Resolved Question: I have been a temporary worker for 3 years in the same job. What are my rights if any?

Due to the economic climate there has been a 'recruitment freeze' during the duration of my assignment here. I have a 100% attendance record and exceed all targets placed in front of me with a 0% error rate. I am paid 40% less than my colleagues who are doing the exactly the same job, albeit worse in my opinion as I am clearing up after them generally, with no entitlement to holiday pay and/or bonus. Surely this cannot be legal after this amont of time?? Now I know that new legislation has to come in to effect by October 2011 (Agency Workers Directive) in that legally you have to be paid the same as a permenant member of staff for doing the same job after 12 weeks of the assignment, but does this mean that companies will just get rid of you before this takes effect?? I have made my boss aware of my feeling of complete lack of appreciation/motivation in my current plight (I.e Not have a permenant job and/or being paid the same) but they just state oh our hands are tied and you cannot get a job because of the recruitment freeze. To top this whenever a position is advertised in my department we get somone from elsewhere in the company who I have to train and mentor. Any constructive thoughts would be much appreciated.... Resolved Question: I run a photography business, should I use my kids to advertise or hire kid models from an agency?

My 2 kids are in a non-competitive modelling agency. They are both 4. Noah has a 2 jobs. 1 small and 1 big, and Mady has had 1 big job. I am not sure If I should use them to advertise my photography business in my print add (just flyers) or run a casting and hire some kids. If I use my kids, I'll have to speak to their agency. But I think they will be fine with it. I am just worried people might think it is not fair to use my own kids. What do you think? I was never lucky with them, I am registered with 2 agencies and they dont even call me, I call them but they always says there is no jobs, but when I look online they are advertising jobs. Some other agencies ask me to go and see them to register, but I dont have time for that bullsh*t!I just phoned a few companies in my town, 10 companies so far to be precise, and I only got one email to send my cv to. Its really bad getting jobs!10 phone calls and only 1 positive response... Damn! more

I found a position that I want but it is being listed through the same employment agency that placed me in my previous position. I met with the recruiter and she asked what my current salary was. I politely said I wanted to speak about the position and the opportunities itself and later about the salary. She would not stop. She insisted and I held my ground. I got a call from her and she asked again and insisted that she needs to know because she cannot negotiate or look out for my best interest if I did not reveal to her what my salary was. The job's salary has already been advertised so I know the salary range, which is in my range but she somewhat knows what I made before which is lower than the salary for the job in which I am interested in. Do I have to reveal to her how much I make? Why is she so persistant? She will not give up. Can someone help? How should I handle this? I am really interested in this job. more

Voting Question: Why do people say the college majors are useless?

I want to work in the advertising field one day, however the schools im deciding on are pretty different as far as the major is concerned. I live in Florida and the schools i selected were usf tampa or ucf orlando. usf has a mass communication major with a concentration in advertising but ucf has an actual advertising degree. I also plan on doubling the major with journalism or some kind of liberal art...maybe history or english. Another thing to consider tho is that tampa is a very large media market (largest in Florida and is also a business city), while orlando is more of a touristy type city, i want to work in either ad agency or something in non profit setting ( preferably the latter), my friend who graduated last year majored in mech engineering, he says the he hates his job but he makes good money, he also says that my major will get me no were in life. I like have taken graphic design and advertising classes throughout high school and i also do volunteer work and i really enjoy both of them.im texting this off and ipod, sheesh i hate grammar police and non journalism is not a dying field, newspapers are dying, who ever said that journalism was strictly for newspapers, the more advance technology becomes the more options you have to communicate more

Voting Question: I dont know what is going on with my boyfriend?

Its quite complicated - Firstly - We have been together for about five years. He has his own business so I bought a house which is in my name. We agreed to do this in case his business folded and i wouldnt lose the house. Anyway - he does F@@k all to help me in the house - No help with DIY, no help with cleaning or maintenance. When i ask him why he says Its not his house so hes not intrested!!!! I feel really crap - he keeps throwing in my face even though it was his idea. He has a flat above his business and sometimes he still stays there, esp if we have an argument he just goes back there. Because of this set up he wont help me pay any bills on the house. He stays up till 3 in the morning using electricity. He gave me a credit card a while ago but im not allowed to use it so i have given it back to him. I dont know what to do - I work for him and I get a small amount of money for doing this but its not enough to live on at all. I have a son to support and my bf is just not helping. To top this off - I said to him I really dont know I can financially go on and am looking for another job. I joked about becoming an escort and he said he found that really horny. So horny in fact he nagged and nagged me to join an agency. Then because i joined he did too. That same day they said they had a booking for him - it made me feel sick. He was going to do it but then found out the agency are scamming people so cancelled it. I just dont know what to do - what is he doing to me. He has a boat which costs him about 1400 pounds a month, a new car which he recently bought for 800 pounds a month plus other stuff. yet he wont help me more. I saw a shop near me today advertising for staff so i told him i might apply and he was really shitty about it. I cant win - and i dont know what to do. more

I've been throwing my resume down the gaping holes of craigslist, careerbuilder, etc and talked to various employment agencies so I'm not just sitting around on my butt. I'm told that a portfolio helps but I'm still newer to graphic design. Resolved Question: impossible to get a job without using agencies nowadays?!?

Hi I am desperately looking for a job and have been on JSA for over 1 month now. Nearly every job on the internet is through an agency. I've applied for everyjob i can find that is advertised by an employer, and as yet have had no reponse. I HATE agencies. I've worked for most of them before (Reed, select, Huntress etc) They just ask what sort of work you want and what you DONT want. They pretend to care, and then they get you a job and LIE to you about what the job entails. When you get to the job, you find that you are doing the thing that you told them you DO NOT want to be doing. Inevitably, you are either useless as this job (hence why you told them beforehand that you didn't want that sort of work) or you hate it too much to carry on. Usually the company let you go and send you back to the agecny so that the stupid cycle can begin again! Not to mention that they take loads of your wage from you. Why do businesses always go through agencies nowadays? it must work out more expensive to use them?? Oh well, gonna have to go registering again next week at the poxy places :( more

If an employer advertises a job opening do they have to interview all applicants IF they don't have some type of applicant elimination steps in the hiring process? Example: Example: Employer advertises a job posting and several employees, who are already employed with the agency, apply for the new job yet the employer only picks who they want to interview. There is no listing of how the hiring process will be conducted in the job posting. Basically, anyone can apply but the employer will ONLY interview who they want to interview for the job. If you know that you weren't called for an interview simply because you are white BUT they interview other white applicants would that exclude you from being able to file an EEOC complaint about the hiring process? You have a spotless discipline record, excellent work reviews, 25 years in your field of work, college educated and WELL trained for the job for which you are applying. It just doesn't appear that an employer can just basically say...Sure anyone can apply but we are only going to interview who we want to interview. more

My ex-wife is jealous and i LOVE IT! LOL! Our marriage was horrible. All we did was argue, so we decided to get a divorce after about 5 years. We have a 4 year old son together and she has custody. Now i am married to my old high school girlfriend and our marriage is great. We have been married for about 4 years now and we are expecting our first daughter in July. I will admit, i have pampered my new wife a lot, mostly because i make a way more money than i did with my ex-wife.I treat her like a queen, anything she wants or needs i get it for her. My ex-wife hates it. But that just makes me jolly. My new wife deserves it. Why do they build cars with speeds that could NEVER be used on public roads? The car might be cheaper if they didn't bother adding all the extra horsepower that we don't need. Why is prostitution illegal but craigslist is allowed to advertise it and make money off of it? Why does a felony disqualify you from being a federal agent? Doesn't that job require you to be ruthless at times? Same goes for being a military officer Why is medical school so expensive when most of the doctors they produce suck? On that same subject, why does everyone refer to him as the first African American president, Last time I checked his mother was white and his father was an African from Kenya. I guess that makes him mixed, and if you disagree then you might as well refer to him as a white president also. Why the hell are there still US troops in the middle east?? At some point we should consider cutting our losses and stop looking for terrorists. Doesn't the CIA do that already? Does anyone else think its retarded to send thousand s of American Troops to a middle eastern country as if they would blend in? And wearing a uniform is mandatory so that makes it even worse, no wonder why they are not having any luck there. Voting Question: Can I be charged by a letting agent for advertising cancellation fees when I haven't signed anything to agree?

I have been receiving letters from a letting company stating that I owe them money as I moved away form home to work and was planning to let out my house. They sent me tenancy agreement papers which I never signed and at that point I had to return home from my new job as my mother took critically ill and has since died. I did not sign anything to my knowledge that gave them the right to advertise which they did according to them. I wasn't sure of the new job and if I would return home therefore I didn't sign the agreement. Can someone help here please as they now are threatening court action for just over £250 Also what proof will this letting agency have that they did indeed advertise my propety for rent? more

Ok, so I'm from Milwaukee and I'm trying to get a job in the advertising field. I have had a couple internships (one being in NYC) and do a lot of freelance work. It's still been hard just to get an interview though because of my experience. Last week I was offered a job in Chicago at a large media company. They buy and sell media as well as some other things. If I take the job I would have to move, which I would have no problem doing if I knew this would help me get a job at an ad agency down the line. If it won't though, I don't want to move right now. Hi :) Well, I *might* be getting my license, and need to buy car insurance. No, my parents won't support me on this; it's out of their budget, and they don't want me driving. But my road test is in a few days, and after that, I want to be able to drive on my own, and be covered. In general, what are the prices of car insurance? Is it affordable for teenagers? When COMPANIES advertise for job openings the salary budget is "Negotiable". Then they get the employment agencies to help them to source for the same openings but setting different salary budgets for different employment agencies to work on. Currently employment agencies “Do Not Disclose Companies Name" to jobseekers they represent. Consequently the same jobseeker may be sending to the same "Company" directly or through different employment agencies with different salary budgets. 1) Now if you are the Company receiving the same CVs from the same jobseeker with different salary budget via different sources what will you think and do with the same jobseeker ? 2) If you are a Jobseeker, do you think you will get the job ? 3) If you are the Employment Agency do you think you can close the deal ? The consequences will be the Companies asking to see more CVs and lose confidence with the jobseekers at large and ended up taking a longer time for employment agencies to close deals. This will affect the survival of jobseekers and employment agencies. So I urge Employment Agencies “To Disclose Company Names" they represent to all jobseekers from the start to avoid duplicated CVs with different salary budgets ended in the hands of Companies. I realise this sounds like a stupid question, but - I want to find a basic customer service job for the summer, preferably somewhere like Tesco, Argos, Asda, Boots etc. But none of these big chains seem to actually advertise customer service roles online - their websites just have management or head office roles! Resolved Question: Is anyone else receiving Spam emails advertising job offers and hiding their email addresses?

I live live in the UK. Lately, I have been receiving about 3-4 emails a day from different recruitment agencies, these emails are going straight into my spam folder, their email address is never shown so it looks like the emails are coming from my email address so they cannot be blocked, there is always a link at the bottom of the email which you are asked to go into if you are interested in the job, this link is also different every time just like the name of the recruitment agency so you can never track where these emails are coming from. Basically they are asking for people from "Europe only" stating job offers in management, HR and such jobs. I recently spoke to my little brother about it and he says that they are a scam trying to steal peoples national insurance numbers so they can work in Europe. Its no big deal, I just delete them, is a bit annoying though. Resolved Question: Applying for jobs out of state?

I have been applying to Advertising jobs in New York as there are some agencies I'd love to work for there. I have had interest from these agencies, but when they get to the part about me living in another state the interest always seems to drop off. For instance, one place asked to interview me early next week. I told them that since I was not in the city I would be open to them making arrangements for me to travel, or we could do a phone/skype interview. I didn't feel this was unreasonable. Now I have not received an answer from them in a day or so after receiving many emails a day from them expressing interest. I have spent a lot of time going to undergrad and getting my MA, and I have experience under my belt, so what is going on? I don't have the money to move without a job, and I don't feel I should have to spend money on plane tickets each time I get interest from someone (maybe for a final final interview I would consider it). I want to do freelancing modeling. But how do you get your compcards? I know someone who is a freelancer but i see that she has like 9 of these compcards from agencies like elite Do you just go to the agency and ask for compcards? Resolved Question: Should I take this matter to small claims court?

I started working for a friend's advertising agency last April as a graphic designer. I did several jobs for him, but he was always late to pay me, and always gave me the run-around about why he couldn’t. He was always demanding work be done by a specific, strict deadline, but he always took his sweet time to pay me. But what was weird was that he always had money and was always taking clients out to eat with the company debit card, and on a few occasions, I saw him use the card at liquor stores and restaurants in casual settings. I was suspicious. The last job I did for him was a billboard for a client, and I originally charged $1,000 to design it. After the billboard went up, he reduced it to $900 for some reason!!!!! I couldn't legally do anything though because it wasn't in writing yet. He then made a contract that said he’d pay $90 payments from January to October. I wanted the payment in full, but payments were fine. However, ever since January, he has been late on the payments, giving me attitude every time I remind him to pay me, which I have to remind him EVERY time to pay me (if I didn't, he wouldn't pay me at all) and I feel I’m being treated very unfairly. Should I sue? I no longer work for him. more

Voting Question: Should i quit my job three days in?

I received two job offers within days of each other. One was for a stable company that offered me a marketing job at $68.5K per year. The job is 30 miles away from my home. The insurance is OK and the benefits are good too (no 401K match but they have other investments that are better than average). The people are nice enough too... The second job was with the biggest advertising agency in the city I live in (no commute) and they have a really fun, young, cool work environment. I was thrilled to get the job offer from them but they only offered me $54K but I would have the option to earn a huge bonus at the end of the year, their benefits/vacation are good and they have a 401K match. I ended up going with the stable job that offered me more money but now that I am working here, I'm really regretting not going with the more fun, hip company. I really think I would be a better fit there and even though the money is lower, I know that I would make my bonus at the end of the year. Plus, I'd be happier which makes all the difference. So, my question to you is - do I call the agency (they are still recruiting for the position) and ask them if I can have the job after only three days at the stable job? During this downturn, as stress levels rise, workplace researchers say, bullies are likely to sharpen their elbows and ratchet up their attacks. It�s probably no surprise that most of these bullies are men, as a survey by the Workplace Bullying Institute, an advocacy group, makes clear. But a good 40 percent of bullies are women. And at least the male bullies take an egalitarian approach, mowing down men and women pretty much in equal measure. The women appear to prefer their own kind, choosing other women as targets more than 70 percent of the time. In the name of Betty Friedan and Gloria Steinem, what is going on here? Just the mention of women treating other women badly on the job seemingly shakes the women�s movement to its core. It is what Peggy Klaus, an executive coach in Berkeley, Calif., has called �the pink elephant� in the room. How can women break through the glass ceiling if they are ducking verbal blows from other women in cubicles, hallways and conference rooms? Women don�t like to talk about it because it is �so antithetical to the way that we are supposed to behave to other women,� Ms. Klaus said. �We are supposed to be the nurturers and the supporters.� Ask women about run-ins with other women at work and some will point out that people of both sexes can misbehave. Others will nod in instant recognition and recount examples of how women � more so than men � have mistreated them. �I�ve been sabotaged so many times in the workplace by other women, I finally left the corporate world and started my own business,� said Roxy Westphal, who runs the promotional products company Roxy Ventures Inc. in Scottsdale, Ariz. She still recalls the sting of an interview she had with a woman 30 years ago that �turned into a one-person firing squad� and led her to leave the building in tears. Jean Kondek, who recently retired after a 30-year career in advertising, recalled her anger when an administrator in a small agency called a meeting to dress her down in front of co-workers for not following agency procedure in a client emergency. But Ms. Kondek said she had the last word. �I said, �Would everyone please leave?� � She added, �and then I told her, �This is not how you handle that.� � Many women who are still in the work force were hesitant to speak out publicly for fear of making matters worse or of jeopardizing their careers. A private accountant in California said she recently joined a company and was immediately frozen out by two women working there. One even pushed her in the cafeteria during an argument, the accountant said. �It�s as if we�re back in high school,� she said. A senior executive said she had �finally broken the glass ceiling� only to have another woman gun for her job by telling management, �I can�t work for her, she�s passive-aggressive.� The strategy worked: The executive said she soon lost the job to her accuser. ONE reason women choose other women as targets �is probably some idea that they can find a less confrontative person or someone less likely to respond to aggression with aggression,� said Gary Namie, research director for the Workplace Bullying Institute, which ordered the study in 2007. But another dynamic may be at work. After five decades of striving for equality, women make up more than 50 percent of management, professional and related occupations, says Catalyst, the nonprofit research group. And yet, its 2008 census found, only 15.7 percent of Fortune 500 officers and 15.2 percent of directors were women. Leadership specialists wonder, are women being �overly aggressive� because there are too few opportunities for advancement? Or is it stereotyping and women are only perceived as being overly aggressive? Is there a double standard at work? Research on gender stereotyping from Catalyst suggests that no matter how women choose to lead, they are perceived as �never just right.� What�s more, the group found, women must work twice as hard as men to achieve the same level of recognition and prove they can lead. �If women business leaders act consistent with gender stereotypes, they are considered too soft,� the group found in a 2007 study. �If they go against gender stereotypes, they are considered too tough.� Skip to next paragraph Enlarge This Image David Kadlubowski for The New York Times Michelle Cirocco, left, and Donna Kent of Televerde, a company in Phoenixthat set up call centers at a state prison. �Women are trying to figure out the magical keys to the kingdom,� said Laura Steck, president of the Growth and Leadership Center in Sunnyvale, Calif., and an executive leadership coach. Women feel they have to be aggressive to be promoted, she said, and then they keep it up. Then, suddenly, they see the need to be collegial and collaborative instead of competitive. Cleo Lepori-Costello, a vice president at a Silicon Valley software company, came to the center for training. She got off to a bumpy start when she stormed into her new role �like a bull in a china shop,� Ms. Steck said. In gathering feedback about Ms. Lepori-Costello, Ms. Steck heard comments like: �Cleo is good at getting things done but may have come on too strong in the beginning. She didn�t read the different cultural unspoken rules like she could have.� So Ms. Steck and Kent Kaufman, another coach at the center, began a one-year, once-a-weekindividual coaching program. It included role-playing and monthly group discussions with other female executives who acknowledged that they also had major blind spots about being politic at work. (The group was once nicknamed the Bully Broads.) When she came to the center, Ms. Lepori-Costello said, she thought her colleagues were not initially open to her ideas. Through coaching and conflict role-playing, she came to realize that her behavior was perhaps �too much overkill� and that she was not always attending to all the people around her. Joel H. Neuman, a researcher at the State University of New York at New Paltz, says most aggressive behavior at work is influenced by a number of factors associated with the bullies, victims and the situations in which they work. �This would include issues related to frustration, personality traits, perceptions of unfair treatment, and an assortment of stresses and strains associated with today�s leaner and �meaner� work settings,,� he said. Mr. Neuman and his colleague Loraleigh Keashly of Wayne State University have developed a questionnaire to identify the full range of behaviors that can constitute bullying, which could help companies uncover problems that largely go unreported. Bullying involves verbal or psychological forms of aggressive (hostile) behavior that persists for six months or longer. Their 29 questions include: Over the last 12 months, have you regularly: been glared at in a hostile manner, been given the silent treatment, been treated in a rude or disrespectful manner, or had others fail to deny false rumors about you? The Workplace Bullying Institute says that 37 percent of workers have been bullied. Yet many employers ignore the problem, which hits the bottom line in turnover, health care and productivity costs, the institute says. Litigation is rare, the institute says, because there is no directly applicable law to cite and the costs are high. Two Canadianresearchers recently set out to examine the bullying that pits women against women. They found that some women may sabotage one another because they feel that helping their female co-workers could jeopardize their own careers. One of the researchers, Grace Lau, a Ph.D. candidate at the University of Waterloo, said the goal was to encourage women to help one another. She said: �How? One way we predicted would be to remind women that they are members of the same group.� �We believe that a sense of pride in women�s accomplishments is important in getting women to help one another,� Ms. Lau said. �To have this sense of pride, women need to be aware of their shared identity as women.� In the workplace, however, it is unlikely that women will constantly think of themselves as members of one group, she said. They will more likely see themselves as individuals, as they are judged by their performance. �As a result, women may not feel a need to help one another,,� she said. �They may even feel that in order to get ahead, they need to bully their co-workers by withholding information like promotion opportunities, and that women are easier to bully than men because women are supposedly less tough than men.� Skip to next paragraph WHAT better place to be a bully than in a prison? Even so, that is exactly where Televerde, a company in Phoenix that specializes in generating sales leads and market insight for high-tech companies, set up shop. About 13 years ago, the company created four call centers in the Arizona state prison in Perryville, employing 250 inmates (out of 3,000). Through immersion training, mentoring and working with real-world clients, these women can overcome their difficult circumstances, said Donna Kent, senior vice president at Televerde. �Often, they will win over bullies and we see the whole thing transform. That�s what gives us inspiration and our clients inspiration.� TODAY, about half of Televerde�scorporate office is made up of �graduates� from Perryville, including Michelle Cirocco, the director of sales operations. She has seen how women treat one another in other settings and she thinks the root cause is that women are taught to fight with one another for attention at an early age. �We�re competing with our sisters for dad�s attention, or for our brother�s attention,� Ms. Cirocco said. �And then we go on in school and we�re competing for our teachers� attention. We�re competing to be on the sports team or the cheer squad.� To be sure, the Televerde experience is not for every inmate, and those who are in it still must work hard to maintain a highly competitive position. �As we get into the corporate world,� Ms. Cirocco added, �we�re taught or we�re led to believe that we don�t get ahead because of men. But, we really don�t get ahead because of ourselves. Instead of building each other up and showcasing each other, we�re constantly tearing each other down.Televerde reversed that attitude in Perryville, Ms. Cirocco said, by encouraging women to work for a common cause, much like the environment envisioned by the Canadian researchers. �It becomes a very nurturing environment,� Ms. Cirocco said. �You have all these women who become your friends, and you are personally invested in their success. I thought it was some kind of temp agency, but when they called to schedule an interview the guy told me the job would involve making sales (and he only told me after I asked him). It seemed a little shady to me, and way too easy to secure a job this way, so I looked some stuff up online and I found a huge amount of negative testimonials. Have you personally worked for them? I started a new job 2 months ago, which was advertised as 'up to £23k per annum'. I told the recruitment consultant I wanted £23k, and was told this would be passed on to the company. However, when I was offered the job, i was told the maximum salary was only £21k. As the job market is so bad, i said i would take the job anyway. Another employee who started the same job as me at the same time also had the same problem. They have since left, and the job is being advertised again with 3 different agencies as 'up to £23k per annum'. I feel this is unfair, but don't want to cause problems with my new employer. Hi there people, look I needed to ask this because I am in uproar with how things are being dealt with in the country, especially two that is 'unemployment' and 'redundancy'. Now i want to ask people round the county, do you ever see recruitment agencies advertising jobs that are non existent in your local job centre just so they can get you on their books, well I have heard rumours, and I for one think that is wrong and should be dis-allowed.
