Resolved Question: TOPSOIL FOR AUTISM? Can i have a company that makes PROFIT as well as donate money?

I bought a 6 wheeler dumptruck and i thought about naming my small business "Topsoil for Autism" because my brother is Autistic and i thought it would be a great idea to help raise money! Also it has a good story! My father owns a Construction Company and if my brother was able he would be taking it over. BUT now i am. So its kinda like im making a small business for my brother... I currently sell landscape supplies- topsoil, sand, mulch etc. So I thought i could advertise- "every yard bought is $1 towards Autism" or "10% of sale goes to Autism" or w/e ** I could even print up coupons with the buyers donation amount ** So its on record of the donation ** THE QUESTION IS: Can I do this without people thinking its a scam, unfair advantage? Because i would still be making a profit. I think this idea would be great! Since i want to make my brother apart of the family business... But through helping his cause and donating to the Org. AUTISM SPEAKS. I could advertise on AutismSpeaks website- local news & radio and at the annual Autism Walks. Voting Question: How can I get a finder's fee or commission from the seller of FSBO real estate?

My friend wants to sell their house (in Maine) as a "For Sale By Owner" (FSBO), rather than listing the house with a real estate broker. She wants me to help her find potential buyers, and would like to pay me a finder's fee or commission, in the event that I have introduced her to the person who ends up buying her house. I am not a licensed real estate broker or agent, and I do not want to run afoul of real estate broker/salesperson licensing laws. How can I legally do this? Some possible ideas that come to mind include: 1 - what if I am her employee - can I then receive a commission on the sale of the property? 2 - (how) can I set up a company, partnership, corporation or LLC which would receive a commission without having an officer or employee of the company being a licensed broker? 3 - (how) can I receive a commission on the sale of a property for performing other work, for example, by providing advertising, printing, web development, building rennovation/contracting or similar services, without being a licensed broker? 4 - apparently in the State of California it may be legal for the seller to pay a "finder's fee" commission to someone who helps locate the buyer - do other states allow this? What do you have to do to avoid crossing the line into territory that is reserved for licensed brokers and agents only? 5 - is there any other way that I can receive a commission from the seller of a FSBO (for sale by owner) property without being a licensed broker or real estate agent?More info: The answer below that stated, 1, only if she is a licensed broker and you are a licensed real estate agent. does not seem to be correct, because Maine statute Title 32, section 13002, "Exceptions" states that "real estate brokerage does not include the following: 1. According to http://www.rubak.com, advertisement is “the attempt to send information to people to convince them to spend their money with a certain company I came across one of your ads regarding a new sandwich you invented: the BK Super Seven Incher. The ad has a young woman with her mouth wide open, looking surprised and nervous. There is a sandwich across from her mouth suggesting that the sandwich is too big to fit in her mouth. Written in bold letters “It’ll blow your mind away“. The target audience seems to be men. As a young woman and Burger King Consumer, I find the ad offensive and insulting. In your mission statement you state “We will conduct all our business affairs ethically, and with the best employees in the mid-south”. You seem to doing the exact opposite in this ad. In your ad, you appear to make the Super Seven Incher so big and juicy that women would not be able to handle it, especially with our small mouths. The ad seems to make everything seem larger. The words are printed in big bold letters, the sandwich is made to appear rather large, and the woman seems to be blown away by the size of the sandwich. On the bottom right hand corner, it is written “fill your desire for something long, juicy and flame-broiled with the NEW BK SUPER SEVEN INCHER. Resolved Question: We're FSBOs. Is this rude?

My husband and I are selling our country home (with acreage and outbuildings) for sale by owner. We've been listed for about a month and a half and have had several showings and calls. Our latest showing was last weekend and they were by far (what we could tell) the most interested. They left us with the impression that they were wanting to look at their finances before getting back with us. We really liked them and feel like they both really loved the property and felt the price was fair (especially since we said we'd negotiate). Anyways. We had planned to advertise for an open house. The local papers have sent us proofs of the ads that are to be run and we have fliers printed to be sent to local realtors attempting to draw in move perspective buyers. With clients that acted so interested we hate to have an offer coming in just after we made a big deal about our open house. Is it rude to follow up on the people from the last showing? If not how much time after seems appropriate? Any suggestions? Thanks! more

Ok, they gave me a scratch off, and it says I won 50$ according to it. It says to call a 1800 number, which I won't give out, and there's small print saying not No purchase necessary, void where prohibited. odds for grand car prize 1/535,000, see rules on card for details. It also says 6 days to come to the sale and claim prizes. I've never bought a ticket from there, but I bought my car there 10 years ago. My neighbor received one with losing numbers. Note: I heard you can't win the lottery when you don't purchase a ticket. Note: Car deals are also being advertised. Final note: no processing fee is mentioned fro the lottery. more

Resolved Question: Company advertising for one job and have it be something totally different, is that legal?

An ad in the help wanted section of the newspaper is advertising for customer service representatives. For mainly electronics repair. The offer 2000/month to start and 1st week bonus! However I did some research and they are not even who they say they are on the phone. It ends up being a totally different job than what is advertised. Selling vacuum cleaners door to door and the pay is not even close to what they printed (only if you meet there quotas). I asked directly on the phone if any sales where involved I was flatly told no. So I checked it out and it ends up being nothing they advertise for. What I'm really asking is can you sue for false advertising of a job!!! more

Voting Question: what would you do? Memphis in may canceling with no refund or reschedule offered?

this is a copy of an email i have sent all over today. I am appalled and very upset that neither mim or alice in chains is offering anything to compensate for the event's cancellation.The tickets purchased clearly state rain or shine, well it was raining and every new's channel was broadcasting weather event's all day long and yet you continued to sell tickets, and i believe with the intention's of cancelling anyway. I suspect wrongdoing on your part, you are trying to use 'public safety' as a scape goat and mim's motives are obvious. I personally purchased 8 tickets at 37.00 each just to see alice in chain's, why were they not rescheduled at another location? I called your office this morning and spoke to a mim representative who stated that you weren't going to do anything about this at all, you mean you are not going to let saturday's one day passes work sunday to ease the burden on the thousands of people who were affected by the ticket gouging. We stand in the mud and rain for hours in spite of all weather warning's, you continued to sell tickets. I will personally and relentlessly see to it that this is made right for the people who were scammed. Rain or shine mean's that the festivities will take place regardless of weather condition's. I realize that the 'fine print' on the ticket's states no refund's but the fact remain's that you continued to sell ticket's to the event even with every memphis news channel's warning's, that clearly show's ill intention's on your behalf. I am personally out of pocket about 600.00 dollars and i am very unhappy about it. Why couldn't you open the gates and hour earlier or close an hour later today and make alice in chain's play, i checked their schedule and it's clear. I am personally considering spearheading a class action lawsuit against mim and it's organizer's. If i advertised that say for instance ' the beatles' were playing at my local civic center and i sold thousands of people ticket's and the beatles didn't play or even offer a reschedule, i wouldn't be receiving letters such as this that i am writing because my moral's wouldn't allow it. You have the ability and control to make this right, it's your choice. While you are tallying ticket sales and alice in chains is at the peabody sipping margarita's i am trying to figure out how you think you are going to get away with this. Would it be illegal to advertise a item on the internet for sale and some one send money for it but me not send the item? or me send the item printed out on paper or something haha. I sent this to customer support at a store I frequent: I recently submitted a comment regarding my online shopping experience and order. I purchased a clearance item online, which was later reduced to a lower sale price. The experience I had in speaking with customer service over the phone was pleasant and I was very excited and happy to have spoken with someone so helpful (Diana). To receive a price adjustment on the product I purchased, I was instructed to visit my nearest store with a copy of my invoice with my order number, and a copy the new sale price printed from the website. I felt I was thoroughly informed and treated as well as a customer should, and provided positive feedback on this experience through the online tool. Unfortunately, my visit to the store was not as pleasant. I visited the store on with the necessary documents- a copy of my purchase order and a printed copy of the advertised price online. However, I was told by a male member of the management team that he could NOT refund my money unless I had the actual invoice that came with the packaging. I was slightly frustrated at the wasted trip to the store, yet understood, as the purchase order that I brought did not have my form of payment (credit card) used. I returned the next day, with the assumption that I had everything I needed. A copy of my receipt that came with the packaging, and again, a copy of the advertised sale price on the website. I was refused a refund again at this point, by a female member of the management team who stated that she needed to see the actual pair of shoes to process the refund. When I explained what I had been told previously, I was told "Well, I am the manager at this store, and I can't give you a refund unless I have the shoe here. I need to scan a barcode". At this point, my frustration escalated. I had been told three different things on three different occasions in regards to the return policy- two of which came from the same store she manages. I am assuming that my purchase was/is stored somewhere on the system, with my name, address, and form of payment. I already had this-- an invoice with my order number, name, address, and credit card payment information on it, but still needed to have the actual shoe? I have never had a similar experience or level of difficulty with any other retail store or any other [name] store, to be more specific. I left the store, and returned again a third time where I was finally refunded. I received my price adjustment for a little over $17.00. I made three separate trips to this particular store for $17.00. What I find incredibly ridiculous is the fact that I probably spent $17.00 in gas driving to and from my home to this store for my refund! The customer service representative I spoke to over the phone made me excited to continue shopping online. There was a lot of ease and friendliness. Contrary to my in-store experience in which the female manager I spoke to was rude and unwilling to assist. I will not be shopping at this particular store again. Ever. The difficulty, attitude, and communication exchanged between the female manager and I have turned me away from doing business at this location. I am requesting a thorough explanation of the in-store policy in regards to price adjustments should I decide to continue a customer relationship with [store name]. More so, because of the following: 1. If I purchased the item online, and had the shoes shipped elsewhere as a gift, how would the store refund my money if I didn't have the actual shoe/box or the invoice that was sent with the packaging? I was turned away my first visit because of lack of information on the invoice printed from my e-mail. 2. If a store orders a shoe online on behalf of the customer, how is merchandise "scanned" if there is not an actual shoe in-store? I was turned away on my second visit to the store because I did not have something for the manager to scan. 3. Does the store not have access to information placed online (such as order number, customer purchase history)? This would seem difficult to satisfy a customer who placed an order online and is redirected to a store for assistance. I am an avid customer. I browse and buy something from one of your stores 9 times out of 10. Nearly all my shoes originate from one of the stores. It is really disappointing that the recent experience I had has made me seriously question whether or not I should continue to be a customer. I am looking forward to a prompt response and resolution. Resolved Question: False Advertising on Used Car... Law Advice?

I purchased a 2004 Santa Fe from a used car lot. When I bought it, I believed it was an LX trim, with a 3.5 liter engine... as per the online ad on their website and on auto trader. However, I found out after purchasing it that it is the GLS Trim model, with a 2.7 liter engine. On kelly blue book the difference in value between the vehicles is: the GLS model is worth roughly 10% less than the model I thought I was purchasing. Now, the bill of sale does not list a trim. Just the make and model. However, I have a print out of both adverts, both with a picture of the car I bought, stating the 'false' specs. Is this enough to prove false advertising? I would ask for my money back, but I spent $75 registering the vehicle and $275 buying tires for it. I would need to be reimbursed for those costs should he offer a return. Otherwise I want roughly 10% rebate on the price a paid for the vehicle. Is this an acceptable demand? What would you do? more

If I had to describe myself in one word I couldn't do it. I like to think that I'm ahead of my years. As an kid I loved going to school. I used to cry and get upset if my mother signed me out for early dismissals if I had a doctor's appointment; God forbid if I didn't get to go to school at all for that day! You would need a mop to clean up all thoses tears. I loved going to school just to learn. Learning filled a void for me that I was missing at home. Learning made me feel special. My childhood experince will be the driving force towards my success at The Fashion Institute of Technology. I am my biggest critic- I can't stress that enough. This trait is due to my childhood. My mother would yell at me often, telling me that I was no good and that I would never amount to anything. I had no father around to encourage me. I was the middle child of three other brothers. I was the child that would get blamed for everything. Nothing came easy for me. So I learned at a very young age that if I wanted something, I'd have to go for it myself. I see people my age that seem to expect the world to bend over backwards for them. I feel the world doesn't owe me. If anything, I owe the world. I owe it to myself to strive to become a productive member of society and to take pride in everything I do. I can never give up or give in, even an inch. Although I’ve been through many trials and tribulations, I’ve always found a way to succeed and at The Fashion Institute of Technology I will do just that “Succeed”. I believe education is the key to the door of opportunities. I know it sounds so old fashioned, but it's so true. A lot of people don't realize that education that one receives affects the lives of the people around them, or your children that one might have some day. A good job is necessary to care for them, and education is needed for that. I’ve worked diligently my entire life, and after taking several years off from school I would like to focus my attention on school. I’m determined to succeed and take advantage of all the classes involved with your Advertising and Marketing curriculum. I feel that I will succeed in your Advertising and Marketing program because I’ll be guided by an amazing faculty of practicing professionals. I look forward to learning such topics as creating integrated marketing communication campaigns for advertising, public relations, direct marketing, and sales promotions. I also hope to learn how to develop media plans and special events, direct and produce television and radio commercials, and write print ads, press releases, and newspaper and magazine articles.I know as a student at FIT I will bring a positive additude,excitment to learn, motivation and leadership. I can't wait to have practicing professionals as professors that want me to succeed a much as I do. FIT would be an amazing opportunity. Getting an education at FIT can open so many doors. Voting Question: bussiness advertising law issue_I signed an ads contract(4 terms), but was not informed by the sales person.?

I live in NJ and signed a advertising contract with a local company who promised to mail out 10,000 mails to the local area (but definitely not the case, we did not even receive their ads at our residential place which is only 3 blocks from our business) and a much better outcome than her competitive( which definitely not the case either, because I had only 2 response). So I called in to tell her that I want to discontinue the ads, but she said the ads was already printed and I had signed up a 4 terms ads contract (which she did not even mention at all in the beginning when I signed up). So I tried to tell her that I can not pay the full amount because it's just not fair enough( the awful outcome and I was not even informed about the details of the contract). But she was very solid that I had to pay for the full amount because I had signed a contract for it. This week, I got a letter from her lawyer to collect the payment and also threat a 275/hr collection fee may apply later on for collection purpose. I really don't think that is fair enough for me to pay the entire amount. What should I do? more

When I'm not doing PI work, I'm just a lowly journalism instructor at a junior college but, as a sidelight, started a newspaper in the New York Metro area. The first issue will come out a day after my 40th birthday on Sunday. Anyhow, early on, when I was looking for ways to fund this project, I pitched the idea to a national media company. They loved the idea and we went back and forth with contract details over the winter break and are almost to terms. They would have exclusive rights to sell ads and take 20% of the gross revenue. BUT, in this time of negotiations, I couldn't just put out a paper without ads, so, being a college journalism expert, I sent out an email to potential advertisers I knew at other colleges, explaining my new publication and sold a good deal of advertising right off the bat. I sold numerous ads in all five upcoming spring issues and will make a profit of at least four times my investment with minimal work on that end. Once I actually print an issue and have something to show the more tepid potential advertisers, I could even double that. So now I'm rethinking signing the exclusive contract with the national company. I'm not a pro seller, but can do this myself and keep 100%. My wife thinks it would be crazy not to sign with the national company, though, as they have so many more connections than me and are probably more professional when it comes to sales. In 2006 (right when Tim McGraw came out), Taylor Swift came to the East York Walmart to sign autographs to advertise her new first cd. I purchased two cds and stood in like for fours hours before finally meeting her. Point being, I got two signed cd covers. One is to my daughters, Sarah and Emily. The other one was is just her autograph. Obviously, the one for my daughter is not up for sale. However, the other one is. Resolved Question: Scratch Off Game Strategies?

First, all lotteries are guaranteed money loser over the long run, medium run and even over reasonable short runs, that much is a given but it does appear that unlike the lucky number astrology stuff of the draw lotteries, there's some actual possibilities for strategizing with scratch off games so I was wondering what strategies would work best. Unlike the odds of a draw lottery, the odds of scratch off games change as tickets are sold. Lottery authorities often publish the number of tickets printed, the number of prizes in each category printed and the number of prizes in each category claimed to date on a daily basis, Texas does so in the form of a CSV file for download. They obviously don't have a way of collecting the number of sales to date as the tickets are bearer instruments and not sold through a computer terminal but a reasonable estimate of the number of tickets sold and hence the number of tickets remaining by using the total number of prizes claimed versus the total number of prizes printed as the ratio of tickets sold. This means that scratch off games can be timed, with tickets purchased when the odds are in your favor or at least less against you. But what do you decide upon, expectations? (That's when the probability of each prize level is multiplied with the value of the prize and then summed up over all the prizes and is a common Engineering technique for estimating returns on investments). The problem with expectations is that they require a lot of statistically independent chances before they average out if the probabilities are low hence you would literally have to play millions of dollars before the winnings play out as expected. Do you look for games with more prizes? more low value prizes? more high value prizes? underclaimed high value prizes? Probabilities of winning at least one prize of a certain value or higher? Using the ratio of prizes claimed to prizes printed to estimate the number of tickets sold would be able to detect if given prize categories had been under claimed or over claimed when compared to the mean and the higher value prizes would show the most dramatic variation in odds. For example, the "Super Set For Life" game in Texas is currently 89% sold based on the ratio of prizes claimed versus prizes printed but only 3 out the 4 top prizes have been claimed which equates to 75% of that prize category. Another interesting aspect of that game is that if you took the full value of the top prize which is $500,000 a year for 15 years or 7.5 million, then the expectations show a $1.01 return on $1.00 invested. Of course, the prize is actually an annuity probably worth only 63% of the total advertised value which equates with a $0.85 return on the dollar but this is much better then the original $0.68 on the dollar expectation when the game was first printed. This would seem to indicate that if you could corral all the remaining unsold tickets together and just buy them one at a time until you've won the big prize hopefully by about the half way point, you might make money. Of course, you would have to buy 724,059 tickets before being 95% certain of obtaining that last 7.5 million dollar top prize but you would have a 50/50 chance at 381,084 tickets which would be closer to the median of what you would have to buy. Of course, the top prize alone would not meet the 7.6 million dollar median that you would expect to require to obtain the top prize but together with all the smaller prizes, perhaps. Mind you, your scratching arm would be very very tired. On the Internet, there seems to be a lot of people espousing attempting to exploit manufacturing processes such as purchasing tickets at the end of the roll or changing rolls once a certain amount of prizes has been won. The former seems somewhat suspect since it's nothing for a computer to randomize the prize placement throughout a typical roll of 50 or 25 tickets at the point of printing but the latter is interesting since there is a guarantee of minimum prize amount per roll that's published to assure retailers they are not getting rolls completely devoid of prizes and it's likely that this would be achieved by evenly dividing low tiered prizes between the rolls and then randomizing their positions within the roll. Having said that, since I have scanned images of my winning tickets, I can see that my winning tickets have all been in the first quarter or the last quarter of a roll and none of them has been in the middle half but then I can hardly afford enough tickets to have a statistically relevant sample. Maybe if you have sufficient records to determine where in the roll your winning tickets were, you could email them to me so that we could get a reasonably relevant sample (I'd only be interested in Texas games for the time being). So what strategies do you think might marginally improve your odds of winning? Aside from not playing at all.Duh, I said these were astronomical odds and improving them marginally still leaves them astronomical. I just wanted to hear some strategies that people use. It's somewhat simple minded to just be saying that lotteries are bad odds, most gambling is and that's a given. more

Recently I became unemployed and got a job for an advertising firm. I booked appointments over the phone cold calling. So on the one of the days I was working for free, I went to a print shop and the owner explained he lost a lot of accounts because of the economy and was really nice. He gave me props for doing the "hardest job" which is selling. I couldn't convince him enough to buy something he couldn't afford at the time even though he wasted my time of driving there. It was hard because my boss did not want me leaving the meeting without closing the deal and if I couldn't convince him of this wonderful service, I would have to use my own cell phone and get her on the phone with him. Sorry this is so long. Well I was quitting anyway right so he told me he wanted to give me memo pads. (5 wrapped up in plastic with his business card on it) It was a way that he got business by having college students/retirees drop them off at businesses around towns. For example, if they need business cards, menus, promotion flyers they remember to call him because of all the memo pads with his name on it. Well I agreed and he put 2 boxes in my car. He explained that he would give me $25 a box. As I was leaving he said, "Yeah if you want to say 8 boxes, I can give you $100." I ignored it and acted like I didn't hear it. So I left the scam job of selling advertising and yesterday I went to 5 different towns and walked up and down the block handing them all out to local businesses. I called him and let him know that I was ready to be paid and he said he would have my money and a couple more boxes. Now I'm 23, I went to college. I suppose I am doing crazier things then I would normally do because of this economy. I went to get paid and he wasn't there. His wife was. She was like, "oh theres 2 boxes outside for you" (there really heavy-no help nothing. I mean it would of been nice. There is 50 per box) Anyway, I was nice and polite and thanked her when I got the envelope with my $50. I opened it up and there was only $25. Obviously this was not a mess up. Come this Monday I will officially be a ad sales consultant for a paper offering free personal classifieds. I am the only sales person for my area and it is my job to get local businesses to advertise. I have to get people to sign on and pay for an ad before the official launch date, sometime next month. I was wondering if anyone had any advice for me on how to do this. P.S. It was reccomended to me by my boss that I visit local businesses personaly. I am not really sure how to do this. I don't know what the best times would be and even if the person I am talking to can pay for the ad. I went into a few businesses yesterday just to get used to things and get my feet wet. Some people were receptive and took my flyer, some werent. I don't have any sales yet. I figure that these businesses will want to advertise if they just had the time to sit down and see what I was offering, so I really need to have the decision maker of the business sit down and make an appointment with me besides the other way around, I don't want to disturbe anyone unannounce, which is why I think my bosses idea is bad.
