogate in the UK and are now looking into or going to start asking very close family members to help and become our surrogate. We have looked into joining a UK surrogate agency but I personally feel that by joining a surrogacy agency, we would not be receiving the best treatment or care and the fees are very high and come with no guarantee that we will be chosen by a surrogate mother.
